GOVERNMENT\nPLEADER for Respondent(s) : 1 -\n2. \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE D.A.MEHTA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMS.JUSTICE H.N.DEVANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 19\/07\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MS.JUSTICE H.N.DEVANI)<\/p>\n<p>This<br \/>\n\tpetition has been preferred seeking following substantive reliefs :\n<\/p>\n<p> [A]\tYour<br \/>\nLordships may be pleased to hold and declare that the action of the<br \/>\nrespondents in considering the failure on the part of the petitioner<br \/>\nto run the wind mill subsequent to June 1998 because of the total<br \/>\ndisruption of the wind farm on account of the natural calamity viz.<br \/>\nCyclone, as a breach of condition of the certificate dated 17.11.1995<br \/>\nand 18.7.1996 issued by the Commissioner of Electricity to resolution<br \/>\nNo.EDA-1092-M(I)-8(1)-E and EDA 1092-M(1)-8(2)-E both dated 27.1.1993<br \/>\nas being illegal, unconstitutional and void.\n<\/p>\n<p>[B]\tYour<br \/>\nLordships may be pleased to issue a writ of certiorari or any other<br \/>\nwrit, order or direction quashing and setting aside the order passed<br \/>\nby the Sales Tax Officer (I) dated 04.11.2003 at Annexure  D  and<br \/>\nthe notice pursuant to the said order dated 19.11.2003 at Annexure<br \/>\n E  hereto.\n<\/p>\n<p>In<br \/>\n\t1993, respondent   State of Gujarat announced the scheme titled<br \/>\n\t Incentive Scheme for Wind Power Generation 1993  for extending<br \/>\n\tsales tax incentives to industrial undertakings who would set up<br \/>\n\twind farms in the State of Gujarat so as to curb the gap between<br \/>\n\tdemand and supply of power in the State.\n<\/p>\n<p>Pursuant<br \/>\n\tto the said Scheme, the petitioner established a wind farm at Lamba,<br \/>\n\tDistrict Jamnagar at the cost of Rs.3,77,25,592\/-.  The power from<br \/>\n\tthis wind farm was synchronized with GEB grid on 27.3.1995. Vide<br \/>\n\texemption certificate dated 17.1.1997 issued by the Sales Tax<br \/>\n\tDepartment, the petitioner was granted sales tax benefit upto a<br \/>\n\tmaximum limit of Rs.1,88,62,796\/- under the Sales Tax Composite<br \/>\n\tScheme, which was valid for the period 16.12.1996 to 26.3.2001.\n<\/p>\n<p>On<br \/>\n\t9th June 1998, a cyclone hit the coastal regions of the<br \/>\n\tState, more particularly districts of Porbandar and Jamnagar<br \/>\n\tresulting in wide spread damage.  The windmills installed by the<br \/>\n\tpetitioner company were uprooted resulting in stoppage of production<br \/>\n\tof power.  One of the conditions of the Scheme was Condition No.7(b)<br \/>\n\twhich reads as under:\n<\/p>\n<p> (b)<br \/>\n\t   The Industrial unit will remain in production continuously during<br \/>\n\tthe eligible period.\n<\/p>\n<p>Since<br \/>\n\tthe petitioner could not remain in production continuously during<br \/>\n\tthe eligible period, vide order dated 29.4.1999 made by the<br \/>\n\tAssistant Sales Tax Commissioner, the sales tax exemption<br \/>\n\tcertificate came to be cancelled.  Vide demand notice dated<br \/>\n\t4.11.2003, the petitioner was called upon to pay the amount of sales<br \/>\n\ttax benefit enjoyed by it from 1996 to 1998 with interest. Vide<br \/>\n\tnotice dated 19.11.2003 issued under section 59 of the Gujarat Sales<br \/>\n\tTax Act, 1969, the petitioner was called upon to show cause as to<br \/>\n\twhy the sales tax exemption to the tune of Rs.44.18 lakhs availed<br \/>\n\tunder Wind Mill Scheme should not be recovered in one lumpsum as<br \/>\n\tthere was a breach of condition.  Being aggrieved, the petitioner<br \/>\n\thas moved the present petition seeking the relief noted hereinabove.\n<\/p>\n<p>Vide<br \/>\n\taffidavit dated 2.9.2008, the petitioner has categorically averred<br \/>\n\tthat due to circumstances beyond the control of the petitioner<br \/>\n\tCompany, it could not re-install the said wind mills.\n<\/p>\n<p>Heard<br \/>\n\tthe learned Advocate for the petitioner and the learned Assistant<br \/>\n\tGovernment Pleader on behalf of the respondents.\n<\/p>\n<p>It<br \/>\n\t is an admitted position that the controversy involved in the<br \/>\n\tpresent petition stands concluded by a judgement and order dated<br \/>\n\t7.8.2008 made in the case of Elecon Engineering Company Ltd.<br \/>\n\tand another v. State of Gujarat and others, rendered in<br \/>\n\tSpecial Civil Application No.2067 of 2004.\n<\/p>\n<p>The<br \/>\n\t facts of the present case are therefore, required to be examined in<br \/>\n\tthe light of the principles laid down in the aforesaid decision. It<br \/>\n\tis an admitted position as noted hereinabove, that the petitioner<br \/>\n\therein has not recommissioned its windmills. In the circumstances,<br \/>\n\tas held in paragraph 9 of the said decision, the petitioner shall be<br \/>\n\tliable to discharge its liability for the period prior to the date<br \/>\n\tof the cyclone for which the original scheme provides for in<br \/>\n\taccordance with other terms of the Scheme. In other words, the<br \/>\n\trespondents shall not be entitled to effect any recovery on the<br \/>\n\tground of breach of condition of continuous operation of period of<br \/>\n\tsix years but such bar shall not apply to the petitioner as regards<br \/>\n\tdischarging its liability, which it is otherwise liable to<br \/>\n\tdischarge, qua the benefit availed of in accordance with the other<br \/>\n\tterms of the scheme.\n<\/p>\n<p>The<br \/>\n\tpetition is, accordingly, allowed.
