1.The petitioner has approached this Court seeking<\/p>\n
 to quash Ext.P10 whereby he has been essentially<\/p>\n
 ordered to close down a piggery. Whatever be the<\/p>\n
 contentions   of   the   petitioner,   the   larger<\/p>\n
 question that arises for decision in the writ<\/p>\n
 court  is  the  fact   that  the   operations  were<\/p>\n
 continuing  in   a  manner   injurious  to   public<\/p>\n
 health. I had, therefore, issued an order on<\/p>\n
 28.8.2009 which reads as follows:<\/p>\n
        “1.The  petitioner   filed  this   writ
\n        petition seeking stay of Ext.P10 which
\n        is challenged on the ground that it
\n        has  been  issued   by  an  incompetent
\n        authority.   The larger issue on the
\n        face of the court of justice is as to
\n        whether    the     petitioner,     who,<\/p>\n
WP(C)13060\/09           -: 2 :-<\/span><\/p>\n
          admittedly going by the submissions
\n          made today on his behalf, has 50 pigs
\n          in his pig farm, should be permitted
\n          to continue his operations in a manner
\n          injurious  to  public    health,  as is
\n          disclosed by the materials on record.
\n          In April, 2009, the Pollution Control
\n          Board has filed a report stating that
\n          at  the  time  of    inspection,  ordour
\n          nuisance could be experienced even at
\n          the  nearby   residences.      The   PCB
\n          accordingly   refused      consent    to
\n          operate.   This was four months ago.\n<\/p><\/blockquote>\n
          Later,  an   order     was   issued  on
\n          17.7.2009, enabling the petitioner to
\n          update the establishment to make it
\n          eligible  for    continued    operation.
\n          That order was issued after noticing
\n          Ext.R6(c)  which    evidences  that the
\n          Public  Health   Authorities   are  also
\n          unhappy with the manner in which the
\n          Panchayat is permitting activities in
\n          violation of the D & O Rules.\n<\/p><\/blockquote>\n
          2. What transpired after that interim
\n          order  is   that     on 24.7.2009,   the
\n          petitioner again applied to the PCB
\n          for consent to operate.    On 12.8.2009,
\n          directions  were    issued  by  the PCB<\/p>\n

          after an inspection on 5.8.2009.   Now,
\n          the  petitioner      says  that  he  is
\n          awaiting   the    assistance    of  the
\n          National    Institute       of     Inter
\n          Disciplinary  Science     &  Technology,
\n          Pappanamkode, referred to in the PCB
\n          communication dated 12.8.2009, which
\n          is Ext.P12.  He says that after that,
\n          he  will  make   a    proposal  for the
\n          implementation to the PCB.        It is
\n          further stated that the petitioner had
\n          contacted the National Institute of
\n          Inter    Disciplinary       Science    &
\n          Technology, which, in turn, has told
\n          the petitioner that they could visit
\n          the  premises         only  after  Onam
\n          holidays.\n<\/p><\/blockquote>\n
          3.    The    materials      on    record\n          categorically  demonstrate    that   the\n<\/pre>\n
          petitioner cannot continue with the
\n          activities awaiting    all the aforesaid
\n          clearance and have the pigs kept in
\n          unhygienic and shabby manner in which
\n          it is now.    Learned counsel for the
\n          Panchayat is right in saying that he
\n          is hiding away even the true figure
\n          before the public.       Taking all the
\n          relevant facts and circumstances into<\/p>\n
WP(C)13060\/09           -: 4 :-<\/span><\/p>\n
          consideration, it is directed that the
\n          petitioner will be permitted to keep
\n          the pigs for a period of one week from
\n          today and if he does not dispose off
\n          or remove the pigs from the place in
\n          question,  the   Panchayat   authorities
\n          will be at liberty to take action for
\n          disposal of those pigs in accordance
\n          with law and any loss sustained by the
\n          Panchayat  in  that    regard would  be
\n          recovered in terms of law.\n<\/p><\/blockquote>\n
             Post for further consideration on
\n       8.9.2009.”\n<\/p><\/blockquote>\n
2.That order was issued following an earlier order<\/p>\n
 dated 17.7.2009 which recorded the fact that even<\/p>\n
 the public health authorities are unhappy with<\/p>\n
 the manner in which the panchayat is permitting<\/p>\n
 the activities in violation of the D & O Rules.<\/p>\n
3.In the aforesaid circumstances, when the matter<\/p>\n
 was taken up day before yesterday, the counsel<\/p>\n
 for the panchayat stated that he has written<\/p>\n
 instructions    that   the    panchayat proceeded to<\/p>\n
WP(C)13060\/09           -: 5 :-<\/span><\/p>\n
 remove the pigs, close the piggery and auction<\/p>\n
 off the pigs, however that, not a single pig was<\/p>\n
 found in the site. The learned counsel for the<\/p>\n
 petitioner,    on  instructions   from his client,<\/p>\n
 stated that the said statement is not true and<\/p>\n
 there were half a dozen pigs even now available.<\/p>\n
4.This    matter  is  taken     up today to further<\/p>\n
 ascertain the situation. The learned counsel for<\/p>\n
 the petitioner stated that even this morning he<\/p>\n
 has instructions from his client that he has 6-7<\/p>\n
 pigs, as of now.\n<\/p>\n<\/p>\n
5.With the aforesaid, rather than niceties of the<\/p>\n
 rules governing licences, what is more important<\/p>\n
 is the requirement to ensure that no activity is<\/p>\n
 carried on without proper licence and without<\/p>\n
 clearance of the public health authorities.<\/p>\n
 In     the   aforesaid   circumstances, this  writ<\/p>\n
 petition is ordered directing that the first<\/p>\n
 respondent panchayat will ensure that necessary<\/p>\n
WP(C)13060\/09         -: 6 :-<\/span><\/p>\n
 action      is taken to     strictly  enforce the<\/p>\n
 provisions of law to ensure that public health<\/p>\n
 and hygiene is secured and no activity is carried<\/p>\n
 on, except in accordance with law. Any request of<\/p>\n
 the petitioner for modified licence, if made<\/p>\n
 within a week, will also be decided upon within a<\/p>\n
 further period of one week.\n<\/p>\n<\/p>\n
