Respondents\n\n        Petition under Article 226  of  the  Constitution  of  India  for  the\nissuance of a Writ of Habeas Corpus to call for the records in connection with\nthe  order  of  detention  passed by the second respondent dated 31.01.2006 in\noffice Ref.No.C3.D.O.No.13\/2006 inst the petitioner Govindasamy S\/o Annamalai,\nnow confined in Central Prison, Vellore, Vellore District and  set  aside  the\nsame  and  direct  the respondents to produce the detenu before this Court and\nset him at liberty.\n\n!For Petitioner         :  Mr.E.Kannadasan\n^For Respondents        :  Mr.M.Babu Muthu Meeran \n                        Addl.  Public Prosecutor\n\n:ORDER  \n<\/pre>\n<p>                (Order of the Court was made by V.DHANAPALAN, J.)<br \/>\n        The petitioner by name Govindasamy, who was detained as a &#8221;Goonda&#8221; as<br \/>\ncontemplated under the  Tamil  Nadu  Prevention  of  Dangerous  Activities  of<br \/>\nBootleggers,  Drug  Offenders,  Forest  Offenders,  Goondas,  Immoral  Traffic<br \/>\nOffenders, Slum Grabbers and Vide rates Act, 1982(Tamil Nadu Act 14 of  1982),<br \/>\nby  the impugned detention order dated 31.01.2006, challenges the same in this<br \/>\nPetition.\n<\/p>\n<p>        2.  Heard learned counsel  for  the  petitioner  as  well  as  learned<br \/>\nGovernment Advocate for the respondents.\n<\/p>\n<p>        3.  At the foremost, learned counsel for the petitioner submitted that<br \/>\nthere is enormous delay in disposal of the representation of the detenu, which<br \/>\nvitiates the  ultimate order of detention.  With reference to the above claim,<br \/>\nlearned Government Ad te has placed the details,<br \/>\nwhich show that the representation of the detenu dated 06.03.2006 was received<br \/>\nby the Government on 07.03.2006 and remarks were called for on 08.03.2006  and<br \/>\nthe reminder was sent on 15.03.2006.  Thereafter, the remarks were received by<br \/>\nthe Government on 3 0.03.2006 and the File was submitted on 31.03.2006 and the<br \/>\nsame was dealt with by the Under Secretary on the same day i.e.  on 31.03.2006<br \/>\nand  by  the  Deputy  Secretary  on  03.04.2006  and finally, the Minister for<br \/>\nProhibition and Excise passed orders on 04 .04.2006.  The rejection letter was<br \/>\nprepared on 10.04.2006 and the same was sent to the detenu  on  the  same  day<br \/>\ni.e.  on  10.04.2006  and served to him on 15.04.2006.  As rightly pointed out<br \/>\nby the learned counsel for the petitioner, though the Minister for Prohibition<br \/>\nand Excise passed an order on 04.04.2006, there is no explanation at  all  for<br \/>\ntaking time  for  preparation  of  rejection  letter  till 10.04.2006.  In the<br \/>\nabsence of any explanation by the person concerned even  after  excluding  the<br \/>\nintervening  ho lidays, we are of the view that the time taken for preparation<br \/>\nof rejection letter is on the higher side and we hold that the said delay  has<br \/>\nprejudiced the  detenu  in disposal of his representation.  On this ground, we<br \/>\nquash the impugned order of detentio n.\n<\/p>\n<p>        4.  Accordingly,  the  Habeas  Corpus  Petition  is  allowed  and  the<br \/>\nimpugned order of detention is set aside.  The detenu is directed to be set at<br \/>\nliberty forthwith from the custody unless he is required in some other case or<br \/>\ncause.\n<\/p>\n<p>raa<\/p>\n<p>To<\/p>\n<p>1.
