As per the report of the Mediator, matter is settled<br \/>\n\tbetween the parties and a specific terms of settlement is arrived at<br \/>\n\tbetween the parties.\n<\/p>\n<p>The<br \/>\n\tlearned advocates for the respective parties have jointly submitted<br \/>\n\tthat as the matter is settled between the parties, the complaint may<br \/>\n\tbe quashed.\n<\/p>\n<p>It<br \/>\n\tis clear that the parties have settled the matter by arriving at a<br \/>\n\tcompromise and a consent terms  settlement is also placed on record.<br \/>\n\tReliance is placed on a decision of the Apex Court reported in  AIR<br \/>\n\t2005 SUPREME COURT 757 in the case of  <a href=\"\/doc\/1180451\/\">Mohd. Shamim v.<br \/>\n\tNahid Begum<\/a> wherein it has been held by the Apex Court in<br \/>\n\tparagraph Nos.12, 13, 14 and 15 as under:\n<\/p>\n<p>&#8220;12.\n<\/p>\n<p>In view of the fact that the settlement was arrived at the<br \/>\nintervention of a judicial officer of the rank of the Additional<br \/>\nSessions Judge, we are of the opinion, the contention of the First<br \/>\nRespondent herein to the effect that she was not aware of the<br \/>\ncontents thereof and the said agreement as also the affidavit which<br \/>\nwere got signed by her by misrepresentation of facts must be<br \/>\nrejected. In the facts and circumstances of this case, we have no<br \/>\ndoubt in our mind that the denial of execution of the said deed of<br \/>\nsettlement is an afterthought on the part of the Respondent No.1<br \/>\nherein.\n<\/p>\n<p>13.<br \/>\nEx facie the settlement between the parties appears to be genuine. If<br \/>\nthe contention of the First Respondent herein is to be accepted, she<br \/>\nwould not have accepted the sum of Rs. 2,25,000\/- and in any event,<br \/>\nshe could have filed an appropriate application in that behalf before<br \/>\nthe Court of S.N. Gupta, Additional Sessions Judge, Delhi. What was<br \/>\nleast expected of her was that she would return the said sum of<br \/>\nRupees 2,25,000\/- to the Appellants herein.\n<\/p>\n<p>14.<br \/>\nSection 406 is a compoundable offence with the permission of the<br \/>\ncourt. It is true that Section 498-A IPC is not compoundable.\n<\/p>\n<p>15.<br \/>\nThis Court in <a href=\"\/doc\/1892287\/\">Ruchi Agarwal v. Amit Kumar Agrawal and others<\/a> (2004<br \/>\n(8) Supreme 525), in almost a similar situation has quashed a<br \/>\ncriminal proceeding against the husband, stating:\n<\/p>\n<p>&#8220;&#8230;\n<\/p>\n<p>Therefore, we are of the opinion that the appellant having received<br \/>\nthe relief she wanted without contest on the basis of the terms of<br \/>\nthe compromise, we cannot now accept the argument of the learned<br \/>\ncounsel for the appellant. In our opinion, the conduct of the<br \/>\nappellant indicates that the criminal complaint from which this<br \/>\nappeal arises was filed by the wife only to harass the respondents.\n<\/p>\n<p>8.<br \/>\nIn view of the above said subsequent events and the conduct of the<br \/>\nappellant, it would be an abuse of the process of the court if the<br \/>\ncriminal proceedings from which this appeal arises is allowed to<br \/>\ncontinue..&#8221;\n<\/p>\n<p>In<br \/>\n\tview of the conduct of the First Respondent in entering into the<br \/>\n\taforementioned settlement, the continuance of the criminal<br \/>\n\tproceeding pending against the Appellants, in our opinion, in this<br \/>\n\tcase also, would be an abuse of the process of the court. The<br \/>\n\tAppellant No.1, however, would be entitled to withdraw the sum of<br \/>\n\tRs. 50,000\/- which has been deposited in the court. We, therefore,<br \/>\n\tin exercise of our jurisdiction under Article 142 of the<br \/>\n\tConstitution of India direct that the impugned judgment be set<br \/>\n\taside. The First Information Report lodged against the Appellants is<br \/>\n\tquashed. The Appeal is allowed. However, this order should not be<br \/>\n\ttreated as a precedent.&#8221;\n<\/p>\n<p>Reliance<br \/>\n\tis also placed on another decision of the Apex Court reported in  AIR<br \/>\n\t2003 SUPREME COURT 1386 in<br \/>\n\tthe case of  B. S. Joshi v. State  of<br \/>\n\tHaryana wherein complaint for the offence under Sec.498-A<br \/>\n\thas been quashed by using the inherent power of the  Court under<br \/>\n\tSec.482 of Cr.P.C. It has been held by the Apex Court in paras 14<br \/>\n\tand 15 of the said judgment as under:\n<\/p>\n<p>&#8220;14.\n<\/p>\n<p>\tThere is no doubt that the object of introducing Chapter XX-A<br \/>\n\tcontaining Section 498A in the Indian Penal Code was to prevent the<br \/>\n\ttorture to a woman by her husband or by relatives of her husband.<br \/>\n\tSection 498A was added with a view to punishing a husband and his<br \/>\n\trelatives who harass or torture the wife to coerce her or her<br \/>\n\trelatives to satisfy unlawful demands of dowry. The hyper-technical<br \/>\n\tview would be counter productive and would act against interests of<br \/>\n\twomen and against the object for which this provision was added.<br \/>\n\tThere is every likelihood that non-exercise of inherent power to<br \/>\n\tquash the proceedings to meet the ends of justice would prevent<br \/>\n\twomen from settling earlier. That is not the object of Chapter XXA<br \/>\n\tof Indian Penal Code.\n<\/p>\n<p>15.<br \/>\n\tIn view of the above discussion, we hold that the High Court in<br \/>\n\texercise of its inherent powers can quash criminal proceedings or<br \/>\n\tFIR or complaint and Section 320 of the Code does not limit or<br \/>\n\taffect the powers under Section 482 of the Code.&#8221;\n<\/p>\n<p>Applying<br \/>\n\tthe above ratio to the facts of the present case, since the matter<br \/>\n\thas been settled between the parties, I am of the opinion that no<br \/>\n\tuseful purpose would be served by permitting the criminal<br \/>\n\tproceedings pending against the petitioners to continue as it would<br \/>\n\tbe abuse of process of the court. Hence, the complaint in question<br \/>\n\tis required to be quashed.\n<\/p>\n<p>In<br \/>\n\tview of the above, FIR registered as C.R.No.I-191 of 2010 at Isanpur<br \/>\n\tPolice Station, Ahmedabad, is quashed. As per the settlement terms,<br \/>\n\tboth the parties are directed to go before the Family Court for<br \/>\n\tobtaining decree of divorce under Sec.13-B of Hindu Marriage Act and<br \/>\n\tcan seek early hearing. This Cri.Misc.Application is accordingly<br \/>\n\tallowed. Rule is made absolute.
