Pujari, learned APP appears and waivers service of  notice<br \/>\nof rule on behalf of  the respondent &#8211; State of Gujarat.\n<\/p>\n<p>2\tHaving<br \/>\nregard to the facts of the case, the application is taken up for<br \/>\nhearing today.\n<\/p>\n<p>3\tThe<br \/>\napplicant &#8211; convict prisoner, who, vide  judgment and order<br \/>\ndated 06.08.2005, rendered in Sessions Case No.68 of 2004, by the<br \/>\nlearned Additional Sessions Judge, Fast Track Court No.12, District &#8211;<br \/>\nRajkot at Morbi,  has been convicted  for the offence punishable<br \/>\nunder Section 302, etc of the Indian Penal Code  and sentenced to<br \/>\nundergo imprisonment  for life, has filed this application through<br \/>\nJail Authority,  praying to enlarge him on temporary bail for a<br \/>\nperiod of  30 days on the ground of house repairing.\n<\/p>\n<p>4\t\tHaving<br \/>\nconsidered the submissions advanced by Mr. L.R. Pujari, learned APP<br \/>\nrepresenting the respondent &#8211; State of Gujarat  and considering<br \/>\nthe jail remarks sheet forwarded by the Jail Authority along with<br \/>\nthis application, it appears that the applicant &#8211; convict  has<br \/>\nundergone sentence of 5 years, 11 months and 19 days and during this<br \/>\nperiod he was released  on temporary bail on three occasions  and it<br \/>\nis further clear that  in the last occasion  the applicant &#8211;<br \/>\nconvict was released on temporary bail for a period of 14 days in the<br \/>\nmonth of January-February, 2010 on the ground of house repairing.\n<\/p>\n<p>5\t\tSeen<br \/>\nin the above context,  since the applicant  &#8211; convict  was released<br \/>\non temporary bail on the same ground in the recent past and earlier<br \/>\napplication on the same ground  came to be rejected, we do not find<br \/>\nany justifiable ground  to allow this application  and to release the<br \/>\napplicant  on temporary bail  for a period of 30 days on the ground<br \/>\nof house repairing.\n<\/p>\n<p>7\t\tFor<br \/>\nthe foregoing reasons,  the Application fails and accordingly it is<br \/>\nrejected.
