No. 4488 of 2008<\/p>\n<p>            In this revision petition under Article 227 of the Constitution<\/p>\n<p>of India by the plaintiff-petitioners, the challenge is to the order dated<\/p>\n<p>21.8.2009 passed by the trial court whereby the application filed by<\/p>\n<p>them under Order 18 Rule 17 of the Code of Civil Procedure (in short<\/p>\n<p>&#8220;the Code&#8221;) for recalling the office Kanungo to produce the complete<\/p>\n<p>record (excerpts) of the suit land, was dismissed.<\/p>\n<p>            The trial court after examining the evidence came to the<\/p>\n<p>conclusion that the plaintiffs had not specifically mentioned in the<br \/>\n<span class=\"hidden_text\"> CR No. 4488 of 2008                                        -2-<\/span><\/p>\n<p>application as to which of the documents were to be produced by the<\/p>\n<p>office Kanungo. The observations recorded by the trial court in para 8<\/p>\n<p>of its order read thus:-\n<\/p>\n<blockquote><p>                    &#8220;8.     First of all, the applicant-plaintiffs have not<\/p>\n<p>                    specifically mentioned in the application, which<\/p>\n<p>                    documents are to be produced by the office<\/p>\n<p>                    Kanungo.     The provision of order 18 rule 17 CPC<\/p>\n<p>                    relating to recalling of witness for further cross-<\/p>\n<p>                    examination, is merely an enabling provision for<\/p>\n<p>                    convenience of Court. It does not permit a party to<\/p>\n<p>                    re-examine any witness of fill the lacuna in the case.<\/p>\n<p>                    When the said office Kanungo appeared before the<\/p>\n<p>                    Court, the counsel for the applicant-plaintiff was very<\/p>\n<p>                    much there to examine him in applicant-plaintiffs&#8217;<\/p>\n<p>                    evidence but this fact has not been pointed out by<\/p>\n<p>                    him at that time.     Therefore, now, he cannot be<\/p>\n<p>                    allowed to take shelters under order 18 rule 17 CPC.<\/p>\n<p>                    The present case is the only oldest case of the year<\/p>\n<p>                    2000.    The parties have already taken more than<\/p>\n<p>                    sufficient opportunities to conclude their evidence.<\/p>\n<p>                    Thus, at the fag end of the trial, the applicant-<\/p>\n<p>                    plaintiffs cannot be allowed to re-open the trial to fill<\/p>\n<p>                    up the lacuna in their case. Reliance on this point<\/p>\n<p>                    can be placed on the authority of Hon&#8217;ble Punjab and<\/p>\n<p>                    Haryana High Court in case titled as Smt. Surinder<\/p>\n<p>                    Kaur Vs. Karanbir Singh and another, AIR 2004<br \/>\n<span class=\"hidden_text\"> CR No. 4488 of 2008                                        -3-<\/span><\/p>\n<p>                   Punjab and Haryana 377.&#8221;<\/p>\n<blockquote><p>             Further, Order 18 Rule 17 of the Code reads thus:-<\/p>\n<\/blockquote>\n<blockquote><p>                   &#8220;17. Court may recall and examine witness.- The<\/p>\n<p>                   Court may at any stage of a suit recall any witness<\/p>\n<p>                   who has been examined and may subject to the law<\/p>\n<p>                   of evidence for the time being in force put such<\/p>\n<p>                   questions to him as the Court thinks fit.&#8221;<\/p>\n<\/blockquote>\n<\/blockquote>\n<blockquote><p>             From the plain reading of the provisions contained in Order<\/p>\n<p>18 Rule 17 of the Code also, it is clear that the application filed by the<\/p>\n<p>petitioners was not maintainable as it is the discretion of the court to<\/p>\n<p>recall any witness who has been examined and subject to the law of<\/p>\n<p>evidence may put such questions to him as it thinks fit.<\/p><\/blockquote>\n<p>             In view of the above, this Court is satisfied that there is no<\/p>\n<p>illegality or perversity in the order dated 21.8.2009 passed by the trial<\/p>\n<p>court which may warrant interference by this Court in exercise of its<\/p>\n<p>jurisdiction under Article 227 of the Constitution of India.<\/p>\n<p>             Dismissed.\n<\/p>\n<\/p>\n<pre>September 22, 2009                               (AJAY KUMAR MITTAL)\ngbs                                                     JUDGE\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Mrs. Bhullan @ Nimbo And Another vs Ranpat And Others on 22 September, 2009 CR No. 4488 of 2008 -1- IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH C.M.
