SUJATA V. MANOHAR, J.\n<\/p>\n<p>     The  respondent  was  appointed  as  Assistant  Medical<br \/>\nOfficer in  the Railways  on ad\t hoc basis in 1986. His case<br \/>\nalong with  the case  of  other\t ad  hoc  Assistant  Medical<br \/>\nOfficers was referred to the Union Public Service Commission<br \/>\nfor the purpose of regularisation. The Commission, after the<br \/>\nscrutiny  of  the  confidential\t Service  record  and  after<br \/>\nconducting an  interview,  has\trejected  the  case  of\t the<br \/>\nrespondent for\tregularisation. The Tribunal however, by its<br \/>\norder (dated  3rd November,  1992 has directed that the case<br \/>\nof the\t respondent should be considered de novo only on the<br \/>\nbasis of  his service  record\tand he should be retained in<br \/>\nservice if  found fit  on a regular basis. Hence the present<br \/>\nappeal.\n<\/p>\n<p>     The case  of the  respondent is  squarely covered\tby a<br \/>\ndecision of  this Court\t in <a href=\"\/doc\/170471\/\">Union of India &amp; Ors. v. Dr.Gyan<br \/>\nPrakash Singh<\/a> (1994 Suppl. (l) SCC 306) where this Court has<br \/>\nlaid down that the decision of this Court in <a href=\"\/doc\/1707104\/\">Dr. A.K. Jain &amp;<br \/>\nOrs. v.\t Union of  India &amp;  Ors.<\/a> [(1988)  1  SCR  335)\tonly<br \/>\napplies to ad hoc Assistant Medical Officers appointed prior<br \/>\nto 1st\tOctober, 1984.\tThe  Court  further  held  that\t the<br \/>\nrespondent in  that case who was appointed 1st October, 1984<br \/>\nwas found  unfit by  the Union Public Service Commission and<br \/>\nhence could  not be  regularised. The  facts of\t the present<br \/>\ncase are  similar to  those in the <a href=\"\/doc\/24214\/\">Case of Union of India v.<br \/>\nGyan Prakash  Singh<\/a>(supra). The\t respondent was appointed on<br \/>\nad hoc\tbasis much  after 1st  October, 1984.  He was  found<br \/>\nunfit  for   regularisation  by\t the  Union  Public  Service<br \/>\nCommission. Hence  the appellant  has correctly\t declined to<br \/>\ncontinue him.\n<\/p>\n<p>     We have  seen the\tcounter affidavit  of the respondent<br \/>\nand the\t documents annexed.  The letter of appointment dated<br \/>\n8.7.1995 pertaining  to the  respondent\t has  been  produced<br \/>\nbefore us.  The letter\tsets out that the appointment of the<br \/>\nrespondent will\t be purely  temporary on  ad hoc basis for a<br \/>\nperiod of six months or till the respondent is replaced by a<br \/>\ncandidate selected  by the  Union Public Service Commission,<br \/>\nwhichever  is\tearlier.  The  letter  further\tprovides  as<br \/>\nfollows:-\n<\/p>\n<p>     &#8220;In   case\t   your\t  services   are<br \/>\n     continued on  ad hoc  basis  beyond<br \/>\n     six  months   due\tto  shortage  of<br \/>\n     candidates duly  selected by UPSC ,<br \/>\n     and if  you fail to get selected in<br \/>\n     the\t   selection\/Competitive<br \/>\n     examinations held\tby the\tUPSC  on<br \/>\n     three successive  occasions  or  do<br \/>\n     not   avail    of\t three\t chances<br \/>\n     successively, your service shall be<br \/>\n     terminated.&#8221;\n<\/p>\n<p>     Pursuant to  this appointment letter the respondent was<br \/>\nappointed as  Assistant Medical Officer on ad hoc basis with<br \/>\neffect from  9.1.1986. The appellant has filed an additional<br \/>\naffidavit which\t sets out  that the  respondent did not make<br \/>\nuse of any of the chances available to him. The Union Public<br \/>\nService Commission  had conducted  competitive\texaminations<br \/>\nevery year.  The particulars of these examinations are given<br \/>\nin the\tsaid affidavit\tof Ashok  Bhandari,  Joint  Director<br \/>\nEstt.(Gaz), Railway  Board, New\t Delhi dated  9th of  April,<br \/>\n1996. It sets out, inter alia, that the Union Public Service<br \/>\nCommission notified  Combined Medical  Services\t Examination<br \/>\n(CMSE) 1986  on 12.10.1985. The written examination was held<br \/>\non 6.4.1986  and interviews  were held\tduring the months of<br \/>\nOctober-November 1986.\tThe results  were declared on 4.3.87<br \/>\nCMSE 1987  was notified\t by the\t UPSC on  11.10.86 for which<br \/>\nwritten examination was held on 5.4.1987 and interviews were<br \/>\nheld during  October-November 1987  and final  results\twere<br \/>\ndeclared on  14.31988. CMSE  1988 was  notified by  UPSC  on<br \/>\n19.987. Written\t examination was  held on  28.2.88  and\t the<br \/>\ninterviews were\t held in October-November 1988 and the final<br \/>\nresults were declared on 5.12.1988. Similar examinations had<br \/>\nbeen held every year thereafter in 1989,1990 and 1992 and so<br \/>\non. The respondent did not avail of three successive chances<br \/>\nand more to get himself qualified through these examinations<br \/>\nfor his\t regular appointment.  Apart from  these competitive<br \/>\nexaminations  a\t special  selection  for  regularisation  of<br \/>\nexisting ad  hoc  doctors  of  the  railways  who  had\tbeen<br \/>\nappointed after\t 1.10.84, was  conducted by the Union Public<br \/>\nService Commission.  He was, however, not found suitable for<br \/>\nregularisation by  the Union  Public Service Commission and,<br \/>\ntherefore, the\tservices of  the respondent were terminated.<br \/>\nThus the termination of the respondent is in accordance with<br \/>\nthe terms  of his appointment as also the ratio laid down by<br \/>\nthis court  in the  case of  <a href=\"\/doc\/24214\/\">Union Of  India v. Gyan Prakash<br \/>\nSingh<\/a>(supra).\n<\/p>\n<p>     The respondent  has relied upon the order of this Court<br \/>\nin the\tcase <a href=\"\/doc\/1684427\/\">Union  of India  v. S.K.  Rajan<\/a> dated 23.8.1993<br \/>\n(S.C.Agrawal and  Sahai JJ.)  in SLP No. 10807\/93 dismissing<br \/>\nthe SLP\t 7318\/95 and Ca 7471\/94 respectively. The two latter<br \/>\norders have  relied upon  the dismissal\t of SLP\t in <a href=\"\/doc\/1684427\/\">Union of<br \/>\nIndia v.  S.K. Rajan<\/a>  (supra) which  was against  the  order<br \/>\npassed by  the Madras  Bench of\t the Central  Administrative<br \/>\nTribunal came  to the conclusion, after nothing the terms of<br \/>\nthe appointment\t letter, that  the applicant  there was\t not<br \/>\ngiven three successive chances in the selection conducted by<br \/>\nthe UPSC.  Hence he  should not be discontinued unless he is<br \/>\ngiven these  three successive  chances and fails to qualify.<br \/>\nThe ratio  of that decision will not have any application to<br \/>\nthe present  case in  View of the facts already set out. The<br \/>\nthree orders of dismissal of SLPS\/CAs of this Court are non-<br \/>\nspeaking orders. Presumably, looking to the reasoning of the<br \/>\nTribunal in  the  orders  impugned  in\tthose  cases,  three<br \/>\nchances were  not given\t to the\t ad  hoc  Assistant  Medical<br \/>\nOfficers before\t termination of\t service as set out in their<br \/>\nappointment letters.  The present  case is not of that type.<br \/>\nThe termination\t of the\t respondent is\tin a accordance with<br \/>\nthe terms  of his  letter of appointment and is based on his<br \/>\nfailure to qualify for regularisation as per his appointment<br \/>\nletter and  also in  the special  selection.  His  case\t is,<br \/>\ntherefore, covered  by the  ratio of  this Court in <a href=\"\/doc\/340656\/\">Union of<br \/>\nIndia v. Gyan Parkash Singh<\/a> (supra).\n<\/p>\n<p>     The   respondent\thas   also   relied   upon   certain<br \/>\nobservations in\t the case  of Dr.  A.K Jain and Ors. (supra)<br \/>\nrelating  to  the  discharge  of  ad  hoc  medical  officers<br \/>\nappointed after 1.10.1984 . In view of the clear findings of<br \/>\nthis Court  in the  case of  Gyan Prakash Singh (supra), the<br \/>\nobservations made  therein cannot be pressed into service in<br \/>\nthe present  case. An  ad hoc officer who has not availed of<br \/>\nthree successive chances for regularisation and has not been<br \/>\nfound suitable\tfor regularisation in a special selection by<br \/>\nthe Union  Public Service  Commission Can  be  removed\tfrom<br \/>\nservice.\n<\/p>\n<p>     The appeal\t is,  therefore\t allowed  and  the  impugned<br \/>\njudgment and order is set aside.
