NO. 4544 OF 2009 N\n                  --------------------------------------\n               Dated this the 20th February, 2009\n\n                            JUDGMENT\n<\/pre>\n<p>      Petitioner has approached this Court seeking a mandamus<\/p>\n<p>to the third respondent not to take revenue recovery proceedings<\/p>\n<p>against him and to furnish demand notice to him under the<\/p>\n<p>Revenue Recovery Act in regard to the proposed revenue<\/p>\n<p>recovery. Case of the petitioner, in brief, is as follows:<\/p>\n<p>      The third respondent, the Kerala Toddy Workers&#8217; Welfare<\/p>\n<p>Fund Inspector, made a final determination order making the<\/p>\n<p>petitioner liable. Petitioner states that he has not received it and<\/p>\n<p>he filed a Writ Petition against the revenue recovery<\/p>\n<p>proceedings. It is stated that the petitioner&#8217;s deceased father had<\/p>\n<p>conducted toddy shop and his mother filed a Suit and obtained a<\/p>\n<p>Decree.     The Writ Petition was disposed of vide Ext.P1.<\/p>\n<p>Petitioner sought legal advice after getting Ext.P1 Judgment and<\/p>\n<p>he filed Appeal.      Now, the petitioner states that there are<\/p>\n<p>revenue recovery proceedings against him.<\/p>\n<p><span class=\"hidden_text\">WPC.4544\/09 N                    2<\/span><\/p>\n<p>      2. I heard the learned counsel for the petitioner, learned<\/p>\n<p>standing counsel appearing for the third respondent and also the<\/p>\n<p>learned Government Pleader.\n<\/p>\n<p>      3. The proceedings are apparently under the Kerala Toddy<\/p>\n<p>Workers&#8217; Welfare Fund Act. A perusal of Ext.P1 would show<\/p>\n<p>that the earlier Writ Petition filed by the petitioner challenging<\/p>\n<p>the proceedings for recovery of arrears of toddy workers welfare<\/p>\n<p>fund, was dismissed by this Court. Dealing with the contention<\/p>\n<p>that the father of the petitioner was the licensee, it was the<\/p>\n<p>argument of the learned standing counsel for the Board that it<\/p>\n<p>was the petitioner who was carrying on the business and final<\/p>\n<p>determination order was issued in his name, and thereafter, the<\/p>\n<p>Court had held that if the petitioner has any grievance against<\/p>\n<p>the final determination order, he has to collect the order and<\/p>\n<p>challenge the same in appeal. Therefore, the mandamus sought<\/p>\n<p>not to take revenue recovery proceedings against the petitioner<\/p>\n<p>is clearly in the teeth of Ext.P1 Judgment, wherein also the<\/p>\n<p>prayer was not to take recovery steps against the petitioner. The<\/p>\n<p><span class=\"hidden_text\">WPC.4544\/09 N                    3<\/span><\/p>\n<p>further prayer is to direct the third respondent to issue the<\/p>\n<p>demand notice to the petitioner.       Learned standing counsel<\/p>\n<p>points out that already the final determination order was served.<\/p>\n<p>I do not see any merit in either of the prayers of the petitioner.<\/p>\n<p>According to the petitioner, he has challenged it before the<\/p>\n<p>Government.     I express no view on the appeal and if the<\/p>\n<p>petitioner has any right in respect of the same, it is for the<\/p>\n<p>petitioner to prosecute the appeal before the Appellate<\/p>\n<p>Authority.\n<\/p>\n<p>      Subject to the above, the Writ Petition is dismissed.<\/p>\n<p>                                             Sd\/=<br \/>\n                                      K.
