SHAH\n\t\t\n\t\n\n \n\nDate\n: 19\/10\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this application under Section 482 of the Code of Criminal<br \/>\nProcedure, the applicants &#8211; original accused have prayed to<br \/>\nquash and set aside the impugned Criminal Case No.5166 of 2004<br \/>\npending in the Court of learned Judicial Magistrate, First Class,<br \/>\nVadodara.\n<\/p>\n<p>2.\t\tConsidering<br \/>\nthe fact that the trial has already begun, Mr.B.S.Patel, learned<br \/>\nadvocate appearing on behalf of the applicants seeks permission to<br \/>\nwithdraw the present application with a liberty to raise all the<br \/>\ncontentions and defences, which are available to the applicants<br \/>\nbefore the learned Trial Court.\n<\/p>\n<p>3.\t\tUnder<br \/>\nthe circumstances, the present application is dismissed as withdrawn<br \/>\nwith above liberty. All the contentions and defences, which are<br \/>\navailable to the respective parties are kept open, which shall be<br \/>\nconsidered by the learned Trial Court in accordance with law and on<br \/>\nmerits.
