Justice ANTONY DOMINIC\n\n Dated :04\/11\/2009\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                     ================\n                   W.P.(C) No. 28253 OF 2008\n                                   &amp;\n                   W.P.(C) No. 21396 OF 2009\n                =====================\n\n           Dated this the 4th day of November, 2009\n\n                           J U D G M E N T\n<\/pre>\n<p>          In these writ petitions, the challenge is against the re-<\/p>\n<p>fixation of pay of the petitioners. It is now pointed out by both<\/p>\n<p>sides that identical issues have been considered by this Court in<\/p>\n<p>the judgment in WP(C) No.17307\/08 and connected cases, which<\/p>\n<p>were disposed of by judgment dated 24th of September, 2009 with<\/p>\n<p>the following directions:\n<\/p>\n<blockquote><p>        &#8220;In view of the elaborate discussion that I have<\/p>\n<p>        undertaken, I consider it appropriate to encapsulate my<\/p>\n<p>        conclusions, as hereunder:\n<\/p><\/blockquote>\n<blockquote><p>      (1)    The petitioners, who were not qualified to be<\/p>\n<p>             appointed to the post of Technical Assistant, coming<\/p>\n<p>             within the purview of the Special Rules for Kerala<\/p>\n<p>             State (Survey and Land Records), were not entitled<\/p>\n<p>             to be granted third time bound higher grade in the<\/p>\n<p>             scale of pay applicable to a Technical Assistant, on<\/p>\n<p>             completion of 25 years of service.<\/p><\/blockquote>\n<p>      (2)    The petitioners were entitled to third time bound<\/p>\n<p>             higher grade on completion of 25 years of service in<\/p>\n<p>             the scale of pay immediately above the scale of pay<\/p>\n<p>             as fixed in the revised orders, which is in consonance<\/p>\n<p>W.P.(C) No. 28253 OF 2008<br \/>\n&amp;<br \/>\nW.P.(C) No. 21396 OF 2009<br \/>\n<span class=\"hidden_text\">                                   :2 :<\/span><\/p>\n<p>             with Clause 3(b)(vii) of G.O.(P)No.930\/93.<\/p>\n<p>      (3)    The revision of the scale of pay and consequent<\/p>\n<p>             revision of the pension being drawn by the<\/p>\n<p>             petitioners as effected in the orders impugned in the<\/p>\n<p>             present cases are upheld, subject to the directions<\/p>\n<p>             issued hereunder:\n<\/p>\n<p>          (a)   The    respondents     are    restrained   from<\/p>\n<p>                effecting    recovery    of    any    amounts,<\/p>\n<p>                consequent upon the impugned re-fixation of<\/p>\n<p>                pay and revision of pension, effected in the<\/p>\n<p>                case of these petitioners till and inclusive of<\/p>\n<p>                the date of this judgment.\n<\/p>\n<p>          (b)   The petitioners, in each one of these cases,<\/p>\n<p>                may    file  a    representation   before   the<\/p>\n<p>                Government within two months from the date<\/p>\n<p>                of receipt of a copy of this judgment, invoking<\/p>\n<p>                Rule 7 of Part I of the KSR, and request the<\/p>\n<p>                Government to exempt them from the re-<\/p>\n<p>                fixation of pay and consequent revision of<\/p>\n<p>                their pension and also to see that the pension<\/p>\n<p>                originally fixed in each of their cases is<\/p>\n<p>                continued.\n<\/p>\n<p>          (c)   The    Government       shall   consider    the<\/p>\n<p>                representations    filed  by   the   petitioners<\/p>\n<p>                sympathetically and in the light of the<\/p>\n<p>                observations contained in this judgment on<\/p>\n<p>W.P.(C) No. 28253 OF 2008<br \/>\n&amp;<br \/>\nW.P.(C) No. 21396 OF 2009<br \/>\n<span class=\"hidden_text\">                                  :3 :<\/span><\/p>\n<p>                humanitarian considerations and take         a<\/p>\n<p>                decision as early as possible.\n<\/p>\n<p>          (d)   It is made clear that the Government will be<\/p>\n<p>                entitled to indicate, if they decide to accept<\/p>\n<p>                the   case   of  the    petitioners, that  the<\/p>\n<p>                Government&#8217;s decision need not be treated<\/p>\n<p>                as a precedent in any other case.\n<\/p>\n<p>          (f)   The interim order in each one of these cases<\/p>\n<p>                will continue to operate, till a decision is<\/p>\n<p>                taken    by    the    Government     on    the<\/p>\n<p>                representations filed by the petitioners as<\/p>\n<p>                aforementioned.\n<\/p>\n<p>          (g)   But, it is made clear that recovery for the<\/p>\n<p>                period, subsequent to the date of this<\/p>\n<p>                judgment, will abide by the decision to be<\/p>\n<p>                taken by the Government as aforementioned.<\/p>\n<p>      2.    Facts being identical, the petitioners are also eligible<\/p>\n<p>for the benefit of the aforesaid directions and it is so clarified.<\/p>\n<p>      3.    In so far as WP(C) No.28253\/08 is concerned, petitioner<\/p>\n<p>has a case that the amount mentioned in Ext.P6 viz., Rs.15,702\/-<\/p>\n<p>has been withheld from his pension and that in view of this<\/p>\n<p>judgment, the said amount is to be disbursed. In the light of the<\/p>\n<p>judgment referred to above, if any amount is withheld, that is<\/p>\n<p>W.P.(C) No. 28253 OF 2008<br \/>\n&amp;<br \/>\nW.P.(C) No. 21396 OF 2009<br \/>\n<span class=\"hidden_text\">                                :4 :<\/span><\/p>\n<p>liable to be disbursed.
