RAMASWAMY, K.S. PARIPOORNAM.\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.  We have  heard learned  counsel on both<br \/>\nsides.\n<\/p>\n<p>     This appeal  by special  leave arises from the Judgment<br \/>\nof  the\t  High\tCourt  of  Orissa,  made  on  13.9.1993.  in<br \/>\nMiscellaneous Appeal No. 384\/90.\n<\/p>\n<p>     Ballav Kumar Sethi, a young man of 24 years was fatally<br \/>\nknocked down by oil Tanker bearing registration No. TCV 667.<br \/>\nThe appellant claimed a sum of Rs.1 lakh towards the loss of<br \/>\nthe estate  of the deceased and the support to the appellant<br \/>\nas dependent  of the deceased. the claim under section 110-A<br \/>\nof the Motor Vehicle Act, 1939 was laid on April 30, 1983.\n<\/p>\n<p>     The Tribunal  delivered the  judgment awarding a sum of<br \/>\nRs. 1,00,000\/-\tto the\tappellant which\t was confirmed under<br \/>\nappeal by the High Court enhancing the same by a further sum<br \/>\nof Rs. 18,000\\-.\n<\/p>\n<p>     The principle  of determination  of the compensation in<br \/>\nthe case  of fatal  accident was determined by this Court in<br \/>\n<a href=\"\/doc\/1554972\/\">U.P. State  Road Transport  Corporation &amp;  Ors.\t vs.  Trilok<br \/>\nChandra &amp;  ors.<\/a>\t  [(19960 4    SCC  362].    This  court  in<br \/>\nParagraph 18 , after considering the tabulations, found that<br \/>\nthe maximum multiplier of purchaser was as under:\n<\/p>\n<blockquote><p>     &#8220;What   we propose\t to emphasise is<br \/>\n     that the  multiplier cannot  exceed<br \/>\n     18 years&#8217;\tPurchase factor. This is<br \/>\n     the improvement  over  the\t earlier<br \/>\n     position that ordinarily, it should<br \/>\n     not  exceed   16.\tWe   thought  it<br \/>\n     necessary\tto   state  the\t correct<br \/>\n     legal  position\t as  courts  and<br \/>\n     tribunals\t  are\t using\t  higher<br \/>\n     multiplier as  in the  present case<br \/>\n     where   the   Tribunal   used   the<br \/>\n     multiplier of  24\twhich  the  High<br \/>\n     Court raised to 34, thereby showing<br \/>\n     lack of awareness of the background<br \/>\n     of the  multiplier system in Davies<br \/>\n     case.&#8221;<\/p><\/blockquote>\n<p>     Thus, we have to conclude that the annual income of the<br \/>\ndeceased  is  Rs.12,000\/-  p.a.\t and  he  would\t have  spent<br \/>\nRs.7,500\/- towards  family  members  and  1\/3  for  himself;<br \/>\nthereby the  annual income  is taken  at Rs.9,000\/- per year<br \/>\nand multiplier\tof 18 years which is the maximum in the case<br \/>\nof the young person dying in an accident, has to be applied.<br \/>\nThe  claimants\t would\tget   Rs.  1.40\t lakhs\ttowards\t the<br \/>\ncompensation.\tSince the claim is limited to Rs 1 lakh, the<br \/>\nclaimants  are entitled to get Rs. 1 lakh, the claimants are<br \/>\nentitled to  Rs.1 lakh,\t the claimants\tare entitled  to get<br \/>\nRs.1 lakh  as compensation with interest at 6% p.a. from the<br \/>\ndate of the judgment of the High court.\n<\/p>\n<p>     The appeal is accordingly allowed.\t No. costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Adikanda Sethi (Dead) Through L &#8230; vs Palani Swami Saran Transports &amp; &#8230; on 8 May, 1997 Bench: K.
