Heard Shri Abhay Kumar, learned counsel for<\/p>\n<p>                    the petitioners and Smt. Indu Bala Pandey, learned<\/p>\n<p>                    Additional Public Prosecutor for the State.<\/p>\n<p>                            The   present   petition   has   been    filed    for<\/p>\n<p>                    quashing of an order dated 18.7.2005 passed by the<\/p>\n<p>                    Sub   Divisional   Judicial   Magistrate,       Sasaram    in<\/p>\n<p>                    Complaint Case No.125 of 2004. By the said order,<\/p>\n<p>                    learned Magistrate has taken cognizance of offence<\/p>\n<p>                    under Section 498A of the Indian Penal Code.<\/p>\n<p>                            I have perused the complaint petition as<\/p>\n<p>                    well as the impugned order. Learned counsel for the<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>petitioners, while challenging the impugned order,<\/p>\n<p>has submitted that so far as petitioner no.5 is<\/p>\n<p>concerned, even in the complaint petition, it was<\/p>\n<p>categorically stated that he was not at all related<\/p>\n<p>to the in-laws family of the complainant and as<\/p>\n<p>such    no     proceeding         can   be     initiated        against<\/p>\n<p>petitioner no.5 under Section 498A of the Indian<\/p>\n<p>Penal Code. Learned counsel for the petitioners has<\/p>\n<p>also referred to number of documents enclosed with<\/p>\n<p>the    present      petition      to    show    that      the   present<\/p>\n<p>petition was filed maliciously.\n<\/p>\n<p>          I have perused the impugned order and the<\/p>\n<p>materials on record. So far as deciding the present<\/p>\n<p>case, it is not advisable for this Court to examine<\/p>\n<p>the documents, which have been brought on record by<\/p>\n<p>the petitioners at this stage. Those materials are<\/p>\n<p>required to be examined by the concerned court at<\/p>\n<p>appropriate        stage.   So    far   as     petitioner       no.5   is<\/p>\n<p>concerned,         since    the     complainant        herself         had<\/p>\n<p>admitted that petitioner no.5 was not relative of<\/p>\n<p>her in-laws family, the court is of the opinion<\/p>\n<p>that the prosecution against the petitioner no.5<\/p>\n<p>may    not     proceed.      Moreover,         in   the     complaint<\/p>\n<p>petition,      no    specific      allegation       has    been    made<\/p>\n<p>against      the    petitioner     no.5,     who    was    arrayed     as<\/p>\n<p>Accused No.6 in the complaint petition.<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>                   Accordingly, so far as petitioner no.5 is<\/p>\n<p>        concerned,      order   of   cognizance   is     set    aside.     In<\/p>\n<p>        respect of other accused persons, the court is of<\/p>\n<p>        the opinion that other petitioners have not made<\/p>\n<p>        out   an   exceptional       case   warranting      exercise      of<\/p>\n<p>        inherent power in their favour.\n<\/p>\n<p>                   Accordingly,      the    petition   in      respect     of<\/p>\n<p>        petitioner nos.1 to 4 stands rejected.
