Saharsa                               .....petitioner.\n                                        Versus\n                  STATE OF BIHAR                                 O.P.\n                                            -----------\n<\/pre>\n<p>3   06.10.2010                Learned counsel for the petitioner is permitted<\/p>\n<p>                    to make necessary correction in the prayer portion of the<\/p>\n<p>                    bail application.\n<\/p>\n<p>                              Heard the parties.\n<\/p>\n<p>                              In a criminal prosecution registered under<\/p>\n<p>                    sections 384. 307\/34 of the Indian Penal Code as also<\/p>\n<p>                    under section 27 of the Arms Act, 5 persons including<\/p>\n<p>                    petitioner have been arrayed as accused. According to<\/p>\n<p>                    the FIR accused persons had gone at the place of<\/p>\n<p>                    occurrence and were demanding rangdari (extortion).<\/p>\n<p>                    The petitioner is alleged to have fired but that hit one of<\/p>\n<p>                    the co-accused Kaushal Yadav.        It is submitted that<\/p>\n<p>                    admittedly none of the members of the prosecution party<\/p>\n<p>                    have sustained any injury at the hands of the accused<\/p>\n<p>                    persons. Co-accused Kaushal Yadav and three others<\/p>\n<p>                    were put on trial and they have been acquitted by the<\/p>\n<p>                    learned trial court.   The petitioner is stated to be in<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>judicial custody since 15.5.2010. It is further submitted<\/p>\n<p>that no other criminal case except the present one is<\/p>\n<p>pending against the petitioner.\n<\/p>\n<p>              In the aforesaid facts and circumstances, the<\/p>\n<p>above named petitioner is directed to be enlarged on bail<\/p>\n<p>on furnishing bail bond of Rs. 10,000\/- (ten thousand)<\/p>\n<p>with two sureties of like amount each to the satisfaction<\/p>\n<p>of F.T.C-III, Saharsa in S.Tr. No. 161 of 2010,arising<\/p>\n<p>out of Bakhtiyarpur P.S. Case No. 349 of 2009 subject<\/p>\n<p>to the conditions : (a) That one of the bailors must be<\/p>\n<p>Govt. servant.\n<\/p>\n<p>              (b) The other bailor must be close family<\/p>\n<p>member of the petitioner who will file an affidavit in the<\/p>\n<p>court below showing his\/her relationship with the<\/p>\n<p>petitioner.\n<\/p>\n<p>              (c) If the petitioner is found involved in same<\/p>\n<p>and similar nature of cases in future, then in that case the<\/p>\n<p>informant\/prosecution shall be at liberty to file a petition<\/p>\n<p>for cancellation of the bail of the petitioner, and if such a<\/p>\n<p>petition is filed, the court below would be obliged to<\/p>\n<p>dispose of the same in accordance with law after giving<\/p>\n<p>opportunity of hearing to all concerned.<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>                       (d) The petitioner shall make regular pairvi in<\/p>\n<p>         the court below in the present case either by appearing<\/p>\n<p>         himself in person or through representation by his lawyer<\/p>\n<p>         on each and every dates, and if on two consecutive dates<\/p>\n<p>         petitioner fails to make pairvi, then the court below<\/p>\n<p>         shall be at liberty to cancel the bail bond of the<\/p>\n<p>         petitioner.\n<\/p>\n<\/p>\n<p>                                    ( Birendra Prasad Verma, J)<\/p>\n<p>Rahman\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Amit Kumar Singh @ Amit Singh vs State Of Bihar on 6 October, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
