These  appeals are filed under Section 379 of the\tCode<br \/>\nof Criminal Procedure.\tThese five appellants along with two<br \/>\nothers\twere  tried for offenses punishable  under  Sections<br \/>\n395, 396, 397 and 449 of the Indian Penal Code.\t Two of them<br \/>\nwere tried under Section 25 read with Section 27 of the Arms<br \/>\nAct.   Mithlesh\t was  tried for\t offenses  punishable  under<br \/>\nSections 216 and 412 IPC.  The trial court acquitted all  of<br \/>\nthem.\tThe State preferred an appeal.\tDuring the  pendency<br \/>\nof  the appeal the two accused Devi Singh and Kishore  Singh<br \/>\ndied and the appeal against them stood abated.\n<\/p>\n<p>2.   The High Court, however, relying on the evidence of the<br \/>\neyewitnesses  who participated in the identification  parade<br \/>\nand  the recovery effected allowed the appeal and set  aside<br \/>\nthe  acquittal\tand convicted Mansingh,\t Rati  Ram,  Narayan<br \/>\nSingh and Shiv Ratan under Sections 395\/397, 396 and 449 IPC<br \/>\nand sentenced each of them to undergo rigorous\timprisonment<br \/>\nfor  ten  years\t under each count.   Rati  Ram\twas  further<br \/>\nconvicted under Section 25 read with Section 27 of the\tArms<br \/>\nAct   and  sentenced  to  undergo  three   years&#8217;   rigorous<br \/>\nimprisonment.  Mithlesh was convicted under Section 412\t IPC<br \/>\nand sentenced to undergo five years&#8217; rigorous  imprisonment.<br \/>\nHis  acquittal\tunder Section 216 was  affirmed.   Sentences<br \/>\nwere directed to run concurrently.\n<\/p>\n<p>3.   Aggrieved\tby the said judgment of the High  Court\t the<br \/>\nconvicted  accused  have preferred these two  appeals.\t The<br \/>\nprosecution case is as follows.\n<\/p>\n<p>4.   On\t the  night of November 11, 1978 at  about  11\tp.m.<br \/>\nthere  was a dacoity with murder in the house  of  Premchand<br \/>\n(PW 22) in village Hardi, within the<br \/>\n<span class=\"hidden_text\">64<\/span><br \/>\nlimits\tof Gadhakota police station, District Sagar.  It  is<br \/>\nalleged\t that the dacoits removed gold and silver  ornaments<br \/>\nand  cash of Rs 500, total valued at Rs 22,465\tby  breaking<br \/>\nopen  the box and the safe.  On the ground  floor,  Nathuram<br \/>\nand  Jagrani parents of the complainant, were  sleeping\t and<br \/>\nthey   were   first   assaulted.   On\tthe   first   floor,<br \/>\ncomplainant&#8217;s  sister-in-law  Rajrani  was  killed  with   a<br \/>\nKatarna.   The complainant saw the incident from the  second<br \/>\nfloor.\t Dacoits  were\tunknown\t to  the  witnesses.   After<br \/>\ncommitting   the  looting  the\tdacoits\t left\tthe   place.<br \/>\nPremchand went and lodged a report (Ex.\t P-42) in the police<br \/>\nstation.  The injured Nathuram and Jagrani were admitted  in<br \/>\nthe hospital.  Rajrani also received injuries and she  died.<br \/>\nIn postmortem examination it was found that she died because<br \/>\nof the incised wound cutting maxilla bone.  Nathuram had  13<br \/>\ninjuries   including   fracture\t of  right   forearm.\t The<br \/>\nprosecution  examined  PWs 17 and 18  who  received  pellet-<br \/>\ninjuries  and  Jagrani who received one\t lathi\tinjury.\t  On<br \/>\nreceipt\t of the information PW 23, PSI reached the scene  of<br \/>\nthe  occurrence and prepared a Panchnama and  effected\tsome<br \/>\nrecoveries.  He took into custody Mansingh in village  Sewda<br \/>\nand the other accused were also arrested on different  dates<br \/>\nafter  the expiry of three months and some  more  recoveries<br \/>\nwere  effected.\t  A Panchnama was drawn in  respect  of\t the<br \/>\nrecoveries  and\t the recovered articles were  identified  as<br \/>\nthose belonging to the complainant.\n<\/p>\n<p>5.   An\t identification parade was held on two dates  namely<br \/>\nMarch 16, 1979 and March 30, 1979.  The accused were said to<br \/>\nhave been identified by the eyewitnesses.  On April 4,\t1979<br \/>\nanother\t identification\t parade was held in respect  of\t the<br \/>\narticles   recovered  and  they\t were  said  to\t have\tbeen<br \/>\nidentified  by PWs 2, 17 and 22.  The trial court  acquitted<br \/>\nthe  accused holding that identification of the\t persons  as<br \/>\nwell as of the articles was doubtful.\n<\/p>\n<p>6.   In\t the appeal the High Court examined the\t proceedings<br \/>\nof  the identification parades and accepted the\t same.\t The<br \/>\nHigh Court also accepted the prosecution case regarding\t the<br \/>\nrecovery  of the stolen articles and  accordingly  convicted<br \/>\nthe accused as stated above.\n<\/p>\n<p>7.   In these appeals Shri Ranjit Kumar, learned counsel for<br \/>\nthe  appellants submits that the dacoity took  place  during<br \/>\nnight-time and the assailants were totally strangers to\t the<br \/>\nvictims and they were arrested after a lapse of three months<br \/>\nand  identification  was  held\tagain  22  days\t thereafter.<br \/>\nTherefore,   the  identification  of  the  accused  by\t the<br \/>\neyewitnesses cannot be relied upon.  In this regard he\talso<br \/>\nsubmits\t that  the reasons given by the\t trial\tcourt  while<br \/>\nrejecting  the evidence regarding the identification of\t the<br \/>\neyewitnesses  as  well as the recovered articles  are  quite<br \/>\nsound  and the High Court erred in reversing the  same.\t  We<br \/>\nhave examined the proceedings and also the evidence given by<br \/>\nthe respective eyewitnesses.  The dacoity is not in dispute.<br \/>\nThough Mithlesh belonged to the same village but none of the<br \/>\neyewitnesses stated that he was present during the  dacoity.<br \/>\nTherefore, he was not put up for identification parade.\t The<br \/>\ndacoits\t were  strangers  to  the  eyewitnesses.   Then\t the<br \/>\nquestion arose whether there was sufficient opportunity\t for<br \/>\nthese witnesses to recognise the accused.  It is noted\tthat<br \/>\nnone of their features (sic was) even suggestively mentioned<br \/>\nin  the FIR not even in the case-diary as noted by the\tHigh<br \/>\nCourt.\tIt is also to be noted that none of the eyewitnesses<br \/>\nsaid that they recognised the dacoits while they were inside<br \/>\nthe  house and on the other hand it becomes highly  doubtful<br \/>\nwhether they could not have identified the strangers in\t the<br \/>\nmoonlight.  Taking all these aspects into consideration\t the<br \/>\ntrial court was not<br \/>\n<span class=\"hidden_text\">65<\/span><br \/>\nprepared to accept the evidence regarding the identification<br \/>\nparade\tof the persons.\t We think this is a reasonable\tview<br \/>\nin   the  matter.   Therefore,\tthe  participation  of\t the<br \/>\nappellants in the actual dacoity becomes doubtful.\n<\/p>\n<p>8.   However, the recoveries are duly effected and the\tSub-<br \/>\nInspector  as  well as the witnesses spoke about  the  same.<br \/>\nMerely\tbecause certain stolen articles were recovered\tfrom<br \/>\nthe  accused they cannot be held to be dacoits\tby  invoking<br \/>\nthe  presumption  unless there is a recent  possession.\t  In<br \/>\nthis  case admittedly, there is a lapse of nearly  three  or<br \/>\nfour  months.  In these circumstances, we think it would  be<br \/>\nsafe  particularly  when they were acquitted  by  the  trial<br \/>\ncourt  to  convict  them only for the offence  of  being  in<br \/>\npossession of the stolen property.\n<\/p>\n<p>9.   A\tserious dacoity took place and must be known to\t all<br \/>\nthe  people  in the village as well as\tin  the\t surrounding<br \/>\nplaces.\t  The accused who were found to be in possession  of<br \/>\nthe  stolen  property  which is the  subject-matter  of\t the<br \/>\ndacoity would be held liable under Section 412 IPC.  In\t the<br \/>\nresult\tthe convictions of Narayan Singh and Shiv  Ratan  in<br \/>\nCrl.   A. No. 573 of 1983 under Sections 395\/397,  396,\t 449<br \/>\nIPC,  and the sentence of ten years&#8217;  rigorous\timprisonment<br \/>\nunder each count are set aside.\t Instead they are  convicted<br \/>\nunder Section 412 IPC and each of them is sentenced to three<br \/>\nyears&#8217; rigorous imprisonment.  With regard to the appellants<br \/>\nMansingh  and  Rati Ram in Criminal Appeal No. 623  of\t1984<br \/>\ntheir  convictions under Sections 395\/397, 396 and  449\t IPC<br \/>\nand the sentence of ten years&#8217; rigorous imprisonment awarded<br \/>\nunder each count are set aside.\t Instead they are  convicted<br \/>\nunder Section 412 IPC and each of them is sentenced to three<br \/>\nyears&#8217;\trigorous imprisonment.\tThe conviction of  Rati\t Ram<br \/>\nunder  Section 25 read with Section 27 of the Arms  Act\t and<br \/>\nthe   sentence\tawarded\t thereunder  are   confirmed.\t The<br \/>\nconviction of Mithlesh one of the appellants in Crl.  A. No.<br \/>\n573  of\t 1993  under Section 412 IPC is\t confirmed  and\t the<br \/>\nsentence  is reduced to three years&#8217; rigorous  imprisonment.<br \/>\nHis acquittal under Section 216 IPC is confirmed.  Sentences<br \/>\nare directed to run concurrently.\n<\/p>\n<p>10.
