claiming compensation on account of the death<\/p>\n
of one Santhosh who died. in a road xtraffici\ufb01\u00e9<\/p>\n
accident occurred on 31.10.2002 at ahout 80000:<\/p>\n

\nappellant’s bus bearinc\ufb01;ho\u00a2g\ufb01:\ufb0201 F 421.
\nAccording to fthe;_cieimants;lJdeceased was<\/p>\n
studying’ in 3\ufb01n\u00a7ine\u00a7\u00a3in\u00a7= College. He would<\/p>\n
have completed the Engineering Course shortly.<\/p>\n
The clairrianta. 0′ .fVi1ed:..’i’a claim petition under”<\/p>\n
.gsection_0163A”*o\u00a3M.the Motor Vehicles Act,<\/p>\n
V7contending%that his income has to be taken at<\/p>\n
RsI\u00a20}000}\u00a5fifconsidering the provision of<\/p>\n
‘Section 1633. The Trial Court considering the<\/p>\n
uincome\u00e9 of the deceased at Rs.40,000\/– per<\/p>\n
45, emonth has awarded a sum of Rs.3,60,000\/– under<\/p>\n
ulthe head, loss of dependency. In addition to<\/p>\n
as\/0<\/p>\n
that a sum of Rs.40,000\/- is awarded on the<\/p>\n
conventional heads. Thus, in Wallh<\/p>\n
Rs.4,00,000\/– has been awarded 7\u00a3;\u00a7g;fg<\/p>\n
compensation. Being aggrieved by”thegsame,p<\/p>\n
the present appeal is filedt\ufb01 :”\n<\/p>\n
3. The main contention of the appellants<\/p>\n
before us is the claimants did not pro\u00a7e the<\/p>\n
income of the deceased5V_atWxgRs.40,000\/-.<\/p>\n
Admittedly, the deoeased was osgy studying in
\nEngineerind \u00a7cligggt hand after completion of
\nhis En\u00a7ih\u00a7\u00e9\ufb01;n\u00a7\u00a7@s@;\u00a7e_hi\u00a7 income could not
\nhave been less than Rs 15,000\/~ per month. In<\/p>\n
this View of the matter, we are of the opinion<\/p>\n
l. that the Hciaim petition filed under sec.163A<\/p>\n
  ;iot:’\u00abV…vv’Vb:eneficial to the claimants and if<\/p>\n
., jthey.had’tiled a petition under sec.166 of the<\/p>\n
lws\ufb01.V. Act, they would have been awarded more<\/p>\n
4l.oompensation than what has been awarded.<\/p>\n
Rd=Therefore, we are of the View that the<\/p>\n
,\\_%\/.\n<\/p>\n
findings of the Trial Court in regard to the<\/p>\n
income of the deceased at Rs.40,000\/e, per<\/p>\n
month cannot be stated to be on higher side\ufb01pi<\/p>\n
Further, we see that when a petition filed fore ‘<\/p>\n
compensation under 1633; f”awardingl\ufb01:Qff<\/p>\n
Rs.40,000\/– under conventional\ufb01 headsf is Lon
\nhigher side. As per Sqm%\u00a2&;e\u00a2IiLa\u00a7\ufb01%\u00a5%a sum
\nof Rs.4,5o0\/– shag; ibgi \u00e9\ufb01afded by the
