      This petition is for anticipatory bail.\n<\/p>\n
      2.   The alleged offences are under Sections 498A and 306<\/p>\n
IPC. According to prosecution, husband and sister in laws of the<\/p>\n
deceased were harassing her after the marriage and she was also<\/p>\n
abetted to commit suicide. After recording a suicide note, she<\/p>\n
committed suicide by consuming poison.\n<\/p>\n
      3.   Learned counsel for petitioners submitted that the<\/p>\n
deceased Sheeba Rani’s husband was in Gulf after the marriage<\/p>\n
and he came back in the month of April 2008. In the meantime,<\/p>\n
she developed an affair with a person named Reji to whom she<\/p>\n
gave half portion of the house on rent to run a computer<\/p>\n
business. In respect of this, there were several quarrels and even<\/p>\n
her family members were against this.                       Therefore, she had<\/p>\n
written a letter to the husband stating that all of them are ill<\/p>\n
treating her (vide Annexure III). She was forced to break her<\/p>\n
relationship with Reji under mental depression and she therefore,<\/p>\n
committed suicide and petitioners are not responsible for the<\/p>\n
suicide.\n<\/p>\n

      4.   It is also submitted that as per the First Information<\/p>\n
Statement, there is no allegation that petitioners who are the<\/p>\n
sister in laws of the deceased had harassed her. On the other<\/p>\n
hand, the allegations were made against the husband. It is also<\/p>\n
pointed out that the first accused was in custody for the past 48<\/p>\n
days after his arrest and he was released on bail.          Hence,<\/p>\n
petitioners may also be granted anticipatory bail, it is submitted.<\/p>\n
      5.   Further it is submitted that the first accused had a<\/p>\n
complaint against deceased Sheeba Rani and Reji alleging that<\/p>\n
they are threatening him stating that complaints will be filed<\/p>\n
against him under Section 498A IPC and also under the Domestic<\/p>\n
Violence Act. Copy of this complainant is produced as Annexure<\/p>\n
II. Learned counsel for petitioners submitted that none of the<\/p>\n
neighbours of the house where the deceased committed suicide<\/p>\n
are questioned by the Investigating Officer. Instead neighbours<\/p>\n
of the parental house of the deceased are questioned by the<\/p>\n
Investigating Officer, it is submitted.\n<\/p>\n
      6.   This petition is strongly opposed.      Learned public<\/p>\n
prosecutor submitted that all the relevant allegations are made in<\/p>\n
the First Information Statement given by brother of the deceased<\/p>\n
Sheeba Rani. First Information Statement will reveal that while<\/p>\n

the defacto complainant was working abroad, he received a<\/p>\n
phone call alleging that the deceased was being harassed<\/p>\n
physically and mentally by the accused nos.1 to 3. His mother<\/p>\n
made a phone call stating that the sister in laws were harassing<\/p>\n
her and hence, immediately he called his sister and he also called<\/p>\n
his brother in law (A1) and on knowing that she was being<\/p>\n
tortured at the house, he immediately left Dubai.<\/p>\n
      7.   The defacto complainant came by flight and reached<\/p>\n
home on 20th evening.     By the time, deceased had consumed<\/p>\n
poison and she was hospitalised and on the next day, she died. It<\/p>\n
is also pointed out that she had written a suicide note making<\/p>\n
specific allegation that she was harassed by both the petitioners<\/p>\n
physically and mentally and that they also abetted her to commit<\/p>\n
suicide.\n<\/p>\n
      8.   Learned    public  persecutor   also   submitted  that<\/p>\n
witnesses are questioned and the dying declaration itself reveals<\/p>\n
the cruelty. The FIR fully supports the case of the prosecution<\/p>\n
and it is not correct to say that no allegations are made therein<\/p>\n
against petitioners. Specific allegations are made in FIS against<\/p>\n
petitioners. The situation was so serious and compelling. So that<\/p>\n
on getting phone calls defacto complainant came over the way<\/p>\n

from abroad without any delay but, by the time she had<\/p>\n
committed suicide. This is not a fit case to grant anticipatory<\/p>\n
bail, it is submitted.\n<\/p>\n
      9.     On hearing both sides and on going through the<\/p>\n
documents, case diary, particularly, the suicide note and the First<\/p>\n
Information Statement, I am satisfied of the submissions made<\/p>\n
by learned public prosecutor and in a case of this nature, it is not<\/p>\n
fit and proper to grant anticipatory bail. The crime is registered<\/p>\n
as early as on 21.7.2008 and petitioners have not surrendered<\/p>\n
before the court below and they were not available for<\/p>\n
interrogation.\n<\/p>\n
             Therefore, petitioners are directed to surrender before<\/p>\n
             the Investigating Officer without any delay and co-<\/p>\n
             operate with investigation. Whether they surrender or<\/p>\n
             not, police is at liberty to arrest them at any time and<\/p>\n
             proceed in accordance with law.\n<\/p>\n
      With this direction, petition is dismissed.<\/p>\n
