Sinha, J.\n<\/p>\n<\/p>\n<p>1.    Leave granted.\n<\/p>\n<p><span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>2.    This appeal is directed against a judgment and order dated 12.05.2005<\/p>\n<p>passed by a Division Bench of the Madhya Pradesh High Court whereby<\/p>\n<p>and whereunder a writ petition filed by the appellant herein from a judgment<\/p>\n<p>and order of the Central Administrative Tribunal allowing the respondent&#8217;s<\/p>\n<p>original application, was dismissed.\n<\/p>\n<\/p>\n<p>3.    Respondent, at all material times, was and still is working as<\/p>\n<p>Inspector of Works at Satna. Allegedly, on the premise that he had accepted<\/p>\n<p>substandard quality of wood, a charge-sheet was issued. Indisputably, the<\/p>\n<p>procedure for imposition of major penalties on Railway Servants is<\/p>\n<p>governed by Chapter V of Establishment Code Volume-I; paragraph 3<\/p>\n<p>whereof reads as under :\n<\/p>\n<\/p>\n<blockquote><p>            &#8220;3. Appointment of Board of Inquiry or<br \/>\n            Inquiring Officer (R.1710). The Disciplinary<br \/>\n            Authority may enquire into the charges itself or if<br \/>\n            it considers necessary, it may, either at the time of<br \/>\n            communicating the charges to the Railway servant<br \/>\n            under Rule 1709 or at any time thereafter, appoint<br \/>\n            a Board of Inquiry or an Inquiring Officer for the<br \/>\n            purpose, which will be termed as the &#8220;Inquiring<br \/>\n            Authority&#8221;.\n<\/p><\/blockquote>\n<blockquote><p>                   Note&#8211;This is an enabling rule. The inquiry<br \/>\n            may be conducted by the Disciplinary Authority<br \/>\n            itself or he may get the same done through an<br \/>\n            agency of his choice. The choice is confined<br \/>\n            either to a Board or a named Officer. The<br \/>\n            procedure in all cases is to be in accordance with<br \/>\n            that laid down in Rule 1709 ante.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>4.    An Enquiry Officer was appointed for holding the said disciplinary<\/p>\n<p>enquiry. He was a Chief Engineer being on deputation to the Vigilance<\/p>\n<p>Department. Whereas the appointing authority of the respondent was of the<\/p>\n<p>rank of District Railway Manager, the Disciplinary authority is only a<\/p>\n<p>Senior Executive Engineer. The District Railway Manager of Railways is<\/p>\n<p>also the appellate authority.\n<\/p>\n<\/p>\n<p>5.    Before the disciplinary proceedings         commenced,       respondent,<\/p>\n<p>indisputably by a letter dated 20.2.1996 requested the Inquiry Officer to<\/p>\n<p>summon the Assistant Engineer Mr. B.S. Walia, stating :<\/p>\n<blockquote><p>             &#8220;You will be kind enough to fix up date of the<br \/>\n             next inquiry in first Fortnight of March 1996<br \/>\n             anywhere as per your convenience.\n<\/p><\/blockquote>\n<blockquote><p>             Shri B.S. Walia, A.E.N.(M) STA now A.E.N. (M)<br \/>\n             N.G.P. &#8220;Headquarter&#8221; must be called for as the<br \/>\n             AEN who recorded 100% test check.\n<\/p><\/blockquote>\n<blockquote><p>             All other witnesses to whom the vigilance wants<br \/>\n             to examine may be called and there presence be<br \/>\n             ensured. Further the inquiries date to be fixed for<br \/>\n             examination and the same sequence arguments are<br \/>\n             also submitted.      This will facilitate early<br \/>\n             completion of an inquiry.\n<\/p><\/blockquote>\n<blockquote><p>                   EX AEN (C) STA Shri B.S. Walia, who is<br \/>\n             of course is a Rly. Witness but since he is very<br \/>\n             much involved in measurements and checking in<br \/>\n             supply, he may be specifically be requested to be<br \/>\n             present to clear many contradiction to enable the<br \/>\n<span class=\"hidden_text\">                                     4<\/span><\/p>\n<p>             inquiry officer to derive at a fair and free judicious<br \/>\n             conclusion.&#8221;\n<\/p><\/blockquote>\n<p>6.    The said letter was not responded to. It was not rejected either.<\/p>\n<p>Concededly, the said Mr. Walia was not examined.\n<\/p>\n<p>7.    In the disciplinary proceedings, respondent was found guilty.<\/p>\n<p>Punishment of reduction of pay to the lower stage in the scale of 6500-<\/p>\n<p>10500\/- for a period of two years with cumulative effect was imposed on<\/p>\n<p>him by the disciplinary authority by an order dated 6.1.1998. He preferred<\/p>\n<p>an appeal thereagainst before the Appellate Authority which was also<\/p>\n<p>dismissed.   The Appellate Authority enhanced the penalty by directing<\/p>\n<p>reduction of his pay to the lowest stage of Rs.6500\/- in the scale of pay of<\/p>\n<p>Rs.6500-10500\/- for a period of three years with cumulative effect.<\/p>\n<p>8.    Order of the Appellate Authority was questioned by the respondent<\/p>\n<p>by filing an original application before the Central Administration Tribunal.<\/p>\n<p>In the said application, respondent, inter alia, contended that Inquiry Officer<\/p>\n<p>being superior in rank to the Disciplinary Authority and Mr. B.S. Walia<\/p>\n<p>having not been examined as a witness by the Department, the order<\/p>\n<p>imposing penalty was unsustainable.\n<\/p>\n<\/p>\n<p>      The learned Tribunal held :\n<\/p>\n<p><span class=\"hidden_text\">                                   5<\/span><\/p>\n<blockquote><p>            &#8220;After hearing the learned counsel for the parties,<br \/>\n            we find from Annexure-A3 that &#8220;AEN is<br \/>\n            responsible for correctness of m\/ment for all<br \/>\n            works&#8221; and applicant has also requested to the<br \/>\n            respondents to call the AEN for clarifying the<br \/>\n            picture. But, he was not called whereas he was<br \/>\n            main person to clarify the picture. In the reply the<br \/>\n            respondents have stated that Shri Walia was<br \/>\n            interrogated by the vigilance and nothing was<br \/>\n            found against him. Hence he was not called nor<br \/>\n            cited as witness. It seems to be not satisfactory,<br \/>\n            therefore, the contention of the respondents is<br \/>\n            rejected. We have also found that the enquiry<br \/>\n            officer was from a different department and of a<br \/>\n            different division and thus there is no question of<br \/>\n            daring to disagree or a reappreciated the findings<br \/>\n            by independent application of mind. However, the<br \/>\n            argument advanced by the respondents also does<br \/>\n            not seem to be proper and justified. The enquiry<br \/>\n            officer must be junior to the disciplinary authority.<br \/>\n            He may be of any department. If the enquiry<br \/>\n            officer is senior to the disciplinary authority, the<br \/>\n            same is neither legal nor justified and it is against<br \/>\n            the principles of natural justice.&#8221;\n<\/p><\/blockquote>\n<p>9.    The writ petition filed by the appellant has been dismissed by the<\/p>\n<p>High Court by reason of the impugned judgment.\n<\/p>\n<\/p>\n<p>10.   Ms. Rajni Ohri Lal, learned counsel appearing on behalf of the<\/p>\n<p>appellant, would submit that respondent cannot be said to have been<\/p>\n<p>prejudiced by reason of the appointment of the Chief Engineer as an enquiry<\/p>\n<p>officer who was on deputation to Vigilance Department as he was from a<\/p>\n<p>different department and, thus, the disciplinary authority or the appellate<br \/>\n<span class=\"hidden_text\">                                    6<\/span><\/p>\n<p>authority were not working under him. In any event, had such a plea been<\/p>\n<p>raised by the respondent before the disciplinary authority, the enquiry<\/p>\n<p>officer could have been changed and in that view of the matter, he must be<\/p>\n<p>held to have waived his right. It was urged that as the function of the<\/p>\n<p>disciplinary authority and the enquiry officer are different, the question of<\/p>\n<p>suffering any prejudice by the respondent did not arise. So far as non-<\/p>\n<p>summoning of the witness of Mr. Walia is concerned, the learned counsel<\/p>\n<p>would contend, he had been interrogated by the vigilance department and as<\/p>\n<p>he was found to be innocent, it was not found necessary to examine him. It<\/p>\n<p>was always open to the prosecution, the learned counsel would contend, to<\/p>\n<p>examine or not to examine any witness on behalf of the department.<\/p>\n<p>11.   Mr. Raju, learned counsel appearing on behalf of the respondent, on<\/p>\n<p>the other hand, would contend that examination of Mr. Walia was essential<\/p>\n<p>as the passing of timber and wood work was within the domain of the<\/p>\n<p>Executive Engineer.\n<\/p>\n<\/p>\n<p>12.   The learned counsel appears to be correct. The Central Railway<\/p>\n<p>Administration as far back as on 3.4.1990 issued a clarification as to<\/p>\n<p>whether the power of the Assistant Engineer to pass the timber\/wood work<\/p>\n<p>has been taken away or not, to state :\n<\/p>\n<p><span class=\"hidden_text\">                                    7<\/span><\/p>\n<blockquote><p>             &#8220;The matter has been scrutinized &amp; it is observed<br \/>\n             that the confusion has arisen due to use of the<br \/>\n             word `Engineer&#8217; in the specification No.1001.<br \/>\n             Corelating the word Engineer with GCC implied<br \/>\n             Divisional Engineer and hence the interpretation<br \/>\n             was extended accordingly in the circular referred<br \/>\n             above.\n<\/p><\/blockquote>\n<blockquote><p>             However, after reconsidering the matter and going<br \/>\n             through the instructions on delegation of powers<br \/>\n             in respect of measurement (RB&#8217;s letter<br \/>\n             No.71\/W1\/CT\/16 dated 23.7.87) it is seen that<br \/>\n             AEN is responsible for correctness of m\/ment for<br \/>\n             all works. Wood work and other materials have<br \/>\n             been traditionally been passed by Asst. Engineer.<br \/>\n             Hence, it has been decided by CE in partial<br \/>\n             modification of above circular that woodwork<br \/>\n             shall continue to be passed by Asst. Engineer.&#8221;\n<\/p><\/blockquote>\n<p>13.   Respondent, in his defence, contended that the measurement book<\/p>\n<p>was checked by Mr. Walia on 5.7.1991 and 6.7.1991. According to him, he<\/p>\n<p>was not at all responsible either as regards the quality of wood or the<\/p>\n<p>correctness of measurement of the timber in question.<\/p>\n<p>14.   The disciplinary proceedings were initiated only after a raid was<\/p>\n<p>conducted by the Vigilance Department. The enquiry officer was the Chief<\/p>\n<p>of the Vigilance Department.       He evidently being from the Vigilance<\/p>\n<p>Department, with a view to be fair to the delinquent officer, should not have<\/p>\n<p>been appointed as an enquiry officer at all.\n<\/p>\n<p><span class=\"hidden_text\">                                    8<\/span><\/p>\n<p>15.   From the evidence of another Assistant Engineer who had taken part<\/p>\n<p>in the raid, it is evident that the alleged loss caused to the railways was<\/p>\n<p>negligible and mere marginal allowances are permitted for measurement of<\/p>\n<p>`scantlings and planks&#8217;.\n<\/p>\n<\/p>\n<p>16.   In the aforementioned situation, we are of the opinion that the<\/p>\n<p>Tribunal as also the High Court cannot be said to have erred in holding that<\/p>\n<p>the said Mr. Walia should have been examined as a witness.<\/p>\n<p>17.   The principles of natural justice demand that an application for<\/p>\n<p>summoning a witness by the delinquent officer should be considered by the<\/p>\n<p>enquiry officer. It was obligatory on the part of the enquiry officer to pass<\/p>\n<p>an order in the said application. He could not refuse to consider the same.<\/p>\n<p>It is not for the Railway Administration to contend that it is for them to<\/p>\n<p>consider as to whether any witness should be examined by it or not. It was<\/p>\n<p>for the enquiry officer to take a decision thereupon.         A disciplinary<\/p>\n<p>proceeding must be fairly conducted. An enquiry officer is a quasi judicial<\/p>\n<p>authority. He, therefore, must perform his functions fairly and reasonably<\/p>\n<p>which is even otherwise the requirement of the principles of natural justice.<\/p>\n<p>18.   <a href=\"\/doc\/610401\/\">In M.V. Bijlani v. Union of India &amp; Ors.<\/a> [(2006) 5 SCC 88], this<\/p>\n<p>Court has held :\n<\/p>\n<p><span class=\"hidden_text\">                                      9<\/span><\/p>\n<blockquote><p>                &#8220;Although the charges in a departmental<br \/>\n                proceeding are not required to be proved like a<br \/>\n                criminal trial i.e. beyond all reasonable doubt, we<br \/>\n                cannot lose sight of the fact that the enquiry<br \/>\n                officer performs a quasi-judicial function, who<br \/>\n                upon analyzing the documents must arrive at a<br \/>\n                conclusion that there had been a preponderance of<br \/>\n                probability to prove the charges on the basis of<br \/>\n                materials on record. While doing so, he cannot<br \/>\n                take into consideration any irrelevant fact. He<br \/>\n                cannot refuse to consider the relevant facts. He<br \/>\n                cannot shift the burden of proof. He cannot reject<br \/>\n                the relevant testimony of the witnesses only on the<br \/>\n                basis of surmises and conjectures. He cannot<br \/>\n                enquire into the allegations with which the<br \/>\n                delinquent officer had not been charged with.&#8221;\n<\/p><\/blockquote>\n<p>19.   If the disciplinary proceedings have not been fairly conducted, an<\/p>\n<p>inference can be drawn that the delinquent officer was prejudiced thereby.<\/p>\n<p>20.   <a href=\"\/doc\/1306907\/\">In S.L. Kapoor v. Jagmohan &amp; Ors.<\/a> (1980) 4 SCC 379, this Court has<\/p>\n<p>held that non-compliance of the principles of natural justice itself causes<\/p>\n<p>prejudice. We are not oblivious of the fact that the said principle has since<\/p>\n<p>been watered down but in a situation of this nature, we are of the opinion<\/p>\n<p>that the concurrent findings of the Tribunal, as also the High Court cannot<\/p>\n<p>be said to be unreasonable or suffering from any legal infirmity warranting<\/p>\n<p>interference.\n<\/p>\n<\/p>\n<p>21.   The appeal, therefore, is dismissed with costs. Counsel&#8217;s fee assessed<\/p>\n<p>at Rs.10,000\/-.\n<\/p>\n<p><span class=\"hidden_text\">                    10<\/span><\/p>\n<p>                         &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.J.\n<\/p>\n<p>                                  [S.B.
