No.9100 of 2011\n                                      AWADHESH KUMAR DAS\n                                                Versus\n                                        THE STATE OF BIHAR\n                                               -----------\n<\/pre>\n<p>2        29.03.2011               Heard learned counsel for the petitioner as well as<\/p>\n<p>                      learned Additional Public Prosecutor for the State.<\/p>\n<p>                                  Petitioner is languishing in jail custody since 27-1-<\/p>\n<p>                      2011 in connection with Manigachhi P.S. Case No.18 of 2011<\/p>\n<p>                      registered under Section 7 of Essential Commodities Act.<\/p>\n<p>                                  It appears that allegedly petitioner lifted grains under<\/p>\n<p>                      different schemes of the Government, but he sold the aforesaid<\/p>\n<p>                      grains in black-marketing.\n<\/p>\n<p>                                  The contention of learned counsel for the petitioner is<\/p>\n<p>                      that the grains were distributed among the beneficiaries, but the<\/p>\n<p>                      record could not be maintained because the concerned clerk had<\/p>\n<p>                      gone out of station in connection with his work.<\/p>\n<p>                                  Taking into consideration the above stated submission<\/p>\n<p>                      as well as period of detention of the petitioner in jail custody, let<\/p>\n<p>                      the petitioner, namely, Awadhesh Kumar Das be released on bail<\/p>\n<p>                      on furnishing bail bonds of Rs.10,000\/-(Ten Thousand) with two<\/p>\n<p>                      sureties of the like amount each, to the satisfaction of learned<\/p>\n<p>                      Chief Judicial Magistrate, Darbhanga in connection with above<\/p>\n<p>                      stated Manigachhi P.S.
