Justice ANTONY DOMINIC\n\n Dated :01\/01\/2008\n\n O R D E R\n                          ANTONY DOMINIC, J.\n\n                 = =W.P.(C)=No.=38167=OF = = = = =\n                      = =     =    = =    =\n                                            2007 R\n                 = = = = = = = = = = = = = = = =\n\n                   Dated this the 1st January, 2008\n\n                             J U D G M E N T\n<\/pre>\n<p>      Petitioner&#8217;s vehicle has been seized on the allegation that it<\/p>\n<p>was engaged in the        unauthorised transportation of river sand.<\/p>\n<p>Records disclose that proceedings are pending and the order in<\/p>\n<p>terms of Rule 27 of the Kerala Protection of River Banks and<\/p>\n<p>Regulation of Sand Removal Rules, 2002 has not been passed by the<\/p>\n<p>2nd respondent till date. It is at that stage the writ petition has been<\/p>\n<p>filed praying for release of the vehicle.\n<\/p>\n<p>      2. In view of the pendency of the proceedings on the<\/p>\n<p>allegation that the vehicle is involved in the unauthorised<\/p>\n<p>transportation of river sand, I am not inclined to release the vehicle<\/p>\n<p>at this stage. It is for the 2nd respondent to consider the matter and<\/p>\n<p>pass orders within the time frame that is set in the rules.<\/p>\n<p>      3. Therefore, I dispose of this writ petition directing that the<\/p>\n<p>2nd respondent shall pass orders in terms of Rule 27 of the Rules as<\/p>\n<p><span class=\"hidden_text\">WPC No. 38167\/07                   -2-<\/span><\/p>\n<p>expeditiously as possible, at any rate within 10 days of production<\/p>\n<p>of a copy of this judgment.
