No\n\n\nFAO No.361 of 2008                                Page 1 of 5\n V.B.Gupta, J.\n<\/pre>\n<p>       Appellant has filed this appeal challenging the<\/p>\n<p>judgment dated 11th July, 2008 of Railway Claim<\/p>\n<p>Tribunal, Delhi (for short as \u201eTribunal), on limited<\/p>\n<p>ground, that Tribunal ought to have awarded interest<\/p>\n<p>@ 12% per annum on compensation amount and that<\/p>\n<p>too from date of the accident, that is, 11th June, 2006<\/p>\n<p>or from date of filing of claim petition.<\/p>\n<p>2.     Vide     impugned     judgment,      Tribunal     awarded<\/p>\n<p>compensation         to   appellants   to   the   tune    of     Rs.<\/p>\n<p>4,00,000\/- along with interest @ 9% per annum from<\/p>\n<p>the date of order (11th July, 2008) till the date of actual<\/p>\n<p>payment.\n<\/p>\n<\/p>\n<p>3.     It is contended by learned counsel for appellants<\/p>\n<p>that Tribunal failed to consider that Section 34 of the<\/p>\n<p>Code of Civil Procedure (for short as \u201eCode\u201f) is<\/p>\n<p>applicable to proceedings before the Tribunal and it<\/p>\n<p>ought to have awarded interest from the date of<\/p>\n<p><span class=\"hidden_text\">FAO No.361 of 2008                                       Page 2 of 5<\/span><br \/>\n accident or from the date of filing of petition. In<\/p>\n<p>support of his contentions, learned counsel cited<\/p>\n<p><a href=\"\/doc\/593557\/\">Union of India v. M.Thankaraj and<\/a> etc. etc., AIR<\/p>\n<p>2000 Kerala 91.\n<\/p>\n<\/p>\n<p>4.      It is not in dispute that Section 34 of the Code, is<\/p>\n<p>applicable to the claims, made before the Tribunal.<\/p>\n<p>That being so, there is no reason why appellants be<\/p>\n<p>denied interest from the date        of filing of the claim<\/p>\n<p>petition. In M.Thankaraj (supra), it has been laid down<\/p>\n<p>that;\n<\/p>\n<\/p>\n<blockquote><p>           &#8220;There is one more common question to<br \/>\n           be considered in this case that is<br \/>\n           regarding payment of interest. We are of<br \/>\n           the view that the claimants are entitled to<br \/>\n           interest from the date of filing the<br \/>\n           petition before the Tribunal. In order to<br \/>\n           make the compensation just and fair it is<br \/>\n           only proper that interest is paid to the<br \/>\n           claimant from the date of filing the<br \/>\n           petition. A similar view was taken by a<br \/>\n           Division Bench of the Madhya Pradesh<br \/>\n           High Court in Union of India v. Smt.<br \/>\n           Laxmipati, AIR 1995 Madh Pra 90. It was<br \/>\n           held that even if Section 34 of C. P. C. has<br \/>\n           not been expressly made applicable to the<br \/>\n           proceedings before the Commissioner<br \/>\n           under the Indian Railways Act, 1890,<br \/>\n           there is no reason to hold that principles<br \/>\n           of Section 34, C. P. C. would be<br \/>\n           inapplicable. Court, therefore, directed<br \/>\n           payment of interest from the date of filing<br \/>\n           the petition before the Commissioner. The<\/p>\n<p><span class=\"hidden_text\">FAO No.361 of 2008                                 Page 3 of 5<\/span><br \/>\n            same view was taken by the Madras High<br \/>\n           Court in Union of India v. Janardhanan,<br \/>\n           AIR 1998 Mad 272. <a href=\"\/doc\/1395897\/\">In A.A. Haja<br \/>\n           Munuddian v. Indian Railways, AIR<\/a> 1993<br \/>\n           SC 361, the Supreme Court had occasion<br \/>\n           to consider the question whether the<br \/>\n           provisions of the Order 33 of the C. P. C.<br \/>\n           would be applicable to the proceedings<br \/>\n           before the Railways Tribunal. It was held<br \/>\n           that although the Railway Claims<br \/>\n           Tribunal Act and the Rules thereunder do<br \/>\n           not specifically provide for the application<br \/>\n           of Order 33 of the C. P. C., there is<br \/>\n           nothing in the Act or the Rules which<br \/>\n           precludes the Tribunal from following<br \/>\n           that procedure if the ends of Justice so<br \/>\n           require. Nowhere in the Act is there any<br \/>\n           provision which runs counter to or is<br \/>\n           inconsistent with the provisions of Order<br \/>\n           33 of the C. P. C. Same principle can be<br \/>\n           applied to hold that even though Section<br \/>\n           34 of C. P. C. as such is not applicable,<br \/>\n           the principles contained therein can be<br \/>\n           made applicable to proceedings before<br \/>\n           the Railway Claims Tribunal.&#8221;\n<\/p><\/blockquote>\n<p>5.     In the light of principles enunciated in the above<\/p>\n<p>judgment, there is no reason as to why appellants be<\/p>\n<p>denied interest, from the date of filing of the petition.<\/p>\n<p>6.     As far as prayer of appellants for interest @ 12%<\/p>\n<p>per annum is concerned, there is no ground to grant<\/p>\n<p>interest @ 12% per annum. Interest @ 9% per annum<\/p>\n<p>as awarded by trial court, is quite reasonable keeping<\/p>\n<p>in view Bank Rates prevailing at present. Accordingly,<\/p>\n<p><span class=\"hidden_text\">FAO No.361 of 2008                                 Page 4 of 5<\/span><br \/>\n there is no ground for enhancement of rate of interest<\/p>\n<p>from 9% per annum to 12% per annum.\n<\/p>\n<\/p>\n<p>7.     So, impugned judgment is modified to the extent,<\/p>\n<p>that respondent shall pay interest @ 9% per annum<\/p>\n<p>from date of         filing of petition, that is w.e.f. 12th<\/p>\n<p>September, 2006, till date of actual payment.<\/p>\n<p>8.     With this modification, the appeal stands disposed<\/p>\n<p>of.\n<\/p>\n<\/p>\n<p>9.
