\nquestion in this appeal.\n<\/p>\n
2. The” claimants lodged a claim petition<\/p>\n
claiming compensation on account of  <\/p>\n
one Shivarama Hegde, who died. while .pn;o\u00a7din\u00a7_ %<\/p>\n
the marble from vehicle bearing; NoQKaE2Qf\u00a7Q93<\/p>\n
during” his course of” employmentn as iloaderW andvg<\/p>\n
unloader.\n<\/p>\n
3. According vtog them;*lon%g1.1l:2b03 the
\ndeceased Shivarama VhegdeiV\ufb01entV\ufb02\u00a7\u00a2. Venoor to<\/p>\n
unload the Jmarhlei in5 the “aforesaid lorry.
\nDuring lithe’  ‘ his employment while<\/p>\n
unloading one_of.theVnarble slab fell on him, as<\/p>\n
_.~a\u00ab revs{:;.lt_i” of 1iw1″zic_h__vhe died. According to the<\/p>\n
lelaimant,’.hedvwas aged. about 34 years and. was<\/p>\n
t\ufb01pv getting a salary of Rs.4,000\/- p.m. and Rs.50\/-<\/p>\n
Vh_ battat z’:h\u00a7 owner of the vehicle though filed<\/p>\n
* :the statement of objection did not cross examine<\/p>\n
l%_ the; claimants and also did not let in any<\/p>\n
 Vii”:-ggvvidence. The Insurance Company also did not<\/p>\n
let in oral evidence except producing the policy<\/p>\n
and cross–examining the widow of Shivarama Hege.<\/p>\n

5. Per contra, the Learned counsel’-\u00ab’f_o.._:*_.’*__i’<\/p>\n

grounds urged by the appell:ant:_,,’are’.,,pnot <\/p>\n
since the owner of the v’ehic1\u00e9._has <\/p>\n
the relationship of maste’r\u00b0’a’nd_VV  cross-\n<\/p>\n
examining PW1 and    evidence .\n<\/p>\n
According to him,  lodged by
\none of the?_:   working with<\/p>\n
Shivarama 1   ‘   an  undisputed fact<\/p>\n
immediately’  ‘accident stating that<\/p>\n
Shivarama”!-Iedgdeii’ “was working as a loader and<\/p>\n
4…,-;1n1oa:ip:er ‘died.’ “on_____account of marble slap falling<\/p>\n
don  .chest”‘*,of Shivarama Hegde. This piece of<\/p>\n
evuidenicel ‘  challenged either by the<\/p>\n
*Insuran.c”‘ea ‘Company or by the owner. When the<\/p>\n
_  V ‘ Qgemplapinant lodged an FIR, it was not<\/p>\n
 ‘-anticipated that claimants would file a claim<\/p>\n
“petition and as a loader when another loader has<\/p>\n
sustained injuries and died on the spot, in the<\/p>\n
usual course a good employee of the owner has<\/p>\n
‘\ufb01g,<\/p>\n
lodged a complaint. Therefore, whether deceased
\nwas a servant of the owner of the vehicle is a<\/p>\n
question of fact and not a question of law} 7It<\/p>\n
was for the owner to step into the witness b\u00a73~<\/p>\n
and let in evidence that_ deceased” was mnctd<\/p>\n
employed by him as a loader on that\ufb02day and as<\/p>\n
an owner he was required ,to “maintainf”certain”c<\/p>\n
documents, who are all his employees._,g?or non
\nproduction of documents _dff the downer of the
\nvehicle, an adverse inference has ix: be drawn.
\nAccordingly, the said \ufb01oint is held against the
\nappellant.=’<\/p>\n
