      The writ petition is filed seeking mainly the following<\/p>\n
relief:\n<\/p>\n<\/p>\n
            i.    to   call   for  the    records   in\n            I.A.No.2751\/2008 in O.S.No.353\/2008\n            of   the   Munsiff's    Court,    Kannur,\n            affirmed     by      the     Order      in\n            C.M.A.No.34\/2008 of the Principal\n            Subordinate Court, Thalassery and set\n            aside Ext.P6 order of the Musniff of\n            Kannur     in    I.A.No.2751\/2008       in\n            O.S.No.353\/2008 dated 21.8.2008 and\n            Ext.P7    order     of    the    Principal\n            Subordinate     Court,    Thalassery    in\n            C.M.A.NO.34\/2008 dated 27.7.2009 in\n            the interests of justice.\n\n\n\n\n<\/pre>\n
      2. Petitioner is the defendant in O.S.No.353 of 2008 on<\/p>\n
the file of the Munsiff Court, Kannur. Suit is one for a decree<\/p>\n
WPC.25944\/09                   2<\/span><\/p>\n
of perpetual prohibitory injunction, and the respondent is the<\/p>\n
plaintiff. Petitioner is admittedly the tenant of the building<\/p>\n
owned by the respondent.       Previously, the petitioner had<\/p>\n
instituted a suit against another, who was granted permission<\/p>\n
to occupy the tenanted premises for carrying out the business,<\/p>\n
on his refusal to vacate the premises on termination of the<\/p>\n
licence. That suit was fraught up to a second appeal before<\/p>\n
this Court, in which, a decree of eviction was granted in<\/p>\n
favour of the petitioner. Pursuant thereto, the building was<\/p>\n
got delivered over from the judgment debtor in that suit<\/p>\n
through court to the petitioner.    Thereafter, the petitioner<\/p>\n
made some attempts to carry out maintenance and repairs to<\/p>\n
the tenanted premises, and at that stage, the respondent<\/p>\n
landlord filed the above suit seeking for a decree of perpetual<\/p>\n
prohibitory injunction to restrain the petitioner from carrying<\/p>\n
out the repairs and maintenance. An application for interim<\/p>\n
injunction moved by the respondent for an identical relief till<\/p>\n
the disposal of the suit was not granted by the learned<\/p>\n
Munsiff. Challenge raised against that order by the petitioner<\/p>\n
preferring an appeal was also unsuccessful. Impeaching the<\/p>\n

propriety and correctness of the judgment passed in the<\/p>\n
C.M.Appeal preferred against the order of the learned<\/p>\n
Munsiff, petitioner has filed this writ petition invoking the<\/p>\n
supervisory jurisdiction vested with this Court under Article<\/p>\n
227 of the Constitution of India.\n<\/p>\n<\/p>\n
      3. I heard the learned counsel for the petitioner. Having<\/p>\n
regard to the submissions made and taking note of the facts<\/p>\n
and circumstances presented with reference to the order<\/p>\n
passed by the learned Munsiff and the judgment rendered by<\/p>\n
the learned Sub Judge, I find no notice to the respondent is<\/p>\n
necessary, and, hence, it is dispensed with. The courts below<\/p>\n
have concurrently found that the respondent\/plaintiff is not<\/p>\n
entitled to the discretionary relief of injunction applied for.<\/p>\n
After going through the order of the learned Munsiff and also<\/p>\n
the judgment rendered by the learned Sub Judge, I find the<\/p>\n
order\/judgment does not suffer from any jurisdictional<\/p>\n
infirmity warranting interference invoking the visitorial<\/p>\n
jurisdiction vested with this Court. The learned counsel for<\/p>\n
the petitioner submitted that no material alteration was<\/p>\n

intended to be carried out by the petitioner\/defendant, but,<\/p>\n
she desired to carry out some minor repairs since the building<\/p>\n
was delivered over from her licencee in occupation in a<\/p>\n
deplorable condition. In the building, it is submitted, hotel<\/p>\n
business was carried out.      To make it fit and proper for<\/p>\n
running the business, according to the learned counsel for the<\/p>\n
petitioner, it is absolutely essential to carry out some minor<\/p>\n
repairs. Needless to point out, as a tenant, petitioner may be<\/p>\n
entitled to carry out minor repairs and maintenance, but, in<\/p>\n
the given facts of the case where the court has passed an<\/p>\n
order, after hearing both sides, restraining the petitioner<\/p>\n
tenant from carrying out any repairs and maintenance in the<\/p>\n
building, it may not be possible for this Court to issue any<\/p>\n
direction permitting the petitioner to carry out minor repairs<\/p>\n
in the building. However, I make it clear that irrespective of<\/p>\n
the order passed by the learned Munsiff, which was upheld by<\/p>\n
the learned Sub Judge, it is open to the petitioner to seek<\/p>\n
permission from the trial court for carrying out minor repairs<\/p>\n
in the building without in any way causing material alteration,<\/p>\n
and that too, under the supervision of an Advocate<\/p>\n

Commissioner appointed by the court and also at her expense.<\/p>\n
I am not expressing any opinion on the merit of the<\/p>\n
application, if so moved.   It is for the learned Munsiff to<\/p>\n
consider such application, if so moved, after hearing the<\/p>\n
respondent as well. Reserving the right of the petitioner to<\/p>\n
move such an application and leaving it to the discretion of the<\/p>\n
learned Munsiff to pass appropriate orders in accordance with<\/p>\n
law, after hearing the respondent, the writ petition is closed.<\/p>\n
