Parikh for the appellant Insurance<br \/>\n\tCompany.\n<\/p>\n<p>By<br \/>\n\tfiling this appeal, the appellant has challenged interim award made<br \/>\n\tby the claims tribunal Bharuch in MACP No. 579 of 2004 dated<br \/>\n\t30.7.2007 wherein the claims tribunal has awarded interim<br \/>\n\tcompensation of Rs.25,000.00 to the claimant under sec. 140 of the<br \/>\n\tMV Act, as No Fault Liability with 9 per cent interest thereon.\n<\/p>\n<p>Claimant<br \/>\n\thad filed aforesaid claim petition under sec. 166 of the MV Act<br \/>\n\tbefore the claims tribunal at Bharuch and during the pendency of the<br \/>\n\tsaid application, claimant also filed application for interim<br \/>\n\tcompensation under sec. 140 of the MV Act, 1988. Relevant record was<br \/>\n\tproduced by the claimant before the claims tribunal and claims<br \/>\n\ttribunal came to the conclusion that the claimants are entitled for<br \/>\n\tcompensation under section 140 of the MV Act,1988 on the basis of No<br \/>\n\tFault Liability.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Parikh submitted that the deceased himself was driving<br \/>\n\tthe motor cycle and, therefore, insurance company of motor cycle was<br \/>\n\tnot liable under the Law of Torts. He also submits that the deceased<br \/>\n\thimself was driving the motor cycle and he himself was negligent in<br \/>\n\tdriving the said vehicle and for his own negligence, insurance<br \/>\n\tcompany cannot be held liable even under sec. 140 of the MV Act,<br \/>\n\t1988. He also submitted that the claims tribunal ought to have<br \/>\n\tconsidered FIR and relevant record wherein it was specifically<br \/>\n\tmentioned that the deceased was driving the motor cycle and while<br \/>\n\tsaving dog, he slipped and sustained injuries and,<br \/>\n\ttherefore,claimants are not entitled for compensation from the<br \/>\n\tinsurance company of motor cycle. He relied upon the decision of the<br \/>\n\tapex court reported in 2007(2) TAC 417 in the case of Oriental<br \/>\n\tInsurance Co. Ltd. V\/s. Meena Variyal &amp; Ohers. He also submitted<br \/>\n\twith all vehemence that inspite of such contention raised by the<br \/>\n\tappellant before the claims tribunal, the claims tribunal has not<br \/>\n\texamined it and awarded compensation under sec.140 of the MV Act,<br \/>\n\t1988. He also relied upon the apex court decision in case of Smt.<br \/>\n\tYallwwa v\/s. National Insurance Co. reported in 2007(6) SCC 657 and<br \/>\n\tsubmitted that the apex court has decided this issue by holding that<br \/>\n\tthe claims tribunal must have to examine the objections\/defences<br \/>\n\traised by the insurance company while deciding an application under<br \/>\n\tsec. 140 of the MV Act, 1988.\n<\/p>\n<p>I<br \/>\n\thave considered the submissions made by the learned Advocate Mr.<br \/>\n\tParikh for the appellant. I have also perused the interim impugned<br \/>\n\taward made by the claims tribunal, Bharuch. Looking to the decision<br \/>\n\tof the apex court in case of   Smt. Yallwwa v\/s. National Insurance<br \/>\n\tCo. reported in 2007(6) SCC 657. However, ultimate purpose is to<br \/>\n\thave decision on merits in an application under section 166 of the<br \/>\n\tMV Act, 1988 filed by the claimants. This being an interim award,<br \/>\n\twhatever observations made by the claims tribunal shall not come in<br \/>\n\tthe way of the claimant or the insurance company. According to my<br \/>\n\topinion, even if this appeal is admitted considering the submissions<br \/>\n\tmade by the learned advocate Mr. Parikh on behalf of the insurance<br \/>\n\tcompany,then also, same would remain pending before this court so<br \/>\n\tlong as the main application under sec.166 of the MV Act, 1988 is<br \/>\n\tnot decided by the claims tribunal. Therefore, according to my<br \/>\n\topinion, it would be just and proper and would also met ends of<br \/>\n\tjustice between the parties if this appeal is disposed of without<br \/>\n\texpressing any opinion on merits of the matter with a direction to<br \/>\n\tthe claims tribunal to decide the main application for compensation<br \/>\n\tunder sec. 166 of the MV Act, 1988 without being influenced by the<br \/>\n\tinterim award dated   30.7.2007 in any manner whatsoever and to<br \/>\n\tdecide the said application strictly in accordance with law and<br \/>\n\tevidence on record and to direct the appellant to deposit the entire<br \/>\n\tamount as awarded by the claims tribunal by interim award with costs<br \/>\n\tand interest before the claims tribunal.\n<\/p>\n<p>Accordingly,<br \/>\n\tthis appeal is disposed of without expressing any opinion on merits<br \/>\n\tof the matter with a direction to the appellant to deposit entire<br \/>\n\tamount awarded by the claims tribunal with costs and interest before<br \/>\n\tthe claims tribunal within one month from the date of receipt of<br \/>\n\tcopy of this order. Amount, if any, deposited by the appellant in<br \/>\n\tthe registry of this Court be transmitted to the claims tribunal<br \/>\n\timmediately. After realising the amount by the claims tribunal, it<br \/>\n\tis directed to the claims tribunal to pay 30 per cent of the amounts<br \/>\n\tto the respondents claimants by way of an account payee cheque and<br \/>\n\trest of the amount is ordered to be invested in any nationalized<br \/>\n\tbank initially for a period of three years with cumulative interest<br \/>\n\twith periodical renewal from time to time, the name of the<br \/>\n\trespondents claimants but FDRs to remain in the custody of th Nazir<br \/>\n\tof the claims tribunal concerned till the application under sec. 166<br \/>\n\tof the MV Act is decided by the claims tribunal and the respondents<br \/>\n\tclaimants will not be entitled to make any withdrawal from such FDRs<br \/>\n\ttill the main application under sec. 166 of the MV Act 1988 is<br \/>\n\tfinally decided by the claims tribunal.
