Dabhi, learned APP appears and waives service of notice of  Rule<br \/>\non behalf of  the respondent &#8211; State of Gujarat.\n<\/p>\n<p>3\tHaving<br \/>\nregard to the facts of the case,  the application is taken up for<br \/>\nhearing today.\n<\/p>\n<p><span class=\"hidden_text\">4\t<\/span><\/p>\n<p>The applicant &#8211;  convict prisoner, who vide judgment and order dated<br \/>\n10.4.2008,  rendered in Sessions Case No. 78 of 2008, by the learned<br \/>\nAdditional Sessions Judge, Nadiad, has been convicted for the offence<br \/>\npunishable under Sections 363 and 376 of the Indian Penal Code and<br \/>\nsentenced to undergo rigorous imprisonment of 10 years,  has filed<br \/>\nthis Application, through jail authority, praying  to enlarge him  on<br \/>\ntemporary bail, for a period of 30 days,  to enable him to  render<br \/>\nfinancial assistance to his family members who are starving on<br \/>\naccount of  paucity of funds.\n<\/p>\n<p>5\tWe<br \/>\nhave considered the submission made by Mr. L.B. Dabhi, learned APP<br \/>\nfor the respondent- State of Gujarat.  We have also perused the<br \/>\naverments made in the application.  We have also gone through the<br \/>\njail remarks sheet forwarded by the jail authority  along with the<br \/>\napplication.\n<\/p>\n<p>6\tUpon<br \/>\nperusal  of the jail remarks sheet, we find that the applicant has<br \/>\nundergone  total period of  imprisonment of  3 years, 8 months and 10<br \/>\ndays.  During the said period  he has enjoyed only one furlough   in<br \/>\n2009 and has surrendered  in time.  There is no jail punishment.<br \/>\nBesides this, his  jail  conduct is good.   In view of the aforesaid,<br \/>\nif the applicant is released on temporary bail for a period of 15<br \/>\ndays from the date of his actual release, the same would meet the<br \/>\nends of justice.\n<\/p>\n<p>7\tFor<br \/>\nthe foregoing reasons,  the Application succeeds in part.<br \/>\nAccordingly,  it is partly allowed. The applicant  &#8211; convict prisoner\n<\/p>\n<p>&#8211; RANJIT<br \/>\nCHHOTABHAI<br \/>\nis ordered to be released on  temporary bail  for a period of 15 days<br \/>\n from the date of  his   actual  release on executing a personal bond<br \/>\nof Rs. 5,000\/- before the Jail Authority on usual terms and<br \/>\nconditions.
