JUSTICE DINESH MAHESHWARI\n\nMr.M.K.Garg     ) for the petitioner\nMr.Shrikant Verma)\n\nMr.O.P.Singaria, Public Prosecutor for the State\n                             .....\n\nBY THE COURT:<\/pre>\n<p>      This revision petition is directed against the judgment<\/p>\n<p>and order dated 09.06.1994 as passed by the Additional<\/p>\n<p>Sessions Judge No.2 Sriganganagar in Criminal Appeal<\/p>\n<p>No.81\/1992 whereby the learned Appellate Judge                partly<\/p>\n<p>allowed the appeal filed by the accused-petitioner against the<\/p>\n<p>judgment and order dated 31.08.1991 passed by the Chief<\/p>\n<p>Judicial   Magistrate,   Sriganganagar       in    Criminal   Case<\/p>\n<p>No.24\/1983; and,     while affirming the          conviction of the<\/p>\n<p>petitioner for the offence under Section 3\/7 of the Essential<\/p>\n<p>Commodities Act, altered the sentence awarded by the Chief<\/p>\n<p>Judicial Magistrate to that of rigorous imprisonment for three<\/p>\n<p>months with fine of Rs.1,000\/- and in default of payment of<\/p>\n<p>fine, to further simple imprisonment for one month.<\/p>\n<p>      The accusation in this case had been directed against<\/p>\n<p>the petitioner Subhash Chandra and one Niranjan Singh, said<\/p>\n<p>to be related with the firm Garg Fertilizer Company, Jawahar<\/p>\n<p>Market, Sriganganagar.     It was alleged that on 19.01.1979<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>Shyam Sunder Goswami, Enforcement Officer carried out<\/p>\n<p>inspection at the business premises of the said firm Garg<\/p>\n<p>Fertilizer Company and      found that there were 45 bags of<\/p>\n<p>manure    available in the shop allegedly purchased from one<\/p>\n<p>Darshan Singh who had purchased about 130 bags of manure<\/p>\n<p>from the godown of Kisan Co-operative Marketing Society. It<\/p>\n<p>was also alleged that 55 bags were sold by the firm to the<\/p>\n<p>customers without issuing bills and without even obtaining bills<\/p>\n<p>of purchase from Darshan Singh.       It was   alleged that the<\/p>\n<p>goods in question were not shown in the stock register either<\/p>\n<p>nor the firm had displayed the price and the stock position.<\/p>\n<p>The allegations were essentially         of violation of the<\/p>\n<p>requirements of Rajasthan Essential Commodities (Stock and<\/p>\n<p>Price) Order, 1977. Upon filing of the complaint and after the<\/p>\n<p>statement of PW-1 Shyam Sunder Goswami, Enforcement<\/p>\n<p>Officer, charges were framed against the petitioner and<\/p>\n<p>Niranjan Singh and after trial, while Niranjan Singh was<\/p>\n<p>acquitted, the petitioner was convicted by the learned Trial<\/p>\n<p>Court for the offence under Section 3\/7 of the Essential<\/p>\n<p>Commodities Act. The learned Appellate Court affirmed the<\/p>\n<p>finding of the learned Trial Court but reduced the sentence as<\/p>\n<p>noticed hereinbefore.\n<\/p>\n<p>      Seeking to assail the orders aforesaid, the learned<\/p>\n<p>counsel for the petitioner contended that the impugned orders<\/p>\n<p>stand vitiated for      the case having not been tried in a<\/p>\n<p>summary manner.         It is also submitted that   the learned<\/p>\n<p>Courts have acted illegally in not considering the testimony of<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>Darshan Singh DW-1 who clearly deposed that he had given<\/p>\n<p>the bags to the firm as against the amount due in him. The<\/p>\n<p>learned counsel further submitted that no independent<\/p>\n<p>witnesses have been examined in the case and rather the<\/p>\n<p>entire search proceedings were illegal for having been carried<\/p>\n<p>out without search warrant.          The learned counsel further<\/p>\n<p>submitted that there had otherwise not been any allegations of<\/p>\n<p>black marketing    against the petitioner and even if it were<\/p>\n<p>taken to be a case of mistake in making the requisite entries<\/p>\n<p>in the stock register, the petitioner ought not to have been<\/p>\n<p>visited with harsh punishment.\n<\/p>\n<p>      Having    given   a   thoughtful     consideration   to   the<\/p>\n<p>submissions and having examined the record, so far the<\/p>\n<p>conviction of the petitioner is concerned, this Court is unable to<\/p>\n<p>find any material illegality or irregularity in the orders as<\/p>\n<p>passed by the learned Magistrate and as affirmed by the<\/p>\n<p>learned Additional Sessions Judge nor could the trial be said<\/p>\n<p>to have vitiated nor any prejudice has been shown.<\/p>\n<p>      However, so far the quantum of punishment is<\/p>\n<p>concerned, it is noticed    that the accusation relates to the<\/p>\n<p>incident of the year 1979; and in its essence, the accusation<\/p>\n<p>against the petitioner had been of the technical offence in not<\/p>\n<p>maintaining the stock register properly. In the given set of<\/p>\n<p>facts and circumstances, the present one does not appear to<\/p>\n<p>be a case for imposing the sentence per Clause (a)(ii) of Sub-<\/p>\n<p>section (1) of Section 7 of the Essential Commodities Act. It is<\/p>\n<p>noticed that    the appeal was dismissed by the learned<br \/>\n<span class=\"hidden_text\">                                      4<\/span><\/p>\n<p>     Additional Sessions Judge on 09.06.1994 but execution of the<\/p>\n<p>     sentence was suspended by this Court in this revision petition<\/p>\n<p>     on 22.06.1994. The accused-petitioner has faced this case for<\/p>\n<p>     more than 30 years and taking into consideration the totality<\/p>\n<p>     of the circumstances including the        nature of accusation<\/p>\n<p>     coupled with the fact that the technical offence was committed<\/p>\n<p>     more than 30 years back, this Court is of opinion that no useful<\/p>\n<p>     purpose would be served with imprisonment of the petitioner at<\/p>\n<p>     this length of time; and interest of justice shall be served with<\/p>\n<p>     modification of the sentence awarded to the petitioner for<\/p>\n<p>     imprisonment     to    the   term    already   undergone    with<\/p>\n<p>     enhancement of fine following the decision of this Court in<\/p>\n<p>     Prabhu Dayal Vs. State of Rajasthan: 1990 Cr.L.R. (Raj.) 191.<\/p>\n<p>            Accordingly, this revision petition is partly allowed to<\/p>\n<p>     the extent indicated above. While the conviction of the<\/p>\n<p>     petitioner under Section 3\/7 of the Essential Commodities Act<\/p>\n<p>     is maintained, the sentence as awarded, in the given<\/p>\n<p>     circumstances, is altered to that of the period of imprisonment<\/p>\n<p>     already undergone but with a fine of Rs. 2,000\/- (two<\/p>\n<p>     thousand), and in default of payment of fine, to further undergo<\/p>\n<p>     three months&#8217; simple imprisonment.\n<\/p>\n<p>           The fine aforesaid shall be deposited by the petitioner in<\/p>\n<p>     the Trial Court within a period of three months failing which,<\/p>\n<p>     the learned Trial Court shall take appropriate steps in<\/p>\n<p>     accordance with law.\n<\/p>\n<\/p>\n<p>                                         (DINESH MAHESHWARI), J.\n<\/p>\n<p>MK\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Subhash Chander vs State on 26 March, 2010 1 S.B.
