Justice K.K.DENESAN\n\n Dated :24\/01\/2007\n\n O R D E R\n                                      K.K.DENESAN, J.\n\n                    -------------------------------------\n\n                      WP(C)Nos. 2452, 2523 &amp; 2587 OF 2007\n\n                      ------------------------------------\n\n                       Dated this the 24th January, 2007.\n\n\n\n                                         JUDGMENT\n<\/pre>\n<p>      These   writ   petitions   raise   an   identical   question   and<\/p>\n<p>therefore   disposed   of   by   this   common   judgment.                                          The<\/p>\n<p>petitioners   are   candidates   before   the   respondent-Public<\/p>\n<p>Service   Commission   seeking   for   appointment   to   the   post   of<\/p>\n<p>District            Probation         Officer          in         the         Social            Welfare<\/p>\n<p>Department.     The   notification   issued   by   the   Commission   as<\/p>\n<p>well   as   the   relevant   rules   requires   the   candidates   to<\/p>\n<p>possess   certain   essential   qualifications.                                    A   bachelors<\/p>\n<p>degree   in   Social   Work   or   Social   Services   is   one   of   the<\/p>\n<p>qualifications.     Some   of   the   petitioners   possess   a   Post<\/p>\n<p>Graduate Degree in Sociology.   But none of them possesses a<\/p>\n<p>degree   in             Social          Work   or   Social   Services.                              The<\/p>\n<p>respondent-Commission   has   taken   up   the   stand   that   the<\/p>\n<p>petitioners   are   not   qualified,   and   therefore,   they   cannot<\/p>\n<p>be   permitted   to   participate   in   the   further   selection<\/p>\n<p>process including interview.\n<\/p>\n<p>      2.  Counsel for the Commission has brought to my notice<\/p>\n<p>the  judgment   of   the   Division   Bench   of   this   Court   in  <a href=\"\/doc\/290043\/\">Mukesh<\/p>\n<p>v. State of Kerala<\/a>  {2006(4) KLT 1023}.   It appears that the<\/p>\n<p>ratio   of   the   above   decision   squarely   applies   to   the   point<\/p>\n<p>raised         for         consideration         in          these            writ         petitions.\n<\/p>\n<p><span class=\"hidden_text\">WPC 2452\/07 etc.                     2<\/span><\/p>\n<p>Precisely   the   issue   discussed   in   the   above   judgment   is   the<\/p>\n<p>same   and   the   ultimate   finding   is   against   the   petitioners.\n<\/p>\n<p>The   Division   Bench   has   held   that   unless   the   candidates<\/p>\n<p>possess   a   degree   in   Social   Work   or   Social   Services,   they<\/p>\n<p>have  no   right   to   participate   in   the   selection   process.     It<\/p>\n<p>follows   that   these   writ   petitions   are   liable   to   be<\/p>\n<p>dismissed.
