(2)\t26\n JT 1994 (1)   427\t  1994 SCALE  (1)419\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>The Judgment of the Court was delivered by<br \/>\nHANSARIA,  J.- The appellant is a manufacturer, inter  alia,<br \/>\nof parts of internal combustion piston engines.\t A  question<br \/>\nwas  raised at one point of time whether the  appellant\t was<br \/>\nentitled  to  the  benefit of  notification  No.  281-Cus\/76<br \/>\ngranting  some\texemption from payment of  customs  duty  in<br \/>\nrespect of rod bushes and camshaft bushes.  On exemption not<br \/>\nhaving\tbeen  given  on the product of\tthe  appellant,\t the<br \/>\nmatter came to be examined ultimately by this Court in Civil<br \/>\nAppeal\tNo.  335  of 1987 and by the  judgment\trendered  on<br \/>\nSeptember  18,\t1987,  it was held that\t the  appellant\t was<br \/>\nentitled to the exemption.\n<\/p>\n<p>2.The aforesaid notification held the field till February<br \/>\n28, 1986, whereafter notification No. 153-Cus\/86 came to  be<br \/>\nissued\ton the selfsame subject.  The notification which  is<br \/>\ndated  March 1, 1986 came to be amended by notification\t No.<br \/>\n203-Cus, dated March 13, 1986.\tThe benefit of the exemption<br \/>\nunder  these  notifications  was  initially  denied  to\t the<br \/>\nappellants but came to be granted ultimately.\n<\/p>\n<p>3.The  Customs Tariff Act was amended subsequently and\ta<br \/>\nnew  notification, this time bearing No. 69-Cus\/87, came  to<br \/>\nbe issued on March 1, 1987.  The appellant claimed exemption<br \/>\nunder this notification also which has not been granted yet.<br \/>\nOn this not being done, an approach was made to the  Custom,<br \/>\nExcise\tand Gold (Control) Appellate Tribunal (CEGAT)  which<br \/>\ntoo  did  not grant this prayer of the\tappellant.   Feeling<br \/>\naggrieved,  this appeal has been filed under the  provisions<br \/>\nof Section 130-E(b) of the Customs Act, 1962.\n<\/p>\n<p>4.A  perusal of the order of the Tribunal shows\t that  it<br \/>\nrequired  the appellant to follow the hierarchy inasmuch  as<br \/>\neven  the  Collector had not taken a final decision  in\t the<br \/>\nmatter\tand no assessment order refusing the  exemption\t had<br \/>\nbeen  passed.  It is because of this that the Tribunal\theld<br \/>\nthat  it  cannot  pass any order relating to  the  claim  of<br \/>\nexemption  inasmuch as the party which may get affected\t had<br \/>\nnot been given opportunity to put forth its ground.\n<\/p>\n<p>5.Shri\tDholakia,  learned  counsel  for  the  appellant,<br \/>\ncontends  that though there is no assessment order  as\tsuch<br \/>\nafter  refusing the exemption prayed for, the order  of\t the<br \/>\nCollector  noted  by  the Tribunal would show  that  he\t had<br \/>\nvirtually  refused the exemption; and so, it is a  fit\tcase<br \/>\nwhere in this proceeding itself this Court should decide the<br \/>\nquestion  raised by the appellant, instead of leaving it  to<br \/>\nagitate the matter before the Collector which, according  to<br \/>\nlearned counsel, would serve no purpose in view of the stand<br \/>\ntaken by the Collector.\n<\/p>\n<p>6.Let  it  be  seen  as\t to what  is  the  stand  of  the<br \/>\nCollector.   This  appears from the  following\tobservations<br \/>\nmade by him as noted at paragraph 11 of the Tribunal&#8217;s order<br \/>\n:\n<\/p>\n<blockquote><p>\t      &#8220;With reference to the claims made by M\/s Jain<br \/>\n\t      Engineering  Co.\tDelhi,\tfor  extending\t the<br \/>\n\t      benefit  in terms of notification\t No.  69\/87,<br \/>\n\t      dated  March  1,\t1987, 1\t observe  that\tthis<br \/>\n\t      benefit  flows to parts falling under  heading<br \/>\n\t      98.06.  The  statute i.e. the  Customs  Tariff<br \/>\n\t      Act, was amended w.e.f. March 1, 1987 and that<br \/>\n\t      in  the  statute\tboth  84.09  and  98.06\t are<br \/>\n\t      coexisting and in the matter gone into by\t the<br \/>\n\t      Hon&#8217;ble Supreme Court there was no occasion<br \/>\n\t      to  consider  the\t changes  effected  in\t the<br \/>\n\t      statute,\teven  though their order  was  dated<br \/>\n\t      September 1987. 1 do not accept the contention<br \/>\n\t      of the importer for benefit under Notification<br \/>\n\t      69\/87-CLIS  in respect of parts which are\t not<br \/>\n\t      classifiable  under heading No. 98.06 of\tCTA.<br \/>\n\t      If the importer has<br \/>\n<span class=\"hidden_text\">\t       31<\/span><br \/>\n\t      any grievance with reference to classification<br \/>\n\t      of  any  parts or application or otherwise  of<br \/>\n\t      notification   No.  69\/87-Cus  or\t any   other<br \/>\n\t      notification,  he\t is advised to\tagitate\t the<br \/>\n\t      matter before the competent assessing  officer<br \/>\n\t      for  his\tconsideration.\t I  hold  that\t the<br \/>\n\t      request  for  extension of the  benefit  under<br \/>\n\t      notification  No.\t 69\/87-Cus, dated  March  1,<br \/>\n\t      1987 does not flow directly from the  decision<br \/>\n\t      and directions contained in the original order<br \/>\n\t      dated  September\t18,  1987  of  the   Hon&#8217;ble<br \/>\n\t      Supreme Court which is the main judgment which<br \/>\n\t      has to be applied in deciding all the  pending<br \/>\n\t      cases.&#8221;\n<\/p><\/blockquote>\n<p>7.  The aforesaid shows that the view of the  Collector\t was<br \/>\nthat  the claim for exemption under notification  No.  67\/87<br \/>\ndid not flow directly from the decision of this Court.\tShri<br \/>\nDholakia  contends that the Collector was  only\t technically<br \/>\nright  in taking this view because a close reading  of\tthis<br \/>\nCourt&#8217;s\t aforesaid judgment would go to show that  exemption<br \/>\nunder notification No. 69-Cus\/87 could not have been  denied<br \/>\nmerely\tbecause\t under\tthe Customs Tariff  Act\t as  amended<br \/>\nheadings  84.09 and 98.06 coexist inasmuch as Chapter 98  of<br \/>\nthe  Act, if read in its entirety along with Notes 1  and  7<br \/>\nand  heading  98.06  would show that the fact  that  in\t the<br \/>\npresent\t classification the machinery parts are\t covered  by<br \/>\n98.06  would  not  make\t any difference\t and  the  goods  in<br \/>\nquestion shall have to be     taken to fall under 84.07\t and<br \/>\n84.08,\twhich  headings\t under\tnotification  No.  281-CS\/76<br \/>\n(which was the subject-matter of this Court&#8217;s examination in<br \/>\nthe  aforesaid\tcase) was 84.06. Shri  Dholakia\t strenuously<br \/>\nurges that the observation made by this Court in its earlier<br \/>\njudgment  that\tparts  covered by heading  84.06  &#8216;will\t get<br \/>\nbenefit of exemption&#8217; leaves no manner of doubt that benefit<br \/>\nunder notification No. 69-Cus\/87 has also to be given.\n<\/p>\n<p>8.  We\thave not felt inclined to express our  view  on\t the<br \/>\ncontention  advanced  by Shri Dholakia because there  is  no<br \/>\norder  of  even the first assessing  authority\tdenying\t the<br \/>\nexemption,  dehors  what  was  held by\tthis  Court  in\t its<br \/>\naforesaid      judgment. It is apparent that by the force of<br \/>\nthe aforesaid judgment alone, benefit of the exemption under<br \/>\nnotification No. 69-Cus\/87 cannot be claimed, though it\t may<br \/>\nbe  that the view taken by this Court in the earlier  appeal<br \/>\nlends\t  support to the contention of the assessee, if what<br \/>\nhas been provided in amended  Chapter  98  is read  as\tShri<br \/>\nDholakia would like.\n<\/p>\n<p>9.   The  learned  counsel presses for our decision  on\t the<br \/>\npoint  involved by referring to order dated August  1,\t1989<br \/>\n(passed in the aforesaid appeal of this Court) by which\t the<br \/>\nCollector  was\trequired  to dispose of\t the  claim  of\t the<br \/>\nappellant  for exemption under the subsequent  notification.<br \/>\nThis not having been done, it is urged that the\t appellants&#8217;<br \/>\nprayer\tin  question  may  be  considered  by  us  in\tthis<br \/>\nproceeding itself, instead of requiring it to knock the door<br \/>\nof the Collector again.\t It may be that the Collector should<br \/>\nhave  finally disposed of this order.  But he has  not.\t  In<br \/>\nview  of  this,\t it may as well be that\t the  Court  has  no<br \/>\njurisdiction to entertain the present appeal because of what<br \/>\nhas  been held in <a href=\"\/doc\/1415193\/\">Navin Chemicals Manufacturing and  Trading<br \/>\nCo.  Ltd.  v.  Collector  of Customs&#8217;<\/a> as  there\t is  yet  no<br \/>\nassessment for the period in question.\tSo, we refrain.\n<\/p>\n<p>10.The\tappeal, therefore, stands dismissed.   To  protect<br \/>\nthe  interest  of the appellant we would,  however,  observe<br \/>\nthat  if there has been any provisional assessment by  which<br \/>\nexemption under notification No. 69-Cus\/87 has been  denied,<br \/>\nit  would be open to it to prefer appeal(s) within a  period<br \/>\nof one month<br \/>\n1    (1993) 4 SCC 320: JT (1993) 5 SC 362<br \/>\n<span class=\"hidden_text\">32<\/span><br \/>\nfrom today, which it might not have done earlier because  of<br \/>\nthe  pendency  of  this appeal.\t On  this  being  done,\t the<br \/>\ndepartment  shall not raise the question of limitation.\t  On<br \/>\nthe facts and circumstances of the case, we make no order as<br \/>\nto costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Balbir Singh vs State Of Punjab on 8 February, 1994 Equivalent citations: 1994 AIR 969, 1994 SCC Supl.
