Ninama, PSI, Gujarat University Police Station along with Woman<br \/>\nConstable Lilaben are present.  Learned Advocate Mr. Mehul M Mehta,<br \/>\nfor the applicant and learned Advocate Mr. A.R. Lakhia  for<br \/>\nrespondents No. 5 to 8 are also present.  Learned APP Mr. K.C. Shah,<br \/>\nIn-charge of the matter along with learned APP Mr. L.B. Dabhi, both<br \/>\nare present.\n<\/p>\n<p>\t\tIn<br \/>\npresence of all, Manaliben, who was made aware of the pleadings and<br \/>\nfacts of this Application and on inquiry, states that her date of<br \/>\nbirth is 25th of October,1989 and that on her own<br \/>\nvolition, she has entered into marriage with one Ajay Bhavsar  &#8211;<br \/>\nRespondent No.5 herein. She submits a copy of the Marriage<br \/>\nCertificate and Affidavit, which are taken on record.   She was, in<br \/>\npresence of the learned Advocate for the applicant, asked whether she<br \/>\nhad informed her father  &#8211; applicant  on land line phone on 01st<br \/>\nof August, 2008 about 3.45 am and had conveyed to her father that<br \/>\nAjay Bhavsar  had kidnapped her  and detained her to some unknown<br \/>\nplace. She flatly  denies the allegations made in the petition and<br \/>\nthis fact.\n<\/p>\n<p>\t\tManaliben<br \/>\n has expressed her wish to go with her husband &#8211; Ajay Bhavsar, who is<br \/>\npresent before the Court. Manaliben is major and she is free to go<br \/>\nanywhere she wishes.\n<\/p>\n<p>\t\tWe<br \/>\nhave found allegations made in the petition to be false and not true.<br \/>\nIn this respect, learned Advocate for the applicant Mr. Mehul M.<br \/>\nMehta   was heard and he states that ultimately the applicant is<br \/>\nfather of the girl and there cannot be any intention of the father<br \/>\nexcept to bring the corpus  and ascertain the wishes of his daughter.<br \/>\n We also made aware to the learned Advocate for the applicant that we<br \/>\nare inclined to saddle the applicant with cost for putting the law<br \/>\nwrongly in motion and when the facts of the petition were not found<br \/>\ncorrect.\n<\/p>\n<p>\t\tIn<br \/>\nview of above, this petition stands disposed of. Notice is<br \/>\ndischarged.  Manaliben is free to go with Ajay Bhavsar. Woman<br \/>\nConstable Lilaben and Mr. R.V. Ninama, PSI, Gujarat University Police<br \/>\nStation will see to that   Manaliben  reaches to her destination<br \/>\nsafely.  In above view of matter, applicant is directed to pay cost<br \/>\nof Rs. 10,000\/-  for filing such application within 10 days from<br \/>\ntoday before the Registry of this Court, failing which, the Registry<br \/>\nshall take appropriate proceedings  against the applicant without<br \/>\nreferring to this Court.  In case of depositing the amount within the<br \/>\n stipulated time, the amount shall be made over to the High Court<br \/>\nLegal Aid Committee.\n<\/p>\n<p>(J.\n<\/p>\n<p>R.
