The<br \/>\npetitioner has alleged that the action of the respondent is illegal<br \/>\nand arbitrary. The petitioner has prayed for direction against the<br \/>\nrespondents to reinstate the petitioner with consequential benefits.\n<\/p>\n<p>\tIn<br \/>\nview of the allegations made in the petition and relief prayed for,<br \/>\nit is apparent that adjudication would necessitate as well as<br \/>\ndocumentary evidence. It is also apparent that disputed questions of<br \/>\nfact are involved and raised in the petition, the resolution of which<br \/>\nwould also necessitate evidence. The petitioner has claimed that he<br \/>\nwas working as driver with the respondent. Thus, the petitioner has<br \/>\navailable unto him alternative statutory remedy where the claim of<br \/>\nthe petitioner is required to be adjudicated and the process of<br \/>\nleading oral evidence can be undertaken. In that view of the matter<br \/>\nthe petition does not deserve to be entertained and the petitioner is<br \/>\nrequired to be relegated to the alternative statutory remedy, more<br \/>\nparticularly because, as aforesaid, the adjudication and resolution<br \/>\nof the petitioner&#8217;s claim mandates oral and documentary evidence.\n<\/p>\n<p>\tLearned<br \/>\nCounsel for the petitioner had, on earlier occasion (i.e. yesterday<br \/>\nduring the hearing) requested for short adjournment to take<br \/>\ninstruction from his client as to whether his client would prefer to<br \/>\nwithdraw the petition with a view to approach alternative remedy.<br \/>\nHowever, today when the petition is taken up for hearing learned<br \/>\nadvocate for the petitioner is not present.
