BHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 31\/03\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)<\/p>\n<p>1.0\tPresent<br \/>\napplication is filed by the applicant &#8211; convict through jail<br \/>\nseeking 90 days&#8217; Temporary Bail for construction of house.\n<\/p>\n<p>2.0\tThe<br \/>\nCourt noticed an insertion in the Certificate issued by the Talati<br \/>\ncum Mantri, Rasulpura Gram Panchayat, Tal. Sami, Dist. Patan dated<br \/>\n22nd February 2011.  The convict has sought pardon for an<br \/>\nact, which is done by the convict without being conscious of its<br \/>\nconsequence, in his Statement dated 27th March 2011.\n<\/p>\n<p>2.1\tTaking<br \/>\na lenient view in the matter, the pardon sought for is granted.\n<\/p>\n<p>3.0\tLearned<br \/>\nAdditional Public Prosecutor Mr. Raval invited the attention of the<br \/>\nCourt to the Jail Remarks.  The convict was last out in the month of<br \/>\nMarch 2009, but then, he late surrendered by 57 days and since then,<br \/>\nhe has not enjoyed any leave.\n<\/p>\n<p>4.0\tTaking<br \/>\ninto consideration the contents of the application, the application<br \/>\nis allowed.  The applicant &#8211; convict is ordered to be released on<br \/>\nTemporary Bail for a period of 30 days from the date of<br \/>\nhis release, on his executing a personal bond of Rs.5,000\/-<br \/>\n(Rupees Five Thousand only) to the satisfaction of the jail<br \/>\nauthorities.\n<\/p>\n<p>4.1\tThe<br \/>\napplicant shall surrender to the jail authorities on expiry of the<br \/>\nTemporary Bail period.\n<\/p>\n<p>4.2\tRule<br \/>\nis made absolute.\n<\/p>\n<p>[<br \/>\nRavi R.
