THOMAS\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t      J U D G M E N T<br \/>\n     Thomas, J.\n<\/p>\n<p>     The six  appellants before us were among the 14 accused<br \/>\narrayed in the Sessions court indicted for the murder of one<br \/>\nRam deo\t Yadav during  the wee\thours on 30th October, 1975.<br \/>\nAlthough the  Sessions\tCourt  convicted  all  the  thirteen<br \/>\naccused of  the offences of rioting and murder (with the aid<br \/>\nof section 149 IPC)  the High Court confirmed the conviction<br \/>\nonly in respect of the seven appellants before us. They have<br \/>\nbeen sentenced\tto imprisonment\t for life for the offence of<br \/>\nmurder and  to rigorous\t imprisonment for  two years for the<br \/>\noffence under section 148, Indian Penal Code.\n<\/p>\n<p>     Facts are\tSimple :  Deceased Ram deo Yadav and his son<br \/>\nGajendra Yadav\t(PW 8)\tafter their dinner at home went to a<br \/>\nnearby field  presumably  for  watching\t the  crop  thereon.<br \/>\nDeceased went  to sleep on a wooden plank in one field while<br \/>\nhis son (PW 8) slept in the adjoining field. Some time after<br \/>\nmidnight these\tappellants and few others came to this place<br \/>\narmed with  lethal weapons  such as spears (bhala) and gupti<br \/>\nand surrounded\tRam deo\t Yadav, dragged him out and showered<br \/>\nbloody assault\ton him\twith the weapons. Gajendra Yadav (PW\n<\/p>\n<p>8) on hearing the sound of a commotion woke up and rushed to<br \/>\nthe  scene  with  his  torchlight  and\tsaw  the  assailants<br \/>\nattacking his  father. He  made a  hue and cry, but somebody<br \/>\namong the assailants snatched away his torchlight. By then a<br \/>\nfew of the neighbouring cultivators rushed to the scene. The<br \/>\nassailants who\tsucceeded  in  inflicting  large  number  of<br \/>\ninjuries on  the deceased  fled\t from  the  place  with\t the<br \/>\nweapons. Ramdeo Yadav who sustained extensive wounds died on<br \/>\nthe spot.\n<\/p>\n<p>     Gajendra Yadav  went to  the local\t Police Station\t and<br \/>\nlodged\tthe   complaint\t on  the  basis\t of  which  FIR\t was<br \/>\nregistered. After  completing  investigation  the  case\t was<br \/>\ncharge-sheeted against the fourteen accused.\n<\/p>\n<p>     There is  no dispute that Ram deo Yadav was murdered at<br \/>\nthe time  and place  mentioned by the prosecution. The large<br \/>\nnumber of  anti-mortem injuries\t observed by  the doctor who<br \/>\nconducted the  autopsy have been detailed in the post-mortem<br \/>\ncertificate. Some  of the injuries have perforated his vital<br \/>\norgans and without difficulty we could observe that deceased<br \/>\nwould have died instantaneously.\n<\/p>\n<p>     Among the eye-witnesses examined by the prosecution the<br \/>\nevidence of  PW5 &#8211; Sipehi Yadav, PW6 &#8211; Harilal Yadav and PW8\n<\/p>\n<p>&#8211; Gajendra  Yadav was  found reliable by the Sessions Court.<br \/>\nBut High  Court did not act on the evidence of Harilal Yadav<br \/>\n(PW 6).\t However, the  evidence of  PW\t8  was\tfound  quite<br \/>\nreliable, yet the High Court chose to confirm the conviction<br \/>\nonly as against the appellants since the version of PW 8 was<br \/>\ncorroborated by PW 5  only in respect of them.\n<\/p>\n<p>     Learned  senior   counsel\tconfined  his  arguments  to<br \/>\nassailing the  evidence of  PW 5 and PW 8 and contended that<br \/>\nthe said  evidence should  not have  been relied  on due  to<br \/>\ncertain drawbacks  high-lighted before\tus. According to the<br \/>\nlearned counsel,  as the  High Court  did not  rely  on\t the<br \/>\nevidence of  PW 8  in regard  to the  acquitted\t accused  it<br \/>\nshould have  been a  logical step to spurn down his evidence<br \/>\neven in regard to the appellants as well.\n<\/p>\n<p>     This is not a case where the High Court declined to act<br \/>\non the\ttestimony of  PW 8. In fact, High Court has observed<br \/>\nin clear  terms that  there  is\t no  reason  to\t reject\t the<br \/>\nevidence of PW 8, though High Court was not inclined to base<br \/>\na conviction  on his  evidence\twithout\t corroboration\tfrom<br \/>\nother materials.  If the  High Court  thought it  unsafe  to<br \/>\nconvict any of the accused on the uncorroborated evidence of<br \/>\na single  eye-witness it  does not mean that the evidence of<br \/>\nthe witness  stands castigated. It is no stigm a against the<br \/>\nevidence of  any eye-witness  if the  Court only  wanted re-<br \/>\nassurance from yet other sources. The corroboration was what<br \/>\nthe court  required as a matter of prudence and as a step of<br \/>\ncaution. The  premise  of  the\tcontention  of\tthe  learned<br \/>\ncounsel that  evidence of  PW 8\t has  been  stigmatised\t is,<br \/>\ntherefore, erroneous.\n<\/p>\n<p>     Another point upon which learned counsel harped heavily<br \/>\nwas the\t failure of  the investigating\tofficer to seize the<br \/>\ntorchlight which  the eye-witnesses  claimed to have flashed<br \/>\nfor witnessing\tthe occurrence.\t We are unable to appreciate<br \/>\nthis argument.\tIf the\taccused had  used a torchlight or if<br \/>\nthe victim  had a  torchlight with him during the occurrence<br \/>\nthere  would   be  much\t  force\t in   insisting\t  that\t the<br \/>\ninvestigating\tofficer should\thave seized  it as  the same<br \/>\ncould be  used as  a material  object  during  trial  but  a<br \/>\ntorchlight used\t by the witness to see the occurrence cannot<br \/>\nbe equated  with the  torchlight used  buy the victim or the<br \/>\nassailants in  the encounter  for evidentiary  purposes. Non<br \/>\nseizure\t of   such  a\ttorchlight  cannot,   therefore,  be<br \/>\nconsidered as  a lapse\ton the\tpart  of  any  investigating<br \/>\nofficer, much  less a ground for impairment of the testimony<br \/>\nof the eye-witness concerned.\n<\/p>\n<p>     It was lastly contended that the weapons which the eye-<br \/>\nwitnesses identified  in the  hands of\tthe  appellants\t are<br \/>\ntotally incompatible  with the\t injuries  found on the dead<br \/>\nbody of\t the deceased.\tApparently, those were sharp cutting<br \/>\nweapons. One  of them  could have  been a  pointed and sharp<br \/>\nweapon. All the injuries of the deceased were incised wounds<br \/>\nand two\t of them had penetrated into the body and perforated<br \/>\nsome of\t the vital  organs. The\t doctor\t who  conducted\t the<br \/>\nautopsy has  said in  evidence that  the injuries  which  he<br \/>\nnoticed could have been caused with those weapons.\n<\/p>\n<p>     None of  the points  raised before\t us by\tt he learned<br \/>\ncounsel for  the  appellants  is  capable  of  changing\t the<br \/>\nconclusion reached by the High Court against the appellants.<br \/>\nAccordingly, we dismiss the appeal.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Balo Yadav And Others vs State Of Bihar on 29 April, 1997 Author: Thomas Bench: G.N.
