Justice K.T.SANKARAN\n\n Dated :12\/01\/2010\n\n O R D E R\n                       K.T.SANKARAN, J.\n                    --------------------------------------\n                        B.A.No.68 of 2010\n                    ---------------------------------------\n             Dated this the 12th day of January, 2010\n\n\n                              ORDER\n<\/pre>\n<p>        This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure. The petitioner is accused No.4 in<\/p>\n<p>Crime No.904 of 2009 of Chavara Police Station.<\/p>\n<p>      2. The offences alleged against the petitioner are under<\/p>\n<p>Sections 143, 147, 148, 323, 324, 326 and 307 read with Section<\/p>\n<p>149 of the Indian Penal Code and Section 27 of the Arms Act.<\/p>\n<p>      3.   The prosecution case is that on 18.11.2009, the<\/p>\n<p>accused persons attacked the de facto complainant with a<\/p>\n<p>chopper and he sustained grievous injuries. It is alleged that the<\/p>\n<p>offence was committed by the accused on account of the fact that<\/p>\n<p>there was delay in serving liquor in the Bar hotel in which the<\/p>\n<p>de facto complainant was the waiter.                     The petitioner was<\/p>\n<p>arrested on 24.12.2009.\n<\/p>\n<p>      4.   It is submitted that all the accused persons in the case<\/p>\n<p>were arrested. The investigation is also at the final stage.<\/p>\n<p>      5.   Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioner, the nature of the offence and the present stage of<\/p>\n<p><span class=\"hidden_text\">BA No.68\/2010                        2<\/span><\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioner on stringent conditions.\n<\/p>\n<p>      The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.25,000\/- with two solvent sureties for the like<\/p>\n<p>amount to the satisfaction of the Judicial Magistrate of the First<\/p>\n<p>Class, Karunagappally, subject to the following conditions:<\/p>\n<p>a)    The petitioner shall report before the investigating officer<br \/>\n      between 9 A.M. and 11 A.M. on all Mondays and Thursdays,<br \/>\n      till the final report is filed or until further orders;<\/p>\n<p>b)    The petitioner shall appear before the investigating officer<br \/>\n      for interrogation as and when required;\n<\/p>\n<p>c)    The petitioner shall not enter into the police station limits<br \/>\n      of Chavara Police Station for a period of two months except<br \/>\n      for complying with conditions (a) and (b);<\/p>\n<p>d)    The petitioner shall not try to influence the prosecution<br \/>\n      witnesses or tamper with the evidence;\n<\/p>\n<p>e)    The petitioner shall not commit any offence or indulge in<br \/>\n      any prejudicial activity while on bail;\n<\/p>\n<p>f)    In case of breach of any of the conditions mentioned above,<br \/>\n      the bail shall be liable to be cancelled.\n<\/p>\n<p>\n      The Bail Application is allowed as above.<\/p>\n<p>                                                   K.T.SANKARAN,<br \/>\n                                                         JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Kanakarajan vs State Of Kerala on 12 January, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 68 of 2010(K) 1.
