 14 along with pillion rider towards Heggere to visit<\/p>\n

their relatives house, and when they reached near Raja
\nclay Works on N.H.No.206, the rider of  Victor<\/p>\n
bearing registration No. KA–Ol–Y–7238 carr1e.H:in:”pa..,:.Vrash<\/p>\n
and negligent manner and dashed agairrgt theiirx <\/p>\n
bike. As a result, the claiman.t’Afell\u00abdAown,a.rid\u00ab_sustained 7.<\/p>\n
injuries. Hence, he filed a petition -befo.rezth-ep<\/p>\n

Whether the quantum of
\n compensation awarded by the Tribunal is
\n just and proper or does it call for<\/p>\n
enhancement?\n<\/p>\n

6. Mter hearing the learned Counsel for the parties
\nand perusing the award of the Tribunal, I arngof the<\/p>\n
View that the compensation awarded by the  is<\/p>\n
not just and proper, it is on the lower  <\/p>\n
it is deserved to be enhanced,”   A<\/p>\n
7. As per wound certi\ufb01cate  “x.P.5;”ciia.i.rna1dt has’<\/p>\n
sustained the following\n<\/p>\n

P.Ws.’2V and 3 .res:pectix_fe’1y’.<\/p>\n
 I_i”3.W.3.’~%*Dr,._..7E’yagaraj, in his evidence has stated<\/p>\n
 has sustained Grade I compound<\/p>\n
.’ co’mrnin.a’t_e.dVsegmental fracture of both bones of right<\/p>\n
leg  he was operated and discharged on 13-~6–O7<\/p>\n
A   an advice to come for follow up treatment as out<\/p>\n
Vi\u00e9patient. Claimant was examined recently on 29-11-08<\/p>\n
and the following was noted :\n<\/p>\n
\u00ae(<\/p>\n
X~ray fracture well united. He has knee
\nmovements 0-90 degree, flexion and ankle, 0-10 degree
\ndorsi\ufb02exion and 0-10 degree plantar \ufb02exion_.-present<\/p>\n
unable to squat and sit cross leg. He has<\/p>\n
partial disability of 30% of that limb, <\/p>\n
body.\n<\/p>\n
8. Considering the 1:-.’atu_re
\nawarded by the Tribunal and\ufb01suffering is
\non the lower side   to be enhanced by
\nanother Rs,_2dO,,_0()Q\/3″aridl_1’ii.c,l:awai*d::..All.tis..30,000\/– under
\nthis  5:.~;i. * 0 1 V 0 ll\n<\/p>\n
9.  As-A  by the Tribunal towards<\/p>\n
medica14_lexpensesl  per medical bills produced by<\/p>\n
ciairriariathe same is just and proper and therefore,<\/p>\n
\u00bb  ” -it doe’synot- call for enhancement.<\/p>\n
  was treated as inpatient for 1 1 days in<\/p>\n
‘lbrthopaedic and Trauma Centre, B.H.Road,<\/p>\n
 ” Vtlfurnlltur. Considering the same, Rs.5,000\/– awarded by<\/p>\n
  Tribunal towards incidental expenses such as<\/p>\n
\ufb01g<\/p>\n
Conveyance, nourishment and attendant charges is on
\nthe lower side and it is deserved to be enhanced by
\nanother Rs.5,000\/– and I award Rs. 10,000\/– under this<\/p>\n
head.\n<\/p>\n
11. Claimant claims to have been <\/p>\n
per month, by working as an. ,Qperator::F[;nd”Kirlosl\u00a7arn\u00bb_ <\/p>\n
Electric Co. Nature of injuries
\nbeen under rest and treatrne:nt” tor  “of
\nmonths. Thereforexa  Rs.1\u00a2l.500\/ awarded
\ntowards loss of incolrnae’   as against<\/p>\n

Rs.2,621 \/_–y agmrde.aii5y gne1.\u00abg.b.mas. <\/p>\n
  in his evidence that even
\nafter  \u00bb 11%}-\u00aburies, he has continued his<\/p>\n
 said Kirloskar Electric Co. Hence,<\/p>\n
‘ ,..V”qV11yestion’v..of, awarding compensation towards loss of<\/p>\n
 future’inr:ome does not arise. Nevertheless, he has to<\/p>\n
bearhwith the disability stated by the doctor at 30% to<\/p>\n
  and 10% to whole body, in addition to certain<\/p>\n
 amount of discomfort and unhappiness which he has to<\/p>\n
undergo for the rest of his life. Therefore, Rs.5,000\/–
\n8%.\n<\/p>\n
awarded by the Tribunal towards loss of amenities is on
\nthe lower side and it is deserved to be enhanced and 1
\naward Rs.50,000\/– under this head. _ pp<\/p>\n
13. Thus the claimant is entitled for <\/p>\n
compensation:\n<\/p>\n

14. Accordirigiy   in part and the<\/p>\n
Judgment of the Tribunal is modified to the
\nextentddttstateddttherein.above. The claimant is entitled for<\/p>\n
 compe.n.s_ation of Rs.1,52,361\/~ as against<\/p>\n
a  iv.4(:)”O_,4S2-A\/~ awarded by the Tribunal with interest at<\/p>\n
   the enhanced compensation of Rs.51,879\/-<\/p>\n
rounded of to Rs.52,000\/- from the date of claim<\/p>\n
in . jppejtition till the date of realisation.<\/p>\n
 15. The Insurance Co. is directed to deposit the<\/p>\n
enhanced compensation amount with interest within<\/p>\n
two months from the date of receipt of a copy of this<\/p>\n
judgment.\n<\/p>\n
16. Out of the enhanced Compensation” <\/p>\n
proportionate interest is ordered to  <\/p>\n
in any nationalized or scheduled-Biankd of -i<\/p>\n
the Claimant for a period  6  Varid’the.,rernaiini–ng
