No.21483 of 2010\n                          ANIL RAI son of Indradeo Rai\n                                     Versus\n                            THE STATE OF BIHAR\n                                    -----------\n<\/pre>\n<p>2\/   28.06.2010              Heard learned counsel for the petitioner and the State.<\/p>\n<p>                                 The petitioner seeks bail in a case instituted for the<\/p>\n<p>                   offence under sections 302,201\/34 of the Indian Penal Code.<\/p>\n<p>                                 It has been submitted that the petitioner is named in the<\/p>\n<p>                   First Information Report even though he is merely a neighbour of the<\/p>\n<p>                   co-accused Ramesh and the deceased and had no motive to commit the<\/p>\n<p>                   murder of the deceased. It has further been submitted that there is no<\/p>\n<p>                   eye witness to the occurrence and entire case is based on mere<\/p>\n<p>                   suspicion.\n<\/p>\n<p>                                 In view of such, let the petitioner, above named, be<\/p>\n<p>                   released on bail on furnishing bail bond of Rs.5,000\/- (five thousand)<\/p>\n<p>                   with two sureties of the like amount each to the satisfaction of the<\/p>\n<p>                   Chief Judicial Magistrate, Bhojpur, Ara, in connection with Piro P.S.<\/p>\n<p>                   Case No.133 of 2009, subject to the conditions (i)That one of the<\/p>\n<p>                   bailors will be a close relative of the petitioner, who will give an<\/p>\n<p>                   affidavit giving genealogy as to how he is related with the petitioner.<\/p>\n<p>                   The bailors will undertake to furnish information to the court about<\/p>\n<p>                   any change in the address of the petitioner, (ii)That the affidavit shall<\/p>\n<p>                   clearly state that the petitioner is not accused in any other case and, if<\/p>\n<p>                   he is, he shall not be released on bail, (iii) That the petitioner will give<\/p>\n<p>                   an undertaking that he will receive the police papers on the given date<\/p>\n<p>                   and be present on date fixed for charge and if he fails to do so on two<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>       given dates and delays the trial in any manner, his bail will be liable to<\/p>\n<p>       be cancelled for reasons of misuse.\n<\/p>\n<\/p>\n<pre>JA\/-                                    (Anjana Prakash, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Anil Rai vs The State Of Bihar on 28 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
