JUSTICE J.B PARDIWALA)<\/p>\n<p>\tThis<br \/>\nappeal arises from judgment and order passed by learned Single Judge<br \/>\ndated 19.10.2010 in SCA No. 13796 of 2010, whereby learned Single<br \/>\nJudge refused to grant any relief to the appellants &#8211; original<br \/>\nrespondents and disposed of SCA No. 13796 of 2010 by making certain<br \/>\nobservations and clarifications and confirmed order dated 1.10.2010<br \/>\npassed by the learned Civil Judge below Ex.17 in Special Civil Suit<br \/>\nNo. 90 of 2010.\n<\/p>\n<p>2.\tIt<br \/>\nappears that the respondent herein &#8211; original plaintiff of Special<br \/>\nCivil Suit No. 90 of 2010 challenged the order dated 1.10.2010 passed<br \/>\nby Additional Senior Civil Judge, Morbi below Exh.17 in Special Civil<br \/>\nSuit No. 90 of 2010, whereby the learned Civil Judge directed that a<br \/>\npanchnama of the disputed property be drawn.  It also appears that<br \/>\nbefore SCA No. 13796 of 2010 could be preferred, panchnama was<br \/>\nalready drawn by the Court Commissioner appointed for the purpose of<br \/>\ndrawing the panchnama and therefore, learned Single Judge disposed of<br \/>\nthe petition by observing that the Civil Court would consider the<br \/>\nlegality and maintainability of the panchnama while considering the<br \/>\nevidence at the time of deciding the Civil Suit.\n<\/p>\n<p>3.\tIt<br \/>\nis evident from the impugned order passed by the learned Single Judge<br \/>\nthat nothing has been observed against the appellants herein, which<br \/>\ncan be said to be prejudicial to their interest.\n<\/p>\n<p>4.\tWe<br \/>\nare of the view that learned Single Judge while confirming the order<br \/>\npassed by the learned Civil Judge, which was the subject matter of<br \/>\nchallenge, made certain suitable observations and disposed of the<br \/>\npetition.\n<\/p>\n<p>5.\tWe<br \/>\ndo not see any reason to interfere with the said judgment and order<br \/>\npassed by the learned Single Judge dated 19.10.2010 in SCA No. 13796<br \/>\nof 2010.  In this view of the matter, we dismiss the appeal with no<br \/>\norder as to costs.
