Superintendent)\nDate of Hearing          :       19.2.2009\nDate of Decision         :       19.2.2009\nFacts<\/pre>\n<p>        The background of the matter is that the appellant had negotiated with Shri<br \/>\nDuni Chand r\/o H.No. 541, Village-Darai, Union Territory of Chandigarh, the<br \/>\npurchase of latter&#8217;s house for Rs. 3,90,000\/- and had made an advance of Rs.<br \/>\n60,000\/- in this regard. The appellant had lodged a complaint with the Chandigarh<br \/>\nPolice alleging that Shri Duni Chand had fraudulently gone back on his word but the<br \/>\ncomplaint was closed by the police. It is in this context that by his letter of<br \/>\n22.5.2008, the appellant had sought information on 10 points.\n<\/p>\n<p>2.     The CPIO had responded to him through his letter dated 17.7.2008. On<br \/>\nappeal, the Appellate Authority had disposed of the matter vide order dated<br \/>\n13.8.2008.\n<\/p>\n<p>3.      The present appeal is directed against the order of the CPIO\/AA.\n<\/p>\n<p>4.      The matter was heard on 19.2.2009. The appellant appeared before the<br \/>\nCommission. The public authority is represented by the officer named above. It is<br \/>\nthe submission of the appellant that he was ready to purchase the said house and,<br \/>\nhad, infact, got a draft made for Rs. 3,30,000\/- as a consideration for the house in<br \/>\nquestion but when he went to the Tehsildar&#8217;s Office he was informed by Tehsildar<br \/>\nthat Shri Duni Chand was not legally entitled to sell this house. Due to this reason,<br \/>\nthe deal fell through and he lost Rs. 60,000\/- advanced to Shri Duni Chand. It is also<br \/>\nhis submission that inquiry conducted into his complaint by ASI Sohan Lal is an eye-<br \/>\nwash and that if inquiry had been properly conducted, then an FIR would have been<br \/>\na logical outcome against Shri Duni Chand.\n<\/p>\n<p>5.     It is the submission of Shri Chadhha that as per available records, the inquiry<br \/>\nhas been conducted on the correct lines but he has no objection to conducting a fresh<br \/>\ninquiry into the matter if the Commission so directs.\n<\/p>\n<p>                                  DECISION\n<\/p>\n<p>5.   Whether or not the inquiry has been conducted properly, it is not for the<br \/>\nCommission to determine. As the appellant has strongly pleaded that inquiry has not<br \/>\n been conducted properly, it would be fit and proper to direct Shri B.S. Chaddha, DSP<br \/>\nto conduct a fresh inquiry at his own level and decide the same on merits.\n<\/p>\n<p>6.
