Justice K.T.SANKARAN\n\n Dated :16\/11\/2009\n\n O R D E R\n                         K.T.SANKARAN, J.\n            ------------------------------------------------------\n                      B.A. NO. 4233 OF 2009\n            ------------------------------------------------------\n          Dated this the 16th day of November, 2009\n\n                               O R D E R\n<\/pre>\n<p>      This is an application for anticipatory bail under Section 438 of<\/p>\n<p>the Code of Criminal Procedure. Petitioners are accused Nos.1 to 4<\/p>\n<p>in Crime No.250 of 2009 of Sooranad Police Station, Kollam District.<\/p>\n<p>      2.  The offences alleged against the petitioners are under<\/p>\n<p>Sections 324, 326 and 341 of the Indian Penal code.<\/p>\n<p>      3.    When the Bail Application came up for hearing on<\/p>\n<p>5.11.2009, the following order was passed:<\/p>\n<blockquote><p>             &#8220;After having heard the learned counsel for the<\/p>\n<p>      petitioners and the learned Public Prosecutor, I am of<\/p>\n<p>      the view that before disposing of the Bail Application,<\/p>\n<p>      an opportunity should be given to the petitioners to<\/p>\n<p>      appear before the investigating officer. Accordingly,<\/p>\n<p>      there will be a direction to the petitioners to appear<\/p>\n<p>      before the investigating officer at 9 AM on 9th and 10th<\/p>\n<p>      November, 2009.\n<\/p><\/blockquote>\n<p>B.A. NO. 4233 OF 2009<\/p>\n<p>                                       :: 2 ::\n<\/p>\n<p>              Post on 16th November, 2009.\n<\/p>\n<p>              It is submitted by the learned Public Prosecutor that<\/p>\n<p>       the petitioners will not be arrested until further orders in<\/p>\n<p>       connection with Crime No.250 of 2009 of Sooranad Police<\/p>\n<p>       Station.&#8221;\n<\/p>\n<\/p>\n<p>      4. It is submitted by the learned counsel for the petitioners as well<\/p>\n<p>as the learned Public Prosecutor that the direction in the order dated<\/p>\n<p>5.11.2009 has been complied with by the petitioners.<\/p>\n<p>      5. Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and also taking note of the fact that<\/p>\n<p>the direction in the order dated 5.11.2009 has been complied with by<\/p>\n<p>the petitioners, I am of the view that anticipatory bail can be granted<\/p>\n<p>to the petitioners. There will be a direction that in the event of the<\/p>\n<p>arrest of the petitioners, the officer in charge of the police station<\/p>\n<p>shall release them on bail on their executing bond for Rs.15,000\/-<\/p>\n<p>each with two solvent sureties for the like amount to the satisfaction<\/p>\n<p>of the officer concerned, subject to the following conditions:<\/p>\n<blockquote><p>       a)     The petitioners shall report before the investigating<br \/>\n              officer between 9 A.M.         and 11 A.M. on alternate<br \/>\n              Mondays, till the final report is filed or until further<br \/>\n              orders;\n<\/p><\/blockquote>\n<p>B.A. NO. 4233 OF 2009<\/p>\n<p>                                    :: 3 ::\n<\/p>\n<\/p>\n<p>      b)    The petitioners shall appear before the investigating<br \/>\n            officer for interrogation as and when required;<\/p>\n<p>      c)    The petitioners shall not try to influence the prosecution<br \/>\n            witnesses or tamper with the evidence;<\/p>\n<p>      d)    The petitioners shall not commit any offence or indulge<br \/>\n            in any prejudicial activity while on bail;<\/p>\n<p>      e)    In case of breach of any of the conditions mentioned<br \/>\n            above, the bail shall be liable to be cancelled.<\/p>\n<p>      The Bail Application is allowed to the extent indicated above.<\/p>\n<p>                                                  (K.T.SANKARAN)<br \/>\n                                                          Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Babu vs State Of Kerala on 16 November, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 4233 of 2009() 1.
