Aftabhusen Ansari,<br \/>\n\tlearned advocate for the applicant and  Mr. Jayant Panchal, learned<br \/>\n\tSpecial Public Prosecutor for the respondent &#8211; State of<br \/>\n\tGujarat.  We have also perused the averments made in the application<br \/>\n\talong with annexures annexed therewith and also gone through the<br \/>\n\tjail remarks sheet as well as police report along with statements of<br \/>\n\tthe witnesses recorded by the police officers.\n<\/p>\n<p>Upon<br \/>\n\tperusal of the jail remarks sheet, we have noticed that the<br \/>\n\tapplicant has undergone total period of 3 years 11 months and 5 days<br \/>\n\timprisonment as against the imprisonment for 10 years.  So far as<br \/>\n\tpolice report is concerned, it is inter alia stated therein that if<br \/>\n\tthe applicant is released on temporary bail, then in all<br \/>\n\tprobability, he shall be likely to be flee away and absconded.  That<br \/>\n\tapart, so far as the marriage of the nephew is concerned, in all<br \/>\n\tthere are 8 male members including the present applicant.<br \/>\n\tTherefore, presence of the applicant is not absolutely indispensable<br \/>\n\tat the time of performing of the marriage ceremony of his nephew.<br \/>\n\tSo far as &#8216;Hakika&#8217; ceremony is concerned, it can be performed at any<br \/>\n\ttime prior to marriage of the son whose &#8216;Hakika&#8217; ceremony is<br \/>\n\tscheduled.  Therefore, the said ceremony can be postponed even for<br \/>\n\tnumber of years till the marriage of the son.  It is also required<br \/>\n\tto be noted that application has not been enlarged on bail on any<br \/>\n\toccasion.  It may be noted that the application has enjoyed furlough<br \/>\n\tleave on three occasions.  Therefore, there is no difficulty even to<br \/>\n\tperform the &#8216;Hakika&#8217; ceremony when he will be granted next furlough<br \/>\n\tleave by the police authority.  Therefore, according to us,<br \/>\n\tapplicant&#8217;s presence is not at all required at the time of<br \/>\n\tperforming the marriage of the nephew as other seven brothers of the<br \/>\n\tapplicant are already outside the jail and the &#8216;Hakika&#8217; ceremony can<br \/>\n\tbe performed at any time prior to the marriage of the son and which<br \/>\n\tcan be performed earlier also when he will be granted next furlough<br \/>\n\tleave.\n<\/p>\n<p>In<br \/>\n\tview of this, we are not inclined to release the applicant on<br \/>\n\ttemporary bail for a period of 3 weeks on the grounds stated by the<br \/>\n\tapplicant in the application.\n<\/p>\n<p>For<br \/>\n\tforegoing reasons, the application fails and it is accordingly<br \/>\n\trejected.
