Justice R.BASANT\n\n Dated :14\/12\/2007\n\n O R D E R\n                            R.BASANT, J.\n                         ----------------------\n                      Crl.M.C.No.3749 of 2007\n                     ----------------------------------------\n           Dated this the 14th day of December 2007\n\n                                O R D E R\n<\/pre>\n<p>     The petitioner faces indictment in a prosecution under<\/p>\n<p>Section 498A read with 34 I.P.C. Cognizance has been taken on<\/p>\n<p>the basis of a final report submitted by the police. The petitioner<\/p>\n<p>did appear and get himself enlarged on bail. But subsequently<\/p>\n<p>the petitioner has not been able to appear.                    Consequently<\/p>\n<p>coercive processes have been issued against the petitioner by<\/p>\n<p>the learned Magistrate.          The petitioner finds such processes<\/p>\n<p>chasing him.\n<\/p>\n<p>     2.    The learned counsel for the petitioner submits that<\/p>\n<p>the petitioner is absolutely innocent.              His absence earlier was<\/p>\n<p>not wilful or deliberate. The petitioner is willing to surrender<\/p>\n<p>before the learned Magistrate and seek regular bail. But he<\/p>\n<p>apprehends that his application for bail may not be considered<\/p>\n<p>by the learned Magistrate on merits, in accordance with law and<\/p>\n<p>expeditiously.      He, therefore, prays that directions under<\/p>\n<p>Section 482 Cr.P.C. may be issued to the learned Magistrate to<\/p>\n<p>release the petitioner on bail when he appears and applies for<\/p>\n<p>bail.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3749\/07                 2<\/span><\/p>\n<p>      3.    It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate and explain to the learned Magistrate, the<\/p>\n<p>circumstances under which he could not earlier appear before<\/p>\n<p>the learned Magistrate.      I find absolutely no reason to assume<\/p>\n<p>that the learned Magistrate would not consider the application<\/p>\n<p>for bail to be filed by the petitioner on merits, in accordance with<\/p>\n<p>law and expeditiously.      Every court must do the same.       No<\/p>\n<p>special or specific directions appear to be necessary. Sufficient<\/p>\n<p>general directions have been issued in <a href=\"\/doc\/147290035\/\">Alice George vs. Deputy<\/p>\n<p>Superintendent of Police<\/a> [2003(1)KLT 339].<\/p>\n<p>      4.    In the result, this Criminal Miscellaneous Case is<\/p>\n<p>dismissed but with the specific observation that if the petitioner<\/p>\n<p>surrenders before the learned Magistrate and applies for bail,<\/p>\n<p>after giving sufficient prior notice to the Prosecutor in charge of<\/p>\n<p>the case, the learned Magistrate must proceed to pass<\/p>\n<p>appropriate orders on merits, in accordance with law and<\/p>\n<p>expeditiously &#8211; on the date of surrender itself.<\/p>\n<p>      5.
