Nayan Tara) pending in the<\/p>\n<p>                court of the Additional District Judge, Fast Track-II, Lakhisarai to<\/p>\n<p>                the court of the Principal Judge, Family Court, East Champaran at<\/p>\n<p>                Motihari.\n<\/p>\n<p>                            It is submitted on behalf of the petitioner that the matter<\/p>\n<p>                of guardianship is with respect to the minor daughter of the<\/p>\n<p>                petitioner. It is further submitted that the petitioner is residing with<\/p>\n<p>                her parent at Raxaul in the district of East Champaran and for<\/p>\n<p>                want of any independent source of income as also in absence of<\/p>\n<p>                any person to accompany her to attend the case at Lakhisarai, it<\/p>\n<p>                becomes very difficult for the petitioner to participate in the above<\/p>\n<p>                proceedings. Learned counsel further submits that there are two<\/p>\n<p>                cases&#8211;one under section 498A of the Penal Code and another for<\/p>\n<p>                maintenance under section 125 of the Code of Criminal<\/p>\n<p>                Procedure&#8211;pending against the opposite party at Motihari. In the<\/p>\n<p>                above circumstances also, aforesaid guardianship case be<br \/>\n<span class=\"hidden_text\">                         -2-<\/span><\/p>\n<p>      transferred from Lakhisarai to the competent court at Motihari.<\/p>\n<p>                 Learned counsel appearing for the opposite party<\/p>\n<p>      submits that the opposite party has no objection to the transfer.<\/p>\n<p>      However, the case may be disposed of at the earliest.<\/p>\n<p>                 Considering the submissions of the parties and the<\/p>\n<p>      grounds for transfer as submitted on behalf of the petitioner, let<\/p>\n<p>      the aforesaid Guardianship Case No.2 of 2009 (Yogendra Kumar<\/p>\n<p>      Vrs. Nayan Tara) pending in the court of the Additional District<\/p>\n<p>      Judge, Fast Track-II, Lakhisarai be transferred to the court of the<\/p>\n<p>      District and Sessions Judge, East Champaran at Motihari for<\/p>\n<p>      disposal. The District Judge may either dispose of the case or<\/p>\n<p>      transfer the same to any competent court.\n<\/p>\n<p>                 Let the records of aforesaid Guardianship Case no.2 of<\/p>\n<p>      2009 be sent to the District and Sessions Judge, East Champaran<\/p>\n<p>      at Motihari immediately. The petitioner and the opposite party,<\/p>\n<p>      both, are directed to appear in the court of the District Judge, East<\/p>\n<p>      Champaran at Motihari on 15th of November, 2011, when a fresh<\/p>\n<p>      date of hearing be fixed.\n<\/p>\n<p>                 The M.J.C. application stands disposed of.\n<\/p>\n<p>                 Let the order be communicated to the District and<\/p>\n<p>      Sessions Judge, Munger for immediate communication and<\/p>\n<p>      needful to the court of the Additional District Judge, Fast Track<\/p>\n<p>      Court-II, Lakhisarai, through fax on the cost being deposited by<\/p>\n<p>      the petitioner.\n<\/p>\n<\/p>\n<pre>PNM                                  (Shailesh Kumar Sinha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
