{"id":204641,"date":"2010-08-03T00:00:00","date_gmt":"2010-08-02T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/ramesh-prasad-verma-vs-secretary-the-state-of-madhya-on-3-august-2010"},"modified":"2017-07-26T00:53:04","modified_gmt":"2017-07-25T19:23:04","slug":"ramesh-prasad-verma-vs-secretary-the-state-of-madhya-on-3-august-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/ramesh-prasad-verma-vs-secretary-the-state-of-madhya-on-3-august-2010","title":{"rendered":"Ramesh Prasad Verma vs Secretary The State Of Madhya &#8230; on 3 August, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">Ramesh Prasad Verma vs Secretary The State Of Madhya &#8230; on 3 August, 2010<\/div>\n<pre>                  Writ Appeal No.704\/2010\n03.08.2010\n\n      Shri Vijay Nayak, learned counsel for the appellant.\n      Shri Kumaresh Pathak, learned Deputy Advocate\nGeneral for the respondents on advance notice.<\/pre>\n<p>      Heard on the question of admissio.\n<\/p>\n<p>      This intra-court appeal preferred against the order<br \/>\ndated 19.7.2010 passed by learned Single Judge in Writ<br \/>\nPetition No.9206\/2010 (S), by which the writ petition has<br \/>\nbeen dismissed.\n<\/p>\n<p>      The appellant has been posted as a Head Master in<br \/>\nGovernment Primary School, Panwari (Girls-Ghuwra),<br \/>\nDistrict Chhatarpur. He has been transferred to Middle<br \/>\nSchool Bilhar, Bachon in the same district. The appellant<br \/>\nchallenged the order of transfer in a writ petition on the<br \/>\nground that his wife is working as Assistant Teacher in<br \/>\nGovernment Primary School, Bhagwa which is 8 Kms. away<br \/>\nfrom the present place of posting and, therefore, transfer<br \/>\norder has been passed in violation of the policy framed by<br \/>\nthe State Government.\n<\/p>\n<p>      Learned Single Judge by order dated 19.7.2010 held<br \/>\nthat merely because there is violation of transfer policy that<br \/>\nitself would not be a ground for interference in the order of<br \/>\ntransfer.\n<\/p>\n<p>      We have heard learned counsel for the parties. Learned<br \/>\ncounsel for the appellant contended that the order of transfer<br \/>\nhas been passed in violation of the transfer policy framed by<br \/>\nthe State Government which provides that as far as possible<br \/>\n<span class=\"hidden_text\">                                -2-<\/span><br \/>\nthe husband-wife should be posted at the same place.<br \/>\nLearned counsel further submitted that in violation of policy<br \/>\nthe appellant has been posted 250 Kms. away from his<br \/>\npresent place of posting. He further contended that nobody<br \/>\nhas been posted in place of the appellant.\n<\/p>\n<p>       We are afraid that the fact that order of transfer is<br \/>\nviolative of transfer policy, cannot be a ground for<br \/>\ninterference with the order of transfer. It is well settled in law<br \/>\nthat transfer is an incident of service. Which employee<br \/>\nshould be posted where is a matter for the appropriate<br \/>\nauthority to decide until and unless the transfer is vitiated by<br \/>\nmalafide or is made in violation of any statutory provisions,<br \/>\nthe Court cannot interfere with the order of transfer. [See:<br \/>\n<a href=\"\/doc\/220487\/\">Union of India and others vs. S.L.Abbas,<\/a> (1993) 4 SCC<br \/>\n357]<br \/>\n       Similarly,   in   <a href=\"\/doc\/1398944\/\">Public      Services   Tribunal     Bar<br \/>\nAssociation vs. State of U.P. and<\/a> another, (2003) 4 SCC<br \/>\n104, once again dealing with the scope of judicial review in<br \/>\nthe matter of transfer, Supreme Court reiterated that transfer<br \/>\nis an incident of service and normally should not be<br \/>\ninterfered with by the Court. If any administrative guidelines<br \/>\nrecalling transfer of an employee are violated, at best the<br \/>\nsame confers the right on the employee to approach the<br \/>\nhigher authorities for redressal of their grievance. Transfer<br \/>\nmade contrary to policy can also not be interfered with.\n<\/p>\n<p><span class=\"hidden_text\">                                 -3-<\/span><\/p>\n<p>      In view of the aforesaid well settled legal position, it is<br \/>\napparent that if the order of transfer of the appellant has been<br \/>\npassed in violation of the policy, the appellant would be at<br \/>\nliberty to submit a representation to the competent authority.\n<\/p>\n<p>      We do not find any ground to interfere with the view<br \/>\ntaken by the learned Single Judge. At this stage, learned<br \/>\ncounsel for the appellant submitted that he may be permitted<br \/>\nto submit representation within a week before the respondent<br \/>\nNo.2 and the respondent No.2 be directed to consider the<br \/>\nrepresentation submitted by the appellant expeditiously.<br \/>\nAccordingly, it is directed that if the appeal is submitted<br \/>\nwithin a period of one week from today before the<br \/>\nrespondent No.2, the respondent No.2 shall decide the<br \/>\nrepresentation submitted by the appellant within a period of<br \/>\ntwo weeks from the date of filing of representation. Since<br \/>\nnobody has been posted in place of the appellant, therefore,<br \/>\nin the peculiar facts of this case we direct the respondents, till<br \/>\nthe representation submitted by the appellant is decided, they<br \/>\nshall not insist the appellant to submit his joining at his<br \/>\ntransferred place for a period of three weeks from today.
