JUSTICE KISHORE KUMAR MANDAL)<\/p>\n<p>6   09-11-2011            Heard both sides.\n<\/p>\n<p>                          Petitioner approached this Court seeking a direction upon<\/p>\n<p>                 the respondents to appoint him on the post of Sweeper in the Bank<\/p>\n<p>                 of India (for short &#8220;the Bank&#8221;) primarily on the ground that earlier<\/p>\n<p>                 also a selection process was gone into in which the petitioner was<\/p>\n<p>                 selected.\n<\/p>\n<p>                          The respondent Bank has filed a counter affidavit to<\/p>\n<p>                 oppose the prayer made in the writ petition. Paragraphs 8, 9 and 10<\/p>\n<p>                 thereof read as under:\n<\/p>\n<blockquote><p>                        &#8220;8. That it is further relevant to mention here that a<br \/>\n                        fresh guidelines was received from Head Office Vide<br \/>\n                        IOM No. HO:HR:IRVGK:I-160 dated 08.05.2010. In<br \/>\n                        terms of revised guidelines, Bank cancelled the earlier<br \/>\n<span class=\"hidden_text\"> Patna High Court CWJC No.12141 of 2011 (6) 2dt.09-11-2011<\/span><\/p>\n<p>                     recruitment process which was initiated vide<br \/>\n                     advertisement dted 13.06.2009 and initiated a fresh<br \/>\n                     recruitment process vide Advertisement dated<br \/>\n                     17.08.2010, wherein higher educational qualification<br \/>\n                     ceiling was removed. The said advertisement was<br \/>\n                     again sent to respective District Employment<br \/>\n                     Exchange and to the branches where the vacancy<br \/>\n                     existed so that eligible candidates can apply for the<br \/>\n                     said post. In the said fresh recruitment process, Smt.<br \/>\n                     Urmila Devi also applied vide her application dated<br \/>\n                     06.09.2010. In the light of the fresh recruitment<br \/>\n                     process her application was considered and she was<br \/>\n                     called for interview on 06.10.2010 along with other<br \/>\n                     candidates vide letter dated 29.09.2010 of the Bank.\n<\/p><\/blockquote>\n<blockquote><p>                     9.     That the petitioner appeared for interview on<br \/>\n                     06.10.2010 as per fresh recruitment process but this<br \/>\n                     time her name was not recommended by the Interview<br \/>\n                     Committee and as such she was not selected for the<br \/>\n                     said post of Safai Karamchari by the Respondent<br \/>\n                     Bank.\n<\/p><\/blockquote>\n<blockquote><p>                     10. Although the interview Board has earlier<br \/>\n                     recommended her name for appointment but it was not<br \/>\n                     to be construed to be a letter of appointment because<br \/>\n                     Bank reserve the right to cancel the candidature of any<br \/>\n                     applicant before giving final letter of appointment.<br \/>\n                     Moreover, the aforesaid act of Bank was challenged by<br \/>\n                     some other petitioners in C.W.J.C. No. 12953 of 2010<br \/>\n                     before the Hon&#8217;ble High Court, Patna but the Hon&#8217;ble<br \/>\n                     High Court dismissed the said petition vide its order<br \/>\n                     dated 03.09.2010 concluding that they do not appear to<br \/>\n                     be any illegality in the act of Bank in withdrawing the<br \/>\n                     earlier    advertisement      and    publishing   fresh<br \/>\n                     advertisement dated 17.08.2010 deleting the maximum<br \/>\n                     qualification clause.&#8221;<\/p><\/blockquote>\n<p>                        Learned counsel for the petitioner fairly states that by<\/p>\n<p>             virtue of earlier selection process undergone by the respondent<\/p>\n<p>             Bank, no vested legal right accrued to her. It has been contended<\/p>\n<p>             that the petitioner has sought relevant information from the Bank<br \/>\n<span class=\"hidden_text\">       Patna High Court CWJC No.12141 of 2011 (6) 3dt.09-11-2011<\/span><\/p>\n<p>                   and awaiting for the same.\n<\/p>\n<p>                              Regard being had to the submission of the parties and the<\/p>\n<p>                   stand taken by the respondent Bank noted above, this Court is not<\/p>\n<p>                   inclined to accede to the request of the petitioner.<\/p>\n<p>                              The application is dismissed. It will, however, be open to<\/p>\n<p>                   the petitioner to seek relevant informations and thereafter pursue<\/p>\n<p>                   her remedy in accordance with law.\n<\/p>\n<\/p>\n<p>                                              (Kishore K.
