S.J. MUKHOPADHAYA)<\/p>\n<p>1.\tThe<br \/>\nland in question was originally alloted in favour of the petitioner<br \/>\nin 1971, but having not utilized for the purpose for which it was<br \/>\nallotted, the allotment was cancelled on 24.08.1984.  After 22 years,<br \/>\nthe petitioner challenged the same, that too without enclosing the<br \/>\norder.  The Collector, Surendranagar, in appeal having rejected the<br \/>\nprayer on the ground of delay, the petitioner moved before the<br \/>\nrevisional authority, who also rejected the revision application on<br \/>\n24.02.2009 on the same ground of delay.\n<\/p>\n<p>2.\tThe<br \/>\nonly plea taken by the petitioner is that the order dated 24.08.1984<br \/>\nwas not made known to him, and no notice was given prior to issuance<br \/>\nof the same.\n<\/p>\n<p>3.\tPer<br \/>\ncontra, according to Mr. Jaswant K. Shah, learned A.G.P., who<br \/>\naccepted the notice and waived, the petitioner never utilized the<br \/>\nland for which it was allotted for more than 13 years and for the<br \/>\nsaid reason it was cancelled on 24.08.1984 after following the<br \/>\nprocedure, which was never challenged.  After 22 years, the appeal<br \/>\nhaving been preferred against the same, it was dismissed on the same<br \/>\nground by the revisional authority.\n<\/p>\n<p>4.\tIn<br \/>\nthe present case, as the petitioner has not enclosed a copy of the<br \/>\norder dated 24.08.1984, we are not in a position to express any<br \/>\nopinion with regard to the said order, nor the question of setting<br \/>\naside such order arises in absence of the same.\n<\/p>\n<p>5.\tLearned<br \/>\ncounsel appearing on behalf of the petitioner submits that the<br \/>\npetitioner may be given liberty to approach the authorities for<br \/>\nre-allotment of the land.  In this regard, we are not expressing any<br \/>\nopinion.  If it is permitted under law, petitioner may approach the<br \/>\nauthorities.  The Letters Patent Appeal and Civil Application both<br \/>\nstand disposed of with the aforesaid observations.
