DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 07\/10\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tRULE.\n<\/p>\n<p>Learned APP Mr.M.G.Nanavati waives service of notice of Rule for the<br \/>\nrespondent &#8211; State.\n<\/p>\n<p>2.\tThis<br \/>\nsuccessive bail application is filed under Section 439 of the Code of<br \/>\nCriminal Procedure in connection with the First Information Report<br \/>\nregistered as C.R. No. I-47\/2011, registered with Devgadh Baria<br \/>\nPolice Station for the offences punishable under Sections-395, 396,<br \/>\n397 of the Indian Penal Code.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned Counsels for the parties and perused the record.\n<\/p>\n<p>4.\tIt<br \/>\nis submitted that, now charge-sheet has been filed and there is no<br \/>\nidentification, subject to availability of accused for trial, I am<br \/>\ninclined to enlarge the applicant on bail, by imposing suitable<br \/>\nconditions.\n<\/p>\n<p>5.\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be released on bail in connection<br \/>\nwith C.R.\n<\/p>\n<p>No. I-47\/2011, registered with Devgadh Baria Police Station<br \/>\non executing a bond of Rs.5,000\/- (Rupees Five Thousand only) with<br \/>\none surety of the like amount to the satisfaction of the trial Court<br \/>\nand subject to the conditions that he shall;\n<\/p>\n<p>\t(a)\tnot<br \/>\ntake undue advantage of liberty or \tmisuse liberty;\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tsurrender<br \/>\npassport, if any, to the lower court within a week;\n<\/p>\n<p>(d)\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>(e)\tmark<br \/>\npresence at the concerned police station on the first Sunday of every<br \/>\nmonth between 10.00 a.m. and 3.00 p.m., till the trial commences;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt, at the time of execution of the bond, and shall not change the<br \/>\nsame without prior permission of this Court;\n<\/p>\n<p>7.\tThe<br \/>\nAuthorities will release the applicant only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>8.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>9.\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>10.\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>11.\tRule<br \/>\nis made absolute to the aforesaid extent.
