Kumar, AC<br \/>\n                                             to SC XI\n<\/p>\n<p>                                     &#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>5   30.3.2011                   Heard learned counsel for the parties.<\/p>\n<p>                                There is no mechanism by which the High Court<\/p>\n<p>                while exercising power under Article 226 of the Constitution of<\/p>\n<p>                India will give its judicial opinion on the delinquent and fraudulent<\/p>\n<p>                conduct in an adjudication which has been made by quasi judicial<\/p>\n<p>                authority, who was the erstwhile Member of the District Teachers<\/p>\n<p>                Employment Appellate Authority. When the details of his wrong<\/p>\n<p>                doing tumbled out an enquiry was made and even an FIR has been<\/p>\n<p>                lodged against the Member and other office staff of the said<\/p>\n<p>                appellate authority which would be evident from annexure-B to<\/p>\n<p>                the counter affidavit filed today.\n<\/p>\n<p>                                The petitioner is a beneficiary of fraudulent<\/p>\n<p>                decision which in the opinion of the Court the petitioner can not<\/p>\n<p>                draw advantage of. The so called objection that what was done by<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>      the S.D.O. on the adjudications made by the appellate authority is<\/p>\n<p>      beyond his powers is also a misplaced stand as annexure-4 is only<\/p>\n<p>      a recommendation in the emerging facts.\n<\/p>\n<p>                     The Court is in agreement with the stand taken by<\/p>\n<p>      the State that the report of the Sub-Divisional Officer was only a<\/p>\n<p>      report on enquiry having been made extensively with regard to<\/p>\n<p>      large number of such orders from which benefit was derived by<\/p>\n<p>      the candidates illegally. Based on findings thereof the subsequent<\/p>\n<p>      decisions for stoppage of salary and may be removal in some cases<\/p>\n<p>      has been passed by the competent authority. There is nothing to<\/p>\n<p>      show that the Sub-Divisional Officer has issued the concerned<\/p>\n<p>      order. It is only his recommendation and the law does bar making<\/p>\n<p>      such an enquiry in such a situation to put the administration of<\/p>\n<p>      justice even by a quasi judicial authority clean and above board.<\/p>\n<p>                     This writ application has no merit and it is<\/p>\n<p>      dismissed.\n<\/p>\n<p>                     A direction is hereby issued to the District<\/p>\n<p>      Magistrate, Aurangabad that he shall personally look into the<\/p>\n<p>      matter and take the issue to its logical end on all fronts including<\/p>\n<p>      the criminal case lodged against the member of appellate<\/p>\n<p>      authority.\n<\/p>\n<\/p>\n<pre>RPS                  (Ajay Kumar Tripathi,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Rameshwar Kumar Singh vs The State Of Bihar &amp;Amp; Ors on 30 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.8398 of 2010 1.
