SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/07\/2010 \n\n \n\nORAL ORDER<\/pre>\n<p>\tBy<br \/>\n\tway of this petition under Article 226 of the Constitution of India,<br \/>\n\tthe petitioner has prayed for the following main reliefs in para<br \/>\n\t17:-\n<\/p>\n<p> (a)\tThis<br \/>\nHon&#8217;ble Court be pleased to issue a writ of mandamus and\/or any other<br \/>\nappropriate writ, order or direction in the  nature of mandamus<br \/>\nholding and declaring that the entry No.1480 dated 15.01.1990 which<br \/>\nis effected retrospectively is illegal and void and the same be<br \/>\nquashed and set aside.\n<\/p>\n<p>(b)\tBy<br \/>\nappropriate writ, order or direction, this  Hon&#8217;ble Court  be pleased<br \/>\nto hold and declare  that the petitioner<br \/>\n is entitled to hold the possession of 4 Acres  and 1<br \/>\nGuntha as the owner of the land of Survey No.259 and Old Survey<br \/>\nNo.478.\n<\/p>\n<p>(c)\tBy<br \/>\nappropriate writ, order or direction, this Hon&#8217;ble Court be pleased<br \/>\nto hold and declare the Annexure-F in which the reduced land in the<br \/>\nname of the petitioner<br \/>\n is shown as 1 Hactare and 45 Gunthas as  illegal and<br \/>\nAnnexure-F be quashed and set aside and the entries thereof which are<br \/>\nreflected be also quashed and set aside.\n<\/p>\n<p>(d)\tThis<br \/>\nHon&#8217;ble Court  be pleased to hold and declare that the petitioner<br \/>\n is in possession of the land admeasuring 4 Acres and 1<br \/>\nguntha and the same cannot be reduced under any circumstances.\n<\/p>\n<p>Having<br \/>\n\theard Mr.M.B. Gandhi, learned advocates appearing on behalf of the<br \/>\n\tpetitioner<br \/>\n\t  and Mr.Patel, learned<br \/>\n\tadvocate appearing on behalf of the private<br \/>\n\trespondents  it appears that the reliefs prayed by the petitioner<br \/>\n\t two folds, (i), challenging the Mutation Entry<br \/>\n\tNo.1480 dtd.15\/1\/1990 and another is with respect to ownership and<br \/>\n\tpossession of 4 Acres and 1 Guntha  of land  of Survey No.259 and<br \/>\n\tOld Survey No.478. As such, the petitioner<br \/>\n\t cannot be permitted to challenge the mutation entry<br \/>\n\twhich was made in the year 1990. Even otherwise as per the settled<br \/>\n\tlaw, mutation entry does not confer any right, title or interest in<br \/>\n\tfavour of a person whose name is mutated in the revenue record. The<br \/>\n\tsame are for fiscal purpose for collecting tax. Mutation Entry can<br \/>\n\tbe challenge before the appellate authority \/ revisional authority<br \/>\n\tas provided under Rule 108 of the Land Revenue Rules and therefore,<br \/>\n\tthe dispute with respect to mutation entry straightway cannot be<br \/>\n\tconsidered in a petition under Article 226 of the Constitution of<br \/>\n\tIndia.\n<\/p>\n<p>Now,<br \/>\n\tso far as the other reliefs sought by the petitioner<br \/>\n\tare with respect to ownership and right claimed by the petitioner<br \/>\n\t and possession of the disputed land in question and<br \/>\n\tit appears that there is a dispute between two private persons with<br \/>\n\trespect to ownership and possession, which is not required to be<br \/>\n\tconsidered by this Court in exercise of powers under Article 226  of<br \/>\n\tthe Constitution of India. If there is any dispute with respect to<br \/>\n\ttitle and\/or possession  of the land in question, in that case, the<br \/>\n\tpetitioner<br \/>\n\t and\/or aggrieved party has to approach the Civil<br \/>\n\tCourt for establishing right by way of claiming  decree of<br \/>\n\tdeclaration  and permanent injunction and\/or even praying for decree<br \/>\n\tof possession. The aforesaid aspect being a disputed question of<br \/>\n\tfact, cannot be considered in a petition under Article 226 of the<br \/>\n\tConstitution of India.
