M. SAHAI)<\/p>\n<p>1.\tList<br \/>\nhas been revised. No one has remained present for petitioner. We have<br \/>\nheard Ms. Vasavdatta M. Bhatt, learned advocate for respondents No.1<br \/>\nto 3.\n<\/p>\n<p>2.\tPetitioner<br \/>\nwas working as Soldier\/Sepoy in the Indian Army and he has been<br \/>\ndischarged from the Indian Army.\n<\/p>\n<p>3.\tThe<br \/>\nCentral Administrative Tribunal, Ahmedabad Bench, Ahmedabad has<br \/>\ndismissed OA No. 342 of 2003  with MA No. 510 of 2003 by order dated<br \/>\n7.10.2003 which is extracted below :\n<\/p>\n<p>&#8220;Heard<br \/>\nMr. C.M. Pawar for the applicant. The applicant, who was working as<br \/>\nSoldier\/Sepoy in the Indian Army, I Batalian, Mahar Reiment, has<br \/>\nmoved this OA challenging the provisional discharge certificate dated<br \/>\n12.10.1998 passed by the respondents as per the Army Rules. Since the<br \/>\napplicant was working as a regular soldier and he has been awarded<br \/>\nthe punishment under the Army Rules, in view of the provisions of<br \/>\nSection 2 of the Act, we have no jurisdiction to entertain and try<br \/>\nthis O.A. Section 2 clearly provides that the provisions of this Act<br \/>\nshall not apply to any Member of the Naval, Army and Air Force or any<br \/>\nother armed forces of the Union and as such, we cannot entertain and<br \/>\ntry the grievance raised by the applicant in this O.A. Since this<br \/>\nTribunal has no jurisdiction to entertain and try the OA, we direct<br \/>\nthe Registry to return the OA to the applicant for presentation to<br \/>\nthe proper forum retaining one set for record purpose. OA stands<br \/>\ndisposed of with no order as to costs. M.A. Also stands disposed of.<br \/>\n&#8221;\n<\/p>\n<p>4.\tWe<br \/>\nare in agreement with the view taken by the Tribunal. Further,<br \/>\npetitioner has prayed for pension and post retiral benefits. We are<br \/>\nof the opinion that since the petitioner has been discharged from the<br \/>\nIndian Army as he was habitual absentee, by way of punishment, he is<br \/>\nnot entitled for pension or post retiral benefits. Therefore, in view<br \/>\nof these reasons, this petition devoid of any merits and is<br \/>\naccordingly dismissed. Rule is discharged.
