BASANT, J.\n\n\n             ````````````````````````````````````````````````````\n\n                      B.A. No. 329 OF 2008 C\n\n             ````````````````````````````````````````````````````\n\n            Dated this the 21st day of January, 2008\n\n\n                               O R D E R\n<\/pre>\n<p>             Application   for   anticipatory   bail.     Petitioners   are<\/p>\n<p>accused  Nos.1 to 5.   Altogether  there five accused  persons.<\/p>\n<p>All   the   five   had   allegedly   attempted   to   transport   arrack   on<\/p>\n<p>23.12.07 when they were intercepted by the detecting excise<\/p>\n<p>party.     Each   of   them   was   allegedly   carrying   a   tube   which<\/p>\n<p>contained about 20 litres of arrack.  They ran away on seeing<\/p>\n<p>the   excise   party.     They   could   not   be   apprehended.     The<\/p>\n<p>contemporaneous seizure mahazar and the occurrence report<\/p>\n<p>reveal   the   complicity   of   the   petitioners.     Their   names   are<\/p>\n<p>allegedly ascertained from the local witnesses.   Investigation<\/p>\n<p>is in progress.  Petitioners apprehend imminent arrest.<\/p>\n<p>      2.     The learned counsel for the petitioners submits that<\/p>\n<p>the allegations are totally false and vexatious.  The petitioners<\/p>\n<p>may be granted anticipatory bail, it is prayed.<\/p>\n<p>BA.329\/08<\/p>\n<p><span class=\"hidden_text\">                                       : 2 :<\/span><\/p>\n<p>      3.      The   learned   Public   Prosecutor   opposes   the<\/p>\n<p>application.     The   learned   Public   Prosecutor   submits   that   the<\/p>\n<p>first   accused   has   criminal   antecedents,   which   point   to   the<\/p>\n<p>culpability   of   the   petitioners.     There   are   no   circumstances<\/p>\n<p>warranting   or   justifying   the   invocation   of   the   extraordinary<\/p>\n<p>equitable   discretion   under   Section   438   Cr.P.C.     The<\/p>\n<p>petitioners   may   now   be   directed   to   surrender   before   the<\/p>\n<p>learned  Magistrate  or  the   investigating  officer  and  then   seek<\/p>\n<p>regular bail in the ordinary course, submits the learned Public<\/p>\n<p>Prosecutor.\n<\/p>\n<\/p>\n<p>      4.      I  find   merit   in   the  opposition   of  the   learned   Public<\/p>\n<p>Prosecutor.    I   am   satisfied   that   there   are   no   features   in   this<\/p>\n<p>case   which   would   justify   the   invocation   of   the   extraordinary<\/p>\n<p>equitable discretion under Section 438 Cr.P.C.   This, I agree<\/p>\n<p>with   the   learned   Public   Prosecutor,     is   a   fit   case   where   the<\/p>\n<p>petitioners must appear before the investigating officer or the<\/p>\n<p>learned   Magistrate   having   jurisdiction   and   then   seek   regular<\/p>\n<p>bail in the normal and ordinary course.\n<\/p>\n<p>\nBA.329\/08<\/p>\n<p><span class=\"hidden_text\">                                    : 3 :<\/span><\/p>\n<p>       5.    In the result, this petition is dismissed.
