No.34123 of 2010\n                                     BIRBAL RAI\n                                         Versus\n                              THE STATE OF BIHAR\n                                       -----------\n<\/pre>\n<p>3   3.2.2011              Heard           learned           counsel        for     the<\/p>\n<p>               parties.\n<\/p>\n<p>                          Petitioner is father-in-law of Sima<\/p>\n<p>               Devi.    Allegation              is    about       kidnapping       of<\/p>\n<p>               Sima     Devi       along        with        Shobha        Kumari    at<\/p>\n<p>               petitioner&#8217;s hand. Defence is on the point<\/p>\n<p>               that petitioner is 75 years old and due to<\/p>\n<p>               matrimonial differences pending litigations<\/p>\n<p>               he     along        with       his      family        members       are<\/p>\n<p>               involved        in       the      case        that        also    after<\/p>\n<p>               several    days          of      the    incident.           Both    the<\/p>\n<p>               victims    disappeared                 from    their        house   on<\/p>\n<p>               29.1.2010 reported on 31.1.2010 and F.I.R.<\/p>\n<p>               is lodged on 9.2.2010. Informant is not eye<\/p>\n<p>               witness         of         the         case.         He      gathered<\/p>\n<p>               information.          Young           lady     having        strained<\/p>\n<p>               relation with her husband if disappears it<\/p>\n<p>               is   natural         that,        that       will     be     informed<\/p>\n<p>               after      reasonable                  wait         followed         by<\/p>\n<p>               hesitation in informing the matter. F.I.R.<\/p>\n<p>               is     lodged       at     later        stage        after       coming<\/p>\n<p>               across         of        witnesses            on       search       of<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>     disappeared ladies but it is an admitted<\/p>\n<p>     fact that both the victims are traceless<\/p>\n<p>     till today, may be murdered, may not be but<\/p>\n<p>     in any case not entitling this petitioner<\/p>\n<p>     who   is   named   by   witnesses    also,    for<\/p>\n<p>     anticipatory        bail.
