Lodha, J.\n<\/p>\n<\/p>\n<p>           Leave granted.\n<\/p>\n<\/p>\n<p>2.         The controversy in this appeal by special leave<\/p>\n<p>relates to the appointment of Lambardar for village Pehladgarh,<\/p>\n<p>Tehsil and District Bhiwani. The said post fell vacant due to the<\/p>\n<p>death of the then Lambardar on August 1, 2000. Four persons<\/p>\n<p>applied for that post but later on two candidates withdrew their<\/p>\n<p>candidature and the present Appellant and Respondent No. 1<\/p>\n<p>remained for selection.   The Collector, Bhiwani by his order<br \/>\ndated December 15, 2005 considered the candidature of these<\/p>\n<p>two candidates and issued an order of appointment in favour of<\/p>\n<p>Respondent No. 1 as Lambardar of village Pehladgarh. In the<\/p>\n<p>opinion of the Collector, Bhiwani, Satbir Singh, Respondent No.<\/p>\n<p>1, was more suitable. This is how the Collector, District Bhiwani<\/p>\n<p>considered comparative merits of these two candidates :<\/p>\n<blockquote><p>     &#8220;&#8230;&#8230;&#8230;.I have come to conclusion that Satbir Singh<br \/>\n     candidate is a suitable candidate. He is Matric pass and has<br \/>\n     passed the B.A. from Military. He has 7 acres of land which<br \/>\n     is sufficient for filing taxes. Satbir Singh candidate is younger<br \/>\n     in age than the other candidate and being healthy and<br \/>\n     active, he is capable to perform the job of Lambardari<br \/>\n     effectively. Shri Ishwar Singh candidate has cut the green,<br \/>\n     neem tree from the panchayat land and the allegation was<br \/>\n     leveled upon his brother Sudesh for cutting neem tree as his<br \/>\n     family members namely Sube Singh as the Sarpanch. It is<br \/>\n     thus clear that Ishwar Singh candidate is not person of a<br \/>\n     clean antecedents. Therefore on the basis of the above<br \/>\n     mentioned facts Shri Satbir Singh son of Shri Ram Jiwan is<br \/>\n     appointed as Lambardar of village at the place of Siri Chand<br \/>\n     deceased Lambardar of village Pehladgarh&#8221;\n<\/p><\/blockquote>\n<p>3.   The present appellant assailed the aforesaid order of the<\/p>\n<p>Collector, District Bhiwani by filing an appeal before the<\/p>\n<p>Commissioner, Hissar Division. The Commissioner, Hissar<\/p>\n<p>Division did not agree with the view of the Collector, Bhiwani in<\/p>\n<p>respect of suitability of the present Respondent No. 1. The<\/p>\n<p>Commissioner, Bhiwani held :\n<\/p>\n<p><span class=\"hidden_text\">                                                                         2<\/span><br \/>\n              &#8220;&#8230;&#8230;&#8230;.From the perusal of the record, it is found that<br \/>\n      the appellant has more land than the respondent and he is<br \/>\n      B.A. pass and retire from the Military service as Honorary<br \/>\n      Captain, whereas the respondent is Matriculate and retire as<br \/>\n      Havaldar. The appellant remained Sarbrah Lamberdar of his<br \/>\n      father for many years and he has the experience of<br \/>\n      Lambardar. No document was produced on the file which<br \/>\n      can prove the illegal possession of the appellant. The<br \/>\n      allegation against the appellant for cutting the green neem<br \/>\n      tree from the panchayat land is also not proved whereas the<br \/>\n      Collector did not accept. The appellant having the good<br \/>\n      antecedents on this basis, which is not legally justified.<br \/>\n      Besides this, Tehsildar Bhiwani and S.D.O.(civil), Bhiwani<br \/>\n      have also recommended the name of the appellant for his<br \/>\n      appointment. Though the Collector is the appointing<br \/>\n      authority of the post and his order should not be interfered in<br \/>\n      general conditions but I do not find that the order of<br \/>\n      Collector, Bhiwani is not justified on the grounds mentioned<br \/>\n      above and I hereby set aside on this ground and appoint<br \/>\n      appellant-Shri Ishwar Singh as Lambardar of village<br \/>\n      Pehladgarh.&#8221;\n<\/p>\n<\/p>\n<p>4.           The Respondent No. 1 challenged the order of the<\/p>\n<p>Commissioner, Hissar Division by filing a Revision Petition<\/p>\n<p>before the Financial Commissioner, Government of Haryana.<\/p>\n<p>The Financial Commissioner in his order dated January 18,<\/p>\n<p>2008, after hearing the parties, found no reason to interfere with<\/p>\n<p>the order of the Commissioner, Hissar Division. In the opinion of<\/p>\n<p>the Financial Commissioner, Government of Haryana, the order<\/p>\n<p>of the Collector was perverse and illegal and, therefore, rightly<\/p>\n<p>set aside by Commissioner, Hissar Division. The Financial<\/p>\n<p>Commissioner considered the matter thus :<\/p>\n<p><span class=\"hidden_text\">                                                                            3<\/span><br \/>\n              &#8220;It is well settled law that the order of Collector should<br \/>\n      not be interfered with unless there is perversity or illegality<br \/>\n      therein. I am also of the opinion that mere allegation of<br \/>\n      cutting of tree-which was not substantiate subsequently<br \/>\n      should not have been the basis of Collector&#8217;s conclusion that<br \/>\n      the respondent did not possess a good image. This clearly<br \/>\n      shows that the Collector has not applied his mind judiciously<br \/>\n      and his order is perverse and illegal and, therefore, rightly<br \/>\n      set aside by the Commissioner.\n<\/p>\n<p>              Further, what clinches the issue in favour of<br \/>\n      respondent is his active participation in social service by<br \/>\n      donating blood twice and organizing a Blood Donation Camp<br \/>\n      and also motivating cases for Family Planning. All other<br \/>\n      qualifications being almost similar, age factor only cannot<br \/>\n      weigh in favour of petitioner because he has not rendered<br \/>\n      the kind of social service and assistance in Government<br \/>\n      sponsored programmers as has been done by the<br \/>\n      respondent. In view of this, I am of the opinion that the order<br \/>\n      of the Collector was rightly set aside by the Commissioner<br \/>\n      and the respondent was a better candidate to discharge the<br \/>\n      functions of a Lambardar.&#8221;\n<\/p>\n<\/p>\n<p>5.           The order passed by the Financial Commissioner<\/p>\n<p>was challenged by the Respondent No. 1 in the writ petition<\/p>\n<p>before the High Court of Punjab and Haryana. The High Court<\/p>\n<p>upturned the orders of the Financial Commissioner as well as<\/p>\n<p>Commissioner, Hissar Division and restored the order of the<\/p>\n<p>Collector, District Bhiwani. The High Court held thus :<\/p>\n<p><span class=\"hidden_text\">                                                                           4<\/span><br \/>\n                  &#8220;The Commissioner and Financial Commissioner<br \/>\n          have reversed the order of the Collector only on the ground<br \/>\n          that respondent No. 4 has more land and passed BA and<br \/>\n          was retired from Military Service as Honorary Capt., whereas<br \/>\n          petitioner is Matriculate and retired as Havaldar. The<br \/>\n          Collector has given a specific finding that petitioner is<br \/>\n          Matriculate and B.A. from Military and is younger in age and<br \/>\n          possesses more land in comparison to respondent No. 4.<br \/>\n          Moreover, contribution of the petitioner in social activities is<br \/>\n          much more than respondent No. 4 as petitioner has<br \/>\n          deposited Rs. 1.30 lacs with Small Saving Scheme and is a<br \/>\n          Member of Red Cross Society and has also constructed a<br \/>\n          room in village school. In addition also, the petitioner seems<br \/>\n          to be more active and energetic and as such he has rightly<br \/>\n          been appointed by the Collector being more meritorious.\n<\/p>\n<p>                  It is a settled law that choice of the Collector should<br \/>\n          not be interfered with unless the same is perverse or<br \/>\n          violative of any rule or procedure. Moreover, there is nothing<br \/>\n          in the orders passed by the Commissioner as well as<br \/>\n          Financial Commissioner that choice of the Collector is<br \/>\n          perverse, violative or against any rules or procedure.&#8221;<\/p>\n<p>6.                The Lambardar is a village headman. His main job<\/p>\n<p>is the collection of revenue. He is paid fixed remuneration as<\/p>\n<p>well as some commission. The criterion for appointment to the<\/p>\n<p>post of Lambardar, inter-alia, includes educational qualification,<\/p>\n<p>age, experience in working of Lambardari, land and property,<\/p>\n<p>character, ability and freedom from indebtedness.<\/p>\n<p>7.                <a href=\"\/doc\/1412737\/\">In Mahavir Singh v. Khiali Ram and Others1<\/a> this<\/p>\n<p>Court was              concerned with the controversy relating to<\/p>\n<p>appointment of Lambardar under Punjab Land Revenue Act,<\/p>\n<p>1887 and rules framed thereunder. The court held that with<br \/>\n<span class=\"hidden_text\">1<\/span><br \/>\n    (2009) 3 SCC 439<\/p>\n<p><span class=\"hidden_text\">                                                                             5<\/span><br \/>\nregard to the appointment of a Lambardar in the State of<\/p>\n<p>Punjab, age of a candidate is a relevant factor. This court<\/p>\n<p>noticed few old cases of Lahore High Court which throw some<\/p>\n<p>light on the subject thus :\n<\/p>\n<\/p>\n<blockquote><p>      &#8220;15. In Lt. Malik Abbas Khan v. Ghulam Haidar (1940 Lah<br \/>\n      LT 25) it was stated:\n<\/p><\/blockquote>\n<blockquote><p>      &#8220;&#8230; It is certainly not wise, save in very exceptional<br \/>\n      circumstances, to appoint for the first time, an Inamkhor or<br \/>\n      Zaildar whose age is 60 or more.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>      16. In Kalyan Singh v. Haidar (1928 Lah LT 33) the Financial<br \/>\n      Commissioner held that ordinarily the Collector&#8217;s choice<br \/>\n      appointing a Zaildar or Sufedpost should not be interfered<br \/>\n      with even though the appellate authority believes that his<br \/>\n      choice was not the best choice.\n<\/p><\/blockquote>\n<blockquote><p>      17. Similar view was expressed in Lila Ram v. Asa Ram<br \/>\n      (1955 Lah LT 29) in the following terms:\n<\/p><\/blockquote>\n<blockquote><p>      &#8220;2. &#8230; While it is now an established principle that there<br \/>\n      should be no interference with the choice made by the<br \/>\n      Collector, it does not follow that where the Collector&#8217;s order<br \/>\n      is based on a misrepresentation of facts, there should still be<br \/>\n      no interference.&#8221;\n<\/p><\/blockquote>\n<p>8.           We heard the learned counsel for the petitioner and<\/p>\n<p>the learned Senior Counsel for Respondent No. 1 and their<\/p>\n<p>respective contentions. The High Court in the impugned order<\/p>\n<p>observed that there was nothing in the orders passed by the<\/p>\n<p>Commissioner as well as Financial Commissioner that the<\/p>\n<p>choice of the Collector is perverse, violative or against in rules<\/p>\n<p>or procedure. This is apparently founded on erroneous premise.<\/p>\n<p><span class=\"hidden_text\">                                                                        6<\/span><br \/>\nThe Financial Commissioner has categorically held that the<\/p>\n<p>Collector did not apply his mind judiciously and his order is<\/p>\n<p>perverse and illegal. The High Court seems to have overlooked<\/p>\n<p>the aforesaid observation. Whether Financial Commissioner<\/p>\n<p>was justified in his observation or not is altogether a different<\/p>\n<p>matter. We even do not suggest for a moment that within<\/p>\n<p>permissible limits of judicial review, the orders of the Financial<\/p>\n<p>Commissioner and Commissioner could not have been<\/p>\n<p>interfered with, but then the High Court must have given cogent<\/p>\n<p>and convincing reasons for such interference. We find that the<\/p>\n<p>impugned order lacks in that. As the matter needs to be re-<\/p>\n<p>examined by the High Court afresh, we refrain from dealing with<\/p>\n<p>the matter further and leave the parties to agitate their<\/p>\n<p>contentions before the High Court.\n<\/p>\n<\/p>\n<p>9.          Appeal is, accordingly, allowed and the judgment<\/p>\n<p>dated April 11, 2008 passed by the High Court is set aside. Writ<\/p>\n<p>Petition (Civil) No. 1672 of 2008 is restored to the file of the<\/p>\n<p>High Court for fresh consideration and decision. Needless to<\/p>\n<p>say that the contentions of the parties are kept open to be<\/p>\n<p>agitated before the High Court which obviously would be<\/p>\n<p><span class=\"hidden_text\">                                                              7<\/span><br \/>\ndecided on their own merits. We request the High Court to<\/p>\n<p>decide the aforesaid writ petition as expeditiously as may be<\/p>\n<p>possible.
